NOTICE

WHEREAS, vide Preliminary Notification No. 65-03-LAQ-2022-23/690 dated 30/08/2024, it was notified under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land described in the schedule hereto (thereafter referred to as the said land) were needed or likely to be needed for the public purpose, namely Land Acquisition from Diu Circle to Be-Otli Strengthening and Widening of NH-251 from Km 11.000 to Km 22.770 at District Diu;

AND WHEREAS, a report was submitted to the appropriate Government i.e. Hon'ble Administrator of Dadra & Nagar Haveli and Daman & Diu to proceed with the acquisition process and the same has been approved;

AND WHEREAS, vide Declaration No. 65-03-LAQ-2022-23/189 dated 23/04/2025, it was declared under the provision of Section 19 of the Right to Fair Compensation, Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 that the said land is required for the public purpose, namely Land Acquisition from Diu Circle to Be-Otli Strengthening and Widening of NH-251 from Km 11.000 to Km 22.770 at District Diu;

AND WHEREAS, in connection with acquisition of land admeasuring 3031.00 sq. mtrs. for Land Acquisition from Diu Circle to Be-Otli Strengthening and Widening of NH-251 from Km 11.000SERIES – II No. 17 THE GAZETTE OF DNH & DD Page 2 to Km 22.770 at District Diu, the Administration of Dadra & Nagar Haveli and Daman & Diu intends to take possession of the land, the particulars of which is given in the declaration u/s 19(1) No. 65-01- LAQ-2022-23/189 dated 23/04/2025 of the Right to Fair Compensation & Transparency in Land Acquisition Rehabilitation and Resettlement (RFCTLARR) Act, 2013;

AND WHEREAS, under Section 21 of the RFCTLARR Act 2013, the Government intends to take possession of the land on 26/05/2025 at 16.00 hrs., and all claims to compensations and Rehabilitation and Resettlement for all interests in the said land, has to be submitted to the Collector for disposal on or before 23/05/2025 at 18.00 hrs;

AND WHEREAS, the details of compensation on the land acquisition as per the Annexure – I, II, III are enclosed herewith;

AND WHEREAS, under sub section (1) & (2) of Section 22 of the said Act, the Collector may also require any such person to make or deliver to him/her a statement containing the name of every other person possessing any interest in the land or any part thereof as co-proprietor, sub-proprietor, mortgage, tenant or otherwise, and of the nature of such interest, and of the rents and profits, if any received or receivable on account thereof for three years next preceding the date of statement;

NOW THEREFORE, to facilitate causation of the above requirements, public notice is hereby served under section 21 of the RFCTLARR Act, 2013 that all persons having interest in the said land to appear personally or by agent or advocate before the Collector, Diu on 26/05/2025 at 13.00 hrs., and to state in writing and signed by the party or his agent, the following:

a) The nature of their respective interest in their land;

b) The amount and particulars of their claims to compensation for such interests;

c) Their objection if any to the measurements made and marked on the referred area.

Please take notice that as provided under sub section 22 of the aforesaid Act, every person required to make or deliver a statement under this section shall be deemed to be legally bound to do so within the meaning of section 175 and 178 of the Indian Penal Code (45 of 1860).

	1. Provision of housing units in case of displacement (1) If a house is lost in rural areas, a constructed house shall be provided as per the Indira Awas Yojana specifications. If a house is lost in urban areas, a constructed house shall be provided, which will be not less than 50 sq. mts. in plinth area. (2) The benefits listed above shall be extended to any affected family which is without homestead land and which has been residing in the area and which has been involuntarily displaced from such area: P rovided that any such family in urban areas which opts not to take the house offered, shall get a one-time assistance for house construction, which shall not be less than one lakh fifty thousand rupees: P rovided further that if any affected family in rural areas so prefers, the entitlement cost of the house may be offered in lieu of the constructed house: Provided also that no family affected by acquisition shall be given more than one house under the provisions of this Act.

