Final Report of the Administrator for Rehabilitation and Resettlement
Scheme u/s 16 of the Right to Fair Compensation and Transparency in Land
Acquisition of Private Land for the project of Extension of Airport at Diu.
Preface:-
Vide Preliminary Notification No. 65-03-LAQ-2024-25/249 dated 30/04/2025 (Copy attached as Annexure-A), land admeasuring total of 73678.00 Sq. mts. in Diu District was notified u/s 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, project for namely "Land Acquisition of Private Land for the project of Extension of Airport at Diu of District Diu", for public purpose as defined in Section 2(1) (vi) of the RFCTLARR Act, 2013.
Vide Notification No. 5/2/COL/Land/RFCTLARR/2015-16/2296 dated 04/08/2015, the undersigned has been appointed as the Administrator under sub section (1) of Section 43 of the said act for Rehabilitation and Resettlement of affected families due to acquisition of the said land parcels.
As per section 16 of RFCTLARR Act 2013, Preparation of Rehabilitation and Resettlement Scheme by the Administrator should be done.
Methodology:-
As per Chapter VI, procedure and manner of Rehabilitation and Resettlement Section 43 of RFCTLARR Act, 2013, the undersigned has been appointed as the Administrator to prepare the Rehabilitation and Resettlement scheme.
Therefore, vide order No. 65-03-LAQ-2024-25/416 dated 29/05/2025, a committee was constituted to obtain a report on Section 16 of the RFCTLARR Act 2013 and Rule 7 of RFCTLARR (Compensation, Rehabilitation and Resettlement and Development Plan) Rules 2015, to conduct a fieldSERIES – II No. 44 THE GAZETTE OF DNH & DD Page 2 survey of proposed land. On 02/09/2025, with concerned Talathi of the area, Planning Assistant, Diu, BDO, Diu and Mamlatdar, Diu had visited the sites. The report dated 23/09/2025 have been received from Mamlatdar, Diu.
Details of Public Hearing & the Discussion
At the outset, the undersigned welcomed all present affected families.
The undersigned discussed the draft Rehabilitation and Resettlement Scheme with the affected families in the public hearing, and public objections were taken one by one, and points were discussed as below:
1. The Draft Rehabilitation and Resettlement Scheme was prepared based on a field survey as per Section 16 and Rule 9 of the RFCTLARR Act, 2013, and Rule 2015 conducted by the committee on 23/09/2025.
2. The Draft Report of Rehabilitation and Resettlement was published in the prescribed manner as per the RFCTLARR Act, 2013.
3. The Rehabilitation and Resettlement benefit is provided as mentioned in the Second Schedule of the RFCTLARR Act, 2013 (enclosed herewith)
4. The Rehabilitation and Resettlement entitlements will be given to the affected family after the Collector published the award under section 31 of the RFCTLARR Act, 2013.
5. A detailed reasoning on all objections is as bellows:

Other Measure:-
Based on the survey conducted by the Rehabilitation and Resettlement Committee and report vide No.4-1-LND-III-11/2025-26/922 dated 23/09/2025 received from Mamlatdar, Diu, the Rehabilitation and Resettlement Scheme is worked out, which is detailed below: -

Rehabilitation and Resettlement Plan
As per Chapter VI, procedure and manner of Rehabilitation and Resettlement Section 43 of RFCTLARR Act, 2013, the Rehabilitation and Resettlement scheme (RR Scheme) is drafted in consonance with section 16 and Second Schedule of the RFCTLARR Act, 2013, and Rule 7 of RFCTLARR (Compensation, Rehabilitation and Resettlement and Development Plan) Rules, 2015.
Findings:-
As per section 3(k) of the RFCTLARR Act 2013, "Displaced Family" means any family who on account of the acquisition of land has to be relocated and resettled from the affected area to the resettlement area. In the present case, the land being acquired is agricultural and Residential, for which compensation shall be paid as and when the Collector, Diu, announces the Award. A list of family losing their complete residential due to proposed land acquisition is given at para 5(b) above.

