(एसएसएसएस....)/टी/टी/टी/टी.... सीसीसीसी.... फेलिंग/फेलिंग/फेलिंग/फेलिंग/17171717-18181818////641-53....----दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, नेताजी नगर, नई दिल्ली में जी.पी.आर.ए कॉलोनी के पुन(cid:19)वकास के लिए निर्माण हेतु नीचे दिए गए विवरण के अनुसार 44.24हैक्टेयर लगभग) क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधो से छूट प्रदान करती है।

(क) आवेदक यािन राष्ट्रीय भवन निर्माण निगम, दिल्ली को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 14,19,30,000/-रूपये ( की राशि अग्रिम रूप में जमा करवानी होगी।

(ii) 3450 हेक्टेयर में
NBCC/Sr.ED.Redev./Netaji Nagar/Forest/2017/65 30.10.2017 ।
(iii) नेताजी नगर में निर्माण स्थल के अन्दर परियोजना क्षेत्र की परिधि के साथ मौजूदा पेड़ों की संख्या 175 का प्रत्यारोपण उनकी अपनी लागत पर किया जायेगा ।
(ग) 2490 वृक्षों को हटाए/ प्रत्यारोपण किए जाने के उपरान्त प्राप्त लकड़ी की नीलामी भूिम स्वामित्व संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार को राजस्व के रूप में जमा कर दी जाएगी।
(घ) 2490 पेड़ों की कटाई चरणब5 तरीके से निर्माण की प्रगति के अनुसार की जाएगी ताकि जिन पेड़ों को तत्काल हटाने की आवश्यकता नह9 हैउनकी बारी आने तक वे मौजूद रहेंगे ताकि वे कम से कम दो वष> की इस विस्तारित अवधि के लिए पर्यावरण में योगदान दे सकें ।
(ड) शेष 1416 वृक्षों को किसी तरह से गिराया/ हानि नह9 की जाएगी । () वृक्ष काटे जाने के स्थल से लकड़ी ले जाने से पूर्व उक्त लकडियों की ढुलाई के लिए वृक्ष अधिकारी (दक्षिणी) से ढुलाई अनुमति प्राप्त करनी होगी।
() राष्ट्रीय भवन निर्माण निगम (एन.बी.सी.सी.) द्वारा वृक्षों की ऊपरी शाखांए (लोप्स एंड टॉप्स) की लकड़ी को काटे जाने के पश्चात प्राप्त लकड़ी मुIत में दिल्ली नगर निगम के संबधित कर्मचारियों को सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाए और प्राप्त रसीद को उप-वन संरक्षक (दक्षिणी) को जमा की जाये ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 () वृक्षों की कटाई, प्रतिपूरक वृक्षारोपण और प्रत्यारोपण की प्रगति निरीक्षण अधिकारी के माध्यम से समय-समय पर उप-वन संरक्षक (दक्षिण) को पेड़ों के पूर्ण विवरण के साथ जमा की जाएगी ।

Delhi, the 23rd April, 2018
F. No. R.150/TO(S)/TC-Felling/17-18 641-53.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 44.24 ha. (approx.) as detailed below for construction for redevelopment of GPRA colony at Netaji Nagar, New Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
a) The applicant viz NBCC Delhi, shall make an advance deposit of an amount of Rs. 14,19,30,000/- (Rupees Fourteen Crore Nineteen Lakh Thirty Thousand only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

b) 100% compensatory plantation of 24900 will be raised and maintained for Seven years and monitored till its successful establishment in following manner:-
(i) Compensatory Plantation of 21450 seedlings will be done by Deputy Conservator of Forests (North) in the 21.45 ha area allotted by DDA at three locations as indicated above vide their letter No. F.1(39)DD-I/LS/ YRFD/ 2015/Vol-I/85 dated 28.07.2017;
(ii) Compensatory Plantation of 3450 seedlings will be done by User Agency over 3.855 ha. of land in 11 small pockets (G1 to G11) earmarked within the construction site at Netaji Nagar as per their letter No. NBCC/Sr.ED.Redev./Netaji Nagar/Forest/2017/65 dated 30.10.2017;
(iii) Transplanting of 175 number of existing trees along the periphery of the project area within the construction site at Netaji Nagar at their own cost.
c) The timber obtained from felling/ transplanting of 2490 trees shall be auctioned by the land owning agency and the proceeds shall be deposited as revenue to the Government.
d) The felling of 2490 trees will be done in a phased manner linked with progress of construction so that the trees which do not require immediate removal shall remain intact till their turn comes so that they can contribute to the environment for this extended period of at least two years of construction period.
e) The balance 1416 trees in the site being saved shall not be felled/ harmed.
f) Before shifting of timber if any, from site of removal of trees, transportation permission for transportation of the said wood shall be obtained from Tree Officer (South).
g) The lops and tops obtained on removal of trees shall be handed over by the National Buildings Construction Corporation (NBCC) to the officials concerned of Municipal Corporation of Delhi for its use on public crematoria in Delhi free of cost and receipt so obtained may be deposited with DCF (South).
h) The progress of felling of trees, compensatory plantation and transplantation shall be submitted through Inspection Officer to DCF (South) from time to time alongwith complete details of trees.