	2. Land for land In case of Irrigation project, as far as possible and in lieu of compensation to be paid for land acquired, each affected family owning agriculture land in the affected area and whose land has been acquired or lost, or who has, as a consequence of the acquisition or loss of land, been reduced to the status of a marginal farmer or landless, shall be allotted, in the name of each person included in the records or rights with regard to the affected family, a minimum of one acre of land in the command area of the project for which the land is acquired: Provided that in every project those person losing land and belonging to the Scheduled Castes or Scheduled Tribes will be provided land equivalent to land acquired or two and a half-acres, whichever is lower.
	Recommendation- Not Applicable as it is not an irrigation project.
	3. Offer for developed land In case the land is acquired for urbanization purposes, twenty five percent of the developed land will be reserved and offered to land owing project affected families, in proportion to the area of their land acquired and at a price equal to the cost of acquisition and the cost of development. Provided that in case the land owing project affected family wishes to avail this offer, an equivalent amount will be deducted from the land acquisition compensation package payable to it.
	Recommendation- Not Applicable as land is not being acquired for urbanization purpose.
	4. Choice of annuity or Employment The appropriate government shall ensure that the affected families are provided with following option: - (a) Job may be given to at least one member per affected family in the project or arrange for a job in such other project as may be required and providing suitable training and skill development in the required field or make provision for employment at a rate not lower than the minimum wages provided for in any other law for the time being enforced. or (b) One time grant of ₹.5 lakh rupees per affected family. Or (c) The affected family will be provided with an annuity payment of Rupees 2000 per month per family for twenty years (this will be adjusted for inflation annually).

Subsistence grant for displaced families for a period of one year Each affected family which is displaced from the land acquired shall be given a monthly subsistence allowance equivalent to three thousand rupees per month for a period of one year from the date of award. Whereas, it appears to the appropriate Government that a total of 73678 Sq. Mtrs. (standard measurement) the land is required in the Diu City, Diu District for a public purpose, namely, the Acquisition Land for the project of Extension of Airport at Diu of Diu District. The details of the land/lands for the above said project in the Diu City of Diu District is enclosed herewith as Annexure- I. The Social Impact Assessment (SIA) was carried out by the Gujarat Environment Management Institute (GEMI) (An Autonomous Institute of Government of Gujarat), GEMI BHAVAN, Plot Number B-246 & 247, Electronic Estate, GIDC, Sector-25, Gandhinagar, an Agency appointed by the Additional District Magistrate, Diu vide Order No.65-01-LAQ-2022-23/4925 dated 19/12/2022 and a report submitted/ preliminary investigation was conducted by a team constituted by Collector as laid down under rule 4. The summary of the Social Impact Assessment Report/ preliminary investigation is as follows (copy attached):

The land proposed for the project of acquisition of land for the project of Extension of Airport at Diu of Diu District is required for regional connectivity, boosts economic growth, and improves operational efficiency by accommodating large aircraft. It fosters job creation, tourism, and investment, driving overall regional development. The project aligns with national infrastructure goals and international standards, ensuring long-term benefits for public welfare and economic progress.

It will also facilitate development of the region as the major tourist spotin West Coast of India specially to attract tourists from India as well as Foreigners as Diu has beautiful Beaches, Forts and Churches made with Portuguese art and culture and which will boost Tourism Sector and due tothis more livelihood options may be created and this will become morebeneficial to manage traffic and boost economy and income sources of the U.T.

The Dy. Collector, Diu is appointed as Administrator for the purpose of Rehabilitation and Resettlement of the affected families vide Notification dated 04/05/2015 u/s 43 of the Act. Therefore, it is notified that for the above-said project in Diu District, a piece of land measuring 73678 Sq. Mtrs. of standard measurement, whose detail description is as following is under acquisition:

This Notification is made under provisions of Section-11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 Of 2013), to all whom it may concern.

