संसंसंसं.... फाफाफाफा.... 6/16/2015-न्याय/6/16/2015-न्याय/6/16/2015-न्याय/6/16/2015-न्याय/पीपीपीपी....एफएफएफएफ....////अधीअधीअधीअधी....विधिविधिविधिविधि..../529/529/529/529-534-534-534-534ः-अद्यतन यथासंशोधित दिल्ली न्यायिक सेवा नियमावली, 1970 के नियम 18 के उपबंधों के अनुसरण में राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, दिल्ली उच्च न्यायालय के परामर्श से, निम्नलिखित 03 अभ्यर्थियों को दिल्ली उच्च न्यायालय, नई दिल्ली द्वारा नियुक्त किए जाने पर अपने-अपने कार्यालयों में कार्यभार सम्भालने की तिथि से दो वर्षों की अवधि के लिए परिवीक्षा आधार पर दिल्ली न्यायिक सेवा के सदस्यों के रूप में नियुक्त करते हैंः-

2. ये नियुक्तियां पूर्णतया अस्थायी आधार पर हैं तथा उनक द्वारा इस प्रभाव क लिए एक वचन प्रस्तुत करना कि वे कम से कम बांड की श्ष अवधि के लिए दिल्ली न्यायिक सेवा के अधिकारी के रूप में कार्य करेंगे तथा कार्मिक अर प्रशासनिक सुधार विभाग, गृह मंत्रालय, भारत सरकार क अएम सं. 28021/1/84-स्था(सी) दिनांक 14.11.1984 एवं सार्वजनिक उद्यम विभाग क अएम सं. 15(2)/2003-डीपीई(जीएम)/जीएल-57 दिनांक 29.07.2004 क संदर्भ में दिल्ली उच्च न्यायालय क महापंजीयक क नाम पर एक नया बांड प्रस्तुत करने, के अनुसार होगी। यह आगे जाति प्रमाण पत्र, जहां लागू हो, की सत्यता की जाँच के अनुसार होगी । यदि सत्यापन से यह पता चलता है कि 2438 DG/2018
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] अनुसूचित जाति तथा अनुसूचित जनजाति श्रेणी, जैसी भी स्थिति हो, से संबंधित दावा गलत है तो बिना किसी आगामी कारणों तथा असत्य प्रमाण पत्र प्रस्तुत करने पर भारतीय दंड संहिता के उपबंधों के अधीन की जाने वाली आगामी कार्यवाही पर प्रतिकूल प्रभाव डाले बिना सेवा तुरन्त समाप्त कर दी जाएगी।
3. उपर्युक्त नियुक्तियाँँ अद्यतन तिथि तक तथा समय-समय पर दिल्ली न्यायिक सेवा के अधिकारियों पर यथा लागू अन्य आदेशों/निर्देशों के अनुसार दिल्ली न्यायिक सेवा नियमावली, 1970 के उपबंधों के अनुसार होगी ।
4. दिल्ली न्यायिक सेवा में उपयुक्त अभ्यर्थियों की परस्पर वरिष्ठता अन्य चुने गए अभ्यर्थियों के समान वही रहेगी जो अद्यतन तिथि तक यथासंशोधित दिल्ली न्यायिक सेवा नियमावली, 1970 के अनुसार चयन समिति द्वारा तैयार वरीयता सूची में उन्हें दी गई है ।
5 उपर्युक्त नियुक्ति माननीय उच्चतम न्यायालय में विचाराधीन सी.ए. संख्या 1086/2013-सर्व रूरल बनाम यूूनियन ऑफ इंडिया, रिट पैटिशन (सिविल) संख्या 764/2017-तानिया मलिक बनाम महापंजीयक, दिल्ली उच्च न्यायालय, रिट पैटिशन (सिविल) संख्या 831/2017-अंशुमन धुन्ना बनाम महापंजीयक, दिल्ली उच्च न्यायालय एवं रिट पैटिशन (सिविल) संख्या 832/2017-चारू धनकर बनाम महापंजीयक, दिल्ली उच्च न्यायालय तथा माननीय दिल्ली उच्च न्यायालय में विचाराधीन रिट पैटिशन (सिविल) संख्या 2828/2010- सुरेंद्र पाल सिंह चहान बनाम राज्य एवं अन्य के फैसलों के आधीन होगी।
6 पद का वेतनमान 27700-770-33090-920-40450-1080-44770 रुपये (पूर्व संशधित) सामान्य भत्ते जैसा समय-समय पर इस संबंध में लागू हो के अनुसार है ।

No. F. 6/16/2015-Judl./P.F./Suptlaw/529-534.—In pursuance of the provisions of rule 18 of the Delhi Judicial Service Rules, 1970 as amended up to date, the Lt. Governor of the National Capital Territory of Delhi, in consultation with the High Court of Delhi, is pleased to appoint the following 03 candidates as members of the Delhi Judicial Service on probation for a period of two years with effect from the date they assume charge of their respective offices on being posted by the Delhi High Court, New Delhi:—

2. These appointments are on purely provisional basis, and subject to their furnishing an undertaking to the effect that they will serve as an officer of Delhi Judicial Service at least for the remaining period of the Bond and furnishing of a fresh bond in the name of Registrar General, Delhi High Court in terms of OM No.28021/1/84-Estt (C) dated 14.11.1984 of Department of Personnel & Administrative Reforms, Ministry of Home Affairs, Govt. of India and DPE OM No.15(2)/2003-DPE(GM)/GL-57 dated 29.07.2004 of the Department of Public Enterprise. It is further subject to verification of veracity of caste category certificate, where ever applicable. If the verification reveals that the claim to belong to Scheduled Caste and Scheduled Tribe category, as the case may be, is false, the services will be terminated forthwith without assigning any further reasons and without prejudice to such further action as may be taken under the provisions of the Indian Penal Code for production of false certificate.
3. The above appointment shall be subject to the provisions of the Delhi Judicial Service Rules, 1970 as amended up to date and other orders/instructions as may be applicable to the officers of the Delhi Judicial Service from time to time.
[PART IV DELHI GAZETTE : EXTRAORDINARY 34. The inter-se seniority of the above named candidates in the Delhi Judicial Service vis-à-vis other selected candidates will remain the same as assigned to them in the merit list prepared by the Selection Committee in accordance with the provisions of the Delhi Judicial Service Rules, 1970 as amended up to date.
5. The above appointment shall be subject to outcome of CA No.1086/2013 titled "Sarv Rural Vs. Union of India", WP (C) No.764/2017 titled "Taniya Malik Vs. Registrar General of the High Court of Delhi", WP(C) No.831/2017 titled "Anshuman Dhunna Vs. Registrar General of the High Court of Delhi" and WP(C) No.832/2017 titled "Charu Dhankar Vs Registrar General of the High Court of Delhi" pending before Hon'ble Supreme Court of India and WP(C) No.2828/2010 titled 'Surender Pal Singh Chauhan Vs. State & Anr.' pending before Delhi High Court.
6. The post carries the scale of pay of Rs.27700-770-33090-920-40450-1080-44770 (pre-revised) plus usual allowances as may be applicable in this behalf from time to time.
