O R D E R
WHEREAS, the U.T. Administration of Daman & Diu is of the opinion that an Induistrial dispute exists between M/s. PCL Oil & Solvents Ltd., 56, Dunteha Industrial Zone, Bhenslore, Kunta Road, Daman and its employee Shri Jayeshkumar Kesavbhai Patel in respect of the matter specified in the Second Shcedule annexed hereto (hereinafter referred to as the „said dispute").
AND WHEREAS, the U.T. Administration of Daman & Diu considers it expedient to refer the said dispute for adjudication.
NOW THEREFORE, in exercise of the powers conferred by clause "c" sub-section 1 of Section 10 of the Industrial Disputes Act, 1947, I Danish Ashraf, Labour Commissioner, Daman hereby refer the said dispute to the Labour Court for adjudication.

NOTIFICATION
In order to promote Water Conservation Programme in the districts of the Daman and Diu, and in pursuance to the provision contained under Rule 56 of the Daman and Diu Minor Mineral Concession Rules, 2013, distilling and deepening of Ponds/Lakes and water Bodies shall be allowed and extraction of Murrum, Kankar, Sand and Stone shall be permissible for r the purpose of being used in Government Work, Public Works.
Further, in pursuance to the provisions contained in the Sub-rule (2) of Rule 47 of the Daman and Diu Minor Mineral Concession Rules, 2013, the rate of Royalty is declared as „NIL" for the purpose of caring out the work of Distilling/Digging and Deepening of Ponds/Lakes and Water bodies and for extraction of Murrum, Kankar, Sand and Stone being used in Government Works, Public Works as per the provision of Rule 56.
The above provision shall be subject to the following conditions:-
1. Prior permission/consent for the deepening the pond / lake should be taken from respective Competent Authority/ Collector of the District before the deepening and ensure, that no damage to be caused to clay wall/other structure works/structure, of pond, as well as ensure that deepening be done so as to maximize and efficient use of storage of water.
2. During the excavation, if other minerals except pain soil/slit/morph are found, the Collector concerned should be informed and not to move such minerals. Transport or storage of such minerals will be considered unauthorized.
3. Soil, Murrum extracted from deepening of ponds, reservoirs cannot be sold and to be used as per provision only.
4. If any of the conditions of the Permit are violated, strict action as per the Rules shall be taken.

In pursuance to Notification No. BDO/DMN/DIGGING.PONDS/2019 dated 26.04.2021 and to promote water conservation, the following Nine (09) ponds / lakes / water bodies located in the rural jurisdiction of Daman District is hereby notified for the purpose of carrying out the activities of desilting and deepening of ponds / lakes and water bodies.

The rate of Royalty has been declared „NIL" for the purpose of carrying out the work of desilting / digging and deepening of ponds / lakes and water bodies and the extraction of Murrum, Kankarm, Sand and stone for the purpose of being used in the Government Works, Public works, shall be as per the provision of Rule 56 of the Daman and Diu Minor Mineral Concession Rules, 2013.

DECLARATION
WHEREAS, vide Preliminary Notification No. 3/73/2019/LND-ACQ/2019-20/8655 dated 19/11/2020, it was Notified under section 11 of the Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the lands described in the Schedule annexed with the said Notification was needed or likely to needed for the public purpose, namely for the purpose of Acquisition of land for widening of road from Somnath Junction Upto Kachigam Zari Bridge, Nani Daman.
WHEREAS, as required under sub section (2) of section 15 of the Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, objection were accorded personal hearing by the Collector, Daman on 18/02/2021, and a report was submitted to the Government Authority i.e. Administration of Daman & Diu for the proceed with acquisition process and the same has been approved by the Appropriate Government i.e. Administrator of Daman & Diu.
AND WHEREAS, the UT Administration of Daman & Diu is satisfied on the basis of the Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the said land as described in the schedule hereto hereafter referred to as the said land/lands is need for the public purpose.
NOW, THEREFORE, it is hereby declared under the Provision of Section 19 of the Land Acquisition & Rehabilitation Act that the said lands are required for the public purpose, namely, Acquisition of land for widening of road from Somnath Junction Upto Kachigam Zari Bridge, Nani Daman. PRELIMINARY NOTIFICATION
No.3/94/LND-ACQ/2020-21/1904 Date: - 29/04/2021
Whereas, it appears to the appropriate Government that a total of 1919.00 Sq. Mtrs. land is required in the Nani Daman, Daman District for public purpose, namely, Acquisition of land for widening of Road starting from Bus Stand Nani Daman to Jetty Garden Nani Daman via Jain Street, Nani Daman.
2. Therefore, It is notified that for the above said project in the Nani Daman of Daman District, a piece of land measuring, of 1919.00 Sq. Mtrs. of standard measurement, the details of the land acquisition as per the Annexure – I is enclosed herewith.
3. This Notification is made under the provisions of Section-11(1) of the Right to Fair Compensation and transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), to all whom it may concern.
4. A plan of the land may be inspected in the Office of the Collector, Dholar, Moti Daman and the Chief Officer, Daman Municipal Council, Daman (Requiring Body) during the working day and working hours.
5. The Government is pleased to authorize Mamlatdar, Daman and his Talathi to enter upon and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in Section-12 of the said Act.
6. Under Section-11(4) of the Act, no person shall make any transaction or cause any transaction of land i.e. sale / purchase, etc. or create any encumbrances on such land from the date of publication without prior approval of the Collector.
7. Objections to the acquisition, if any, may be filed by the person interested within 60 (Sixty Days) from the date of publication of this notification as provided under Section-15 of the Act before Collector.

PRELIMINARY NOTIFICATION
No.3/59/2019/LND-ACQ/2018-19/1916 Date:- 29/04/2021
Whereas, it appears to the appropriate Government that a total of 720.00 Sq. Mtrs. land is required in the Moti Daman, Daman District for public purpose, namely, Acquisition f land for Extension of Secretariat Building, Moti Daman.
2. Therefore, it is notified that for the above said project in the Nani Daman of Daman District, a piece of land measuring of 720.00 Sq. Mtrs. of standard measurement, the details of the land acquisition as per the Annexure – I is enclosed herewith.
3. This Notification is made under the provisions of Section-11(1) of the Right to Fair Compensation and transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), to all whom it may concern.
4. A plan of the land may be inspected in the Office of the Collector, Dholar, Moti Daman and Executive Engineer, PWD, Work Division No.1, Moti Daman (Requiring Body) during the working day and working hours.
5. The Government is pleased to authorize Mamlatdar, Daman and his Talathi to enter upon and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in Section-12 of the said Act.
6. Under Section-11(4) of the Act, no person shall make any transaction or cause any transaction of land i.e. sale / purchase, etc. or create any encumbrances on such land from the date of publication without prior approval of the Collector.
7. Objections to the acquisition, if any, may be filed by the person interested within 60 (Sixty Days) from the date of publication of this notification as provided under Section-15 of the Act before Collector.