A plan of the land may be inspected in the Office of the Collector, Fort Road, Diu, and the Deputy Secretary, Civil Aviation, DNH & DD, Daman (Requiring Body) during the working day and working hours.

The Government is pleased to authorize Mamlatdar, Diu and his Talathi to enter upon and survey land, take levels of any land, dig or bore into the sub-soil, and do all other acts required for the proper execution of their work as provided and specified in Section-12 of the said Act.

Under Section - 11 (4) of the Act, no person shall make any transaction or cause any transaction of land i.e. Sale/purchase, etc. or create any encumbrances on such land from the date of publication of such notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed by the person interested within 60 (Sixty Days) from the date of publication of this notification as provided under Section 15 of the Act before Collector.

WHEREAS, vide Preliminary Notification No. LAQ/SMC/Panchayat Market/Road/ SSCL /2022/991 dated 16.08.2024, it was Notified under section 11 of the Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land described in the schedule hereto (thereafter referred to as the said land/lands) were needed or likely to be needed for the public purpose, namely for the purpose for Development of Road Under Silvassa Smart City Limited for Providing Access to New Panchayat Market.

AND WHEREAS, a report was submitted to the Appropriate Government i.e. Hon'ble Administrator, Dadra & Nagar Haveli and Daman & Diu to proceed with acquisition process and the same has been approved by the Appropriate Government i.e. Administrator of Daman& Diu and Dadra & Nagar Haveli;

AND WHEREAS, vide Declaration No. LAQ/SMC/Panchayat Market/Road/SSCL/ 2022/166 dated 02/04/2025 it was declared under the provision of Section 19 of the Land Acquisition and Rehabilitation Act that the said lands are required for the public purpose, and namely purpose for Development of Road Under Silvassa Smart City Limited for Providing Access to New Panchayat Market;

AND WHEREAS, in connection with acquisition of Government and Private land admeasuring 2462.25 Sq. Mtrs. (standard measurement) for Development of Road Under SilvassaSERIES – II No. 17 THE GAZETTE OF DNH & DD Page 35 Smart City Limited for Providing Access to New Panchayat Market, the Administration of Dadra and Nagar Haveli intends to take possession of land, the particulars of which are given in the declaration u/s 19(1) of the Right to Fair compensation & Transparency in land Acquisition Rehabilitation and Resettlement (RFCTLARR) Act, 2013;

AND WHEREAS, under section 21 of the RFCTLARR Act, 2013, the Government intends to take possession of the land within 30 days from the date of issue of this Notice, and claims to compensations and rehabilitation and resettlement for all interests in the land, has to be submitted to the Collector for disposal within 30 days from the date of issue of this Notice;

AND WHEREAS, the details of compensation on the land acquisition as per the Annexure- I, II and III is enclosed herewith.

AND WHEREAS, under sub section (1) & (2) of Section 22 of the said Act, the Collector may also require any such person to make or deliver to him/her a statement containing the name of every other person possessing any interest in the land or any part thereof as co-proprietor, mortgage, tenant or otherwise, and of the nature of such interest, and of the rents and profits, if any received or receivable on account thereof for three years next preceding the date of statement, every person required to make or deliver a statement under this section shall be deemed to be legally bound to do so within the meaning of section 175 and176 of the Indian Penal Code (45 of 1860);

NOW THEREFORE, to facilitate causation of the above requirements, public notice is hereby served under section 21 of the RFCTLARR Act, 2013 that all persons having interest in the said land to appear personally or by agent or advocate before the Collector, Dadra and Nagar Haveli on 30/05/2025 and to state in writing and signed by the party of his agent, the following:

a) The nature of their respective interest in their land;

b) The amount and particulars of their claims to compensation for such interest;

c) Their objection if any to the measurements made and marked on the referred area.

