NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 of the constitution, with Government of India, Ministry of Home Affairs, Order No.7/1/65-Estt.(A), dated 16th February, 1965 and Ministry of Home Affairs Notification No.3(4)/65-GP, dated 27th January, 1965 read with Department of Personnel and Training Notification No.39023/02/2015-Estt(B), dated 25th May, 2017 and in supersession of the existing Recruitment Rules for the posts and all other powers enabling him in this behalf, the Administrator of UT of Dadra and Nagar Haveli and Daman and Diu and hereby makes the following rules relating to the recruitment rules relating to the recruitment of General Central Services, Groups „B" (Non-Gazetted/Non Ministerial) posts of Skipper Mate (Sub- Inspector) in the Police Department, Administration of Dadra and Nagar Haveli and Daman and Diu namely.

1. Short title, application and commencement :

(i) These rules may be called the Administration of Dadra and Nagar Haveli and Daman and Diu, Group "B" (Non-Gazetted/Non-Ministerial) posts of Skipper Mate (Sub- Inspector) Recruitment Rules, 2022.

(ii) These rules shall apply to the posts specified in column 1 of the Schedule to these rules (hereinafter called the said schedule).

(iii) These rules will come into effect from the date of publication of this notification in the Official Gazette and will relate to appointment to the various posts made on or after this date.

2. Number, classification and level of Pay Matrix:- The number of posts, classification and the level of pay matrix attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

Provided that, the Administrator of Dadra and Nagar Haveli and Daman and Diu may vary the number of posts in Column 2 of the said Scheduled from time to time subject to exigencies of work.

3. Method of recruitment, age limit and other qualification etc.: The methods of recruitment to the said posts, age limit, qualification and other matters connected there with shall be as specified in Columns 5 to 13 of the aforesaid schedule.

4. Disqualification :

No person (a) who has entered into or contracted a marriage with a person having a spouse, living or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the service.

Provided that the Administrator of Dadra and Nagar Haveli and Daman and Diu, may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax :

Where the Administrator of Dadra and Nagar Haveli and Daman and Diu is of the opinion that, it is necessary or expedient so to do it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving :

Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for Scheduled Castes, Scheduled Tribes, Other backward Class, Ex- Servicemen and other special of persons in accordance with the orders issued by Central Government from time to time in this regard.

NOTIFICATION

Whereas, the Government intends to acquire the following land for Acquisition of land for Pedestrian Bridge Approach at Moti Daman with the concerned Panchayat/Municipality/Municipal Corporation, as the case may be, at Daman, in the affected area and carry out a Social Impact Assessment Study for public purpose. The study shall be undertaken as per the provision as section 4 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Social Impact Assessment Activities:

If any attempt of coercion or threat is noticed/brought to notice, the same will render this exercise null and void.

N O T I C E

WHEREAS, vide Preliminary Notification No. 3/59/2019/LND-ACQ/2018-19/1905 dated 29/04/2021, it was Notified under section 11 of the Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land described in the schedule hereto (thereafter referred to as the said land/lands) were needed or likely to be needed for the public purpose, namely for the purpose of Shamsan Bhumi to Chhapli Sheri, Nani Daman (21.00 Mtrs Wide) for Development of Sea Front Road and Beautification of Devka Beach, Nani Daman.

WHEREAS, a report was submitted to the Government Authority i.e. Administrator of Dadra & Nagar Haveli and Daman & Diu for the proceed with acquisition process and the same has been approved by the Appropriate Government i.e. Administrator of Dadra & Nagar Haveli and Daman & Diu.

WHEREAS, vide Declaration No. 3/59/2019/LND-ACQ/2018-19/5469 dated 19/11/2021, it was declared under the provision of Section 19 of the Land Acquisition, Rehabilitation Act that the said lands are required for the public purpose, and namely for the purpose of Shamsan Bhumi to Chhapli Sheri, Nani Daman (21.00 Mtrs Wide) for Development of Sea Front Road and Beautification of Devka Beach, Nani Daman.

WHEREAS, in connection with acquisition of land admeasuring 1188.00 sq. mtrs. for Shamsan Bhumi to Chhapli Sheri, Nani Daman (21.00 Mtrs Wide) for Development of Sea Front Road and Beautification of Devka Beach, Nani Daman, the Administration of Daman intends to take possession of the land, the particulars of which are given in the declaration u/s 19(1) of the Right to Fair compensation & Transparency in Land Acquisition Rehabilitation and Resettlement (RFCTLARR) Act, 2013.

WHEREAS, under Section 21 of the RFCTLARR Act, 2013, the Government intend to take possession of the land on 02/03/2022 at 10.00 hrs., and claims to compensations and rehabilitation and resettlement for all interests in the land, has to be submitted to the Collector for disposal on or before 02/03/2022 at 15.00 hrs.

The details compensation on the land acquisition as per the Annexure – I, II & III are enclosed herewith.

WHEREAS, under sub section (1) & (2) of Section 22 of the said Act, the Collector may also require any such person to make or deliver to him a statement containing the name of every other SERIES – II No. 06 THE GAZETTE OF DNH & DD Page 18 person possessing any interest in the land or any part thereof as co-proprietor, sub-proprietor, mortgage, tenant or otherwise, and of the nature of such interest, and of the rents and profits, if any received or receivable on account thereof for three years next preceding the date of statement, every person required to make or deliver a statement under this section shall be deemed to be legally bound to do so within the meaning of section 175 and 176 of the Indian Penal Code (45 of 1860).

NOW THEREFORE, to facilitate causation of the above requirements, public notice is hereby served under section 21 of the RFCTLARR Act, 2013 that all persons having interest in the said land to appear personally or by agent or advocate before the Collector, Daman on 07/03/2022 at 11:00A.M. and to state in writing and signed by the party or his agent, the following :

a) The nature of their respective interest in their land;

b) The amount and particulars of their claims to compensation for such interests;

c) Their objection if any to the measurements made and marked on the referred area.

Please take notice that as provided under sub section 22 of the aforesaid Act, every person required to make or deliver a statement under this section shall be deemed to be legally bound to do so within the meaning of section 175 and 178 of the Indian Penal Code (45 of 1860)

The provisions of this notification shall take effect from the midnight of date of issue.