ORDER
In exercise of powers under Section 26 of Goa, Daman & Diu Land Revenue Code, 1968 read with Rule 34 of the Goa, Daman & Diu Land Revenue (Disposal of Govt. Lands) Rules, 1971, the Hon'ble Administrator, U.T. of Dadra & Nagar Haveli and Daman & Diu is pleased to permit the Collector, Diu to grant the lease period of Government Land bearing New City Survey PTS No.44/1(Part), admeasuring area 5000 sq. mts. in favour of Omnibus Industrial Development Corporation (OIDC) at near the Bus stand, Diu for the construction of the proposed OIDC Wholesale liquor Warehouse at the rate of Rs. 1/-per annum as Lease Rent from 01/12/2025 to 30/11/2058 for period of 33 years from the date of issue of this order subject to the following conditions :-
1. All Acts and rules particularly Revenue related are applicable to the licensee with all future changes, modifications and amendments related to land.
2. The department shall make sure that there are no revenue leakages and timely deposit to consolidated fund of India and also make sure that imposition of fine/levies of penalty in case of default/delay as applicable.
3. The Lease extension is for OIDC as the Lessee only and further Extension of sub lease shall be on merit and only for industrially utilized plots by the Lessee/OIDC.
4. Strict compliance, of all applicable GFRs, other Rules and terms and conditions as finalized, by the department from time to time.

Whereas, it appears to the appropriate Government that a total of 165 Sq. Mtrs. (standard measurement) the land is required in the Diu City, Diu District for a public purpose, namely, the Acquisition Land for Tent City at Swarn Jayanti Lake, Gandhipara, Diu of Diu District. The details of the land/lands for the above said project in the Diu City of Diu District is enclosed herewith as Annexure – I. Social Impact Assessment Study was carried out by Social Impact Assessment (SIA) Unit and a report submitted/ preliminary investigation was conducted by a team constituted by Collector as laid down under rule 4. The summary of the Social Impact Assessment Report/ preliminary investigation is as follows (copy attached):
A total of 01 family is likely to be displaced due to the land acquisition. The reason necessitating such displacement is given.
The Dy. Collector, Diu, is appointed as Administrator for the purpose of Rehabilitation and Resettlement of the affected families vide Notification dated 04/05/2015 u/s 43 of the Act. Therefore, it is notified that for the above-said project in Diu of Diu District, a piece of land measuring 165 Sq.

This Notification is made under the provisions of Section 11 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 Of 2013), to all whom it may concern.
A plan of the land may be inspected in the Office of the Collector, Fort Road, Diu, and the Additional Director, Tourism Department, Diu (Requiring Body) during the working day and working hours.
The Government is pleased to authorize Mamlatdar, Diu, and his Talathi to enter upon and survey land, take levels of any land, dig or bore into the sub-soil, and do all other acts required for the proper execution of their work as provided and specified in Section 12 of the said Act.
Under Section 11 (4) of the Act, no person shall make any transaction or cause any transaction of land, i.e. Sale/purchase, etc., or create any encumbrances on such land from the date of publication of such notification without prior approval of the Collector.
Objections to the acquisition, if any, may be filed by the person interested within 60 (Sixty Days) from the date of publication of this notification as provided under Section 15 of the Act before the Collector.