Whereas, it appears to the appropriate Government that a total of 21174.46 Sq. Mtrs. (standard measurement) land is required in Athal Village of Dadra and Nagar Haveli for public purpose, namely, for Construction of Fly Over Bridge (FOB) at Athal Junction to Naroli Silvassa Road, D&NH. The Social Impact Assessment study was carried out by Social Impact Assessment (SIA) Unit and a report submitted/preliminary investigation was conducted by a team constituted by Collector as laid down under rule 4. The Summary of the Social Impact Assessment Report/preliminary investigation is as follows:-

• The proposed land acquisition is for the bare minimum needed for the project and there are

no other options for the desired purpose. These parcels of land are owned by a number of

parties both private and public and the RFCTLARR Act 2013 requires compensation in the

form of the value of unoccupied land and other assets.

• After careful analysis of the data collected through a questionnaire, interview with the PAF,

and meetings with officials, site visit and based on the issues raised during public hearing

following recommendations are made.

I. The compensation shall be released prior to the acquisition/physical takeover of the land.

II. Rate of compensation shall be calculated using market pricing.

III. Owners with small shops/establishments whose appreciable area is being taken over by

land acquisition and the remaining area is insufficient to re-establish shall be compensated

in the form of a higher rate or given suitable land to establish their shops/establishments.

IV. There shall not be any change in the acquisition as notified earlier. The curves/turns should

not cause inconvenience to the owners.

V. Demarcation is pending. Before acquisition it should be completed.

VI. Existing road is 7.50 meters which is to be widened upto 25 meters.

The land owners were informed that it would be ensured that acquisition doesn't have any adverse effect on the socio-economic life of the owners and the public. The payment etc. will be strictly as per the Government guidelines.

The number of families that may/are likely to be displaced due to the land acquisition will be known only after the survey for R&R initiated U/s 16 of the RFCTLARR Act 2013.

The Resident Deputy Collector, Silvassa is appointed as Administrator for the purpose of Rehabilitation and Resettlement of the affected families vide Notification no. LAQ/RFCTLARRA, 2013-2015/174 dated 11/08/2015 u/s 44 (1) and Section 43(1) of the Act-2013. Therefore, it is notified that for the above-said project in Dadra & Nagar Haveli District, a piece of land Admeasuring 21174.46 Sq. Mtrs. of standard measurement, whose detail description is as following, is under acquisition:

This Notification is made under the provisions of Section-11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), to all whom it may concern.

A plan of the land may be inspected in the Office of the Collector, Silvassa, Dadra & Nagar Haveli and the Executive Engineer, Public Work Department, Division-I (Road), DNH (Requiring Body) during the working day and working hours.

The Government is pleased to authorize Mamlatdar, Silvassa and his Talathi to enter upon and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in Section-12 of the said Act.

Under Section-11(4) of the Act, no person shall make any transaction or cause any transaction of land i.e. sale/purchase, etc. or create any encumbrances on such land from the date of publication of such notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed before Collector, DNH by the person interested within 60 (Sixty Days) from the date of publication of this notification as provided under Section-15 of the Act.

NOTIFICATION

I, in pursuance to the Executive Committee meeting of Dadra and Nagar Haveli State Legal Services Authority dated 20/03/2025 and approval of the Hon'ble Patron-in-Chief and Hon'ble Executive Chairman, State Legal Services Authority, Dadra and Nagar Haveli on submission dated 25/03/2025 and in exercise of powers conferred by Section 29-A of the Legal Services Authorities Act, 1987. Dadra and Nagar Haveli State Legal Services Authority is hereby pleased to make the following regulations to amend the Dadra and Nagar Haveli State Legal Services Authority Regulations, 1998 for the purpose of giving effect to the provisions of the said Act, namely :-

1. In the regulations 9 of the Dadra and Nagar Haveli State Legal Services Authority Regulations, 1998 (hereinafter referred to as the "the principal regulations") following points at (A) of the Schedule - I shall be substituted.

9. The fee payable to the legal practitioners, representing the parties, in the

matters to be filed, conducted, assigned by the State Legal Services

Authority shall be as per the Schedule I, appended to the Regulations.

Drafting (Civil Matters)