NOTICE
(Under Section 21 of RFCTLARR Act, 2013)
WHEREAS, vide Preliminary Notification No.LAQ/Naroli-AnklasBorder/101/2021/524 dated 19.12.2024, it was Notified under section 11 of the Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land described in the schedule hereto (thereafter referred to as the said land/lands) were needed or likely to be needed for the public purpose, namely for Road widening from Naroli Junction to Kanadi Junction to Anklas Border for public purpose.
AND WHEREAS, a report was submitted to the Appropriate Government i.e. Hon'ble Administrator, Dadra & Nagar Haveli and Daman & Diu to proceed with acquisition process and the same has been approved by the Appropriate Government i.e. Administrator of Dadra & Nagar Haveli and Daman & Diu;
AND WHEREAS, vide Declaration No.LAQ/ Naroli-AnklasBorder/ 101/2021/074 dated 24.11.2025 it was declared under the provision of Section 19 of the Land Acquisition and Rehabilitation Act that the said lands are required for the public purpose, and namely for Road widening from Naroli Junction to Kanadi Junction to Anklas Border for public purpose;
AND WHEREAS, in connection with acquisition of land admeasuring 8070.50 Sq. Mtrs. for Road widening from Naroli Junction to Kanadi Junction to Anklas Border for public purpose,SERIES – II No. 44 THE GAZETTE OF DNH & DD Page 21 the particulars of which are given in the declaration u/s 19(1) of the Right to Fair compensation & Transparency in land Acquisition Rehabilitation and Resettlement (RFCTLARR) Act, 2013;
AND WHEREAS, under section 21 of the RFCTLARR Act, 2013, the Government intends to take possession of the land and claims for compensations and rehabilitation and resettlement for all interests in the land, has to be submitted to the Collector for disposal within 30 days from the date of issue of this Notice;
The details of compensation on the land acquisition as per the Annexure- I, II and III are enclosed herewith.
AND WHEREAS, under sub section (1) & (2) of Section 22 of the said Act, the Collector may also require any such person to make or deliver to him/her a statement containing the name of every other person possessing any interest in the land or any part thereof as co-proprietor, mortgage, tenant or otherwise, and of the nature of such interest, and of the rents and profits, if any received or receivable on account thereof for three years next preceding the date of statement, every person required to make or deliver a statement under this section shall be deemed to be legally bound to do so within the meaning of section 175 and176 of the Indian Penal Code (45 of 1860);
NOW THEREFORE, to facilitate causation of the above requirements, public notice is hereby served under section 21 of the RFCTLARR Act, 2013 that all persons having interest in the said land to appear personally or by agent or advocate before the Collector, Dadra and Nagar Haveli on 16/01/2026 and to state in writing and signed by the party of his agent, the following:
a) The nature of their respective interest in their land;
b) The amount and particulars of their claims to compensation for such interest;
c) Their objection, if any, to the measurements made and marked on the referred area.
Please take notice that as provided under sub section 22 of the aforesaid Act, every person required to make or deliver a statement under this section shall be deemed to be legally bound to do so within the meaning of section 175 and 178 of the Indian Penal Code (45 of 1860).

NOTIFICATION
In exercise of the Powers conferred under Section 25 of the Negotiable Instruments Act 1881 (26 of 1881), the Administrator of Union Territory of Dadra & Nagar Haveli and Daman & Diu is pleased to declare the holidays as specified in the Part-I, II and III appended to this Notification for the Union Territory of Dadra & Nagar Haveli and Daman & Diu.
Part – I Indicates Holidays in the Union Territory of Dadra & Nagar Haveli and Daman & Diu during the calendar year 2026, Saka 1947-48 which shall apply to all Government Offices/Semi Govt. Offices/Local Bodies/Commercial Banks in Dadra & Nagar Haveli and Daman & Diu.
Part - II Indicates the list of Restricted Holidays out of which an employee is entitled to avail any two holidays.
Part – III Indicates Holidays under the Negotiable Instruments Act, 1881 which apply to all the Industrial Establishments, Public Sector Undertakings and Commercial Banks operating in Union Territory of Dadra & Nagar Haveli and Daman & Diu. The Commercial Banks operating in Union Territory of Dadra & Nagar Haveli and Daman & Diu shall observe holidays declared by respective regional offices according to their norms. However, State Bank of India, Dadra & Nagar Haveli, Daman & Diu in which Government transaction is being done, shall have to observe the holidays specified in the Part – I and the Government transaction / RBI chest will remain operative on other working days.
All the holidays including in Part – III shall be paid holidays in the Establishment, as below in the Union Territory of Dadra & Nagar Haveli and Daman & Diu.
(1) Industrial workers in the U.T. of Dadra & Nagar Haveli and Daman & Diu.
(2) Daily wages workers of Govt. Department/U.T. Government Industrial Department. (3) Employees of the Commercial Banks, Industrial Workers of Private establishment in the U.T. of Dadra & Nagar Haveli and Daman & Diu.
