4(30)/आरआर/एलबी/2018/सीडी-000250424/5101-09.----दिल्ली नगर निगम अधिनियम, 1957 (1957 का 66) संसंसंसं....फाफाफाफा.... 4(30)/आरआर/एलबी/2018/सीडी-000250424/5101-09 4(30)/आरआर/एलबी/2018/सीडी-000250424/5101-09 4(30)/आरआर/एलबी/2018/सीडी-000250424/5101-09 की धारा 480 की उपधारा (2) तथा धारा 484क की उपधारा (3) के साथ पठित धारा 98 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा 27 मार्च, 1995 की अधिसूचना सं0 13(103)/99/यूडी के अनुसार अधिसूचित सहायक निदेशक, षिक्षा (षारीरिक) के पद से संबंधित भर्ती विनियमों के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व की गई बाते या हटाई जाने वाली बातों को छोड़कर, संघ लोक सेवा आयोग से परामर्ष के पश्चात् तथा गृह मंत्रालय, भारत सरकार की दिनांक 19 अक्टूबर, 1966 की अधिसूचना सं0 एसओ 3159 के साथ पठित राश्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल के अनुमोदन के पष्चात् उत्तर, दक्षिण तथा पूर्व दिल्ली नगर निगमों में सहायक निदेसहायक निदेसहायक निदेसहायक निदेश्श्श्शक, ािक, ािक, ािक, श्श्श्शिक्षा ाक्षा ाक्षा ाक्षा ((((श्श्श्शारीरिकाारीरिकाारीरिकाारीरिक)))) के पद की भर्ती पद्धति को विनियमित करने के लिये निम्नलिखित नियम बनाते है, अर्थात्ः-
1. संक्षिप्त शीर्षक तथा प्रारंभसंक्षिप्त शीर्षक तथा प्रारंभसंक्षिप्त शीर्षक तथा प्रारंभसंक्षिप्त शीर्षक तथा प्रारंभ :- (1) इन विनियमों को सहायक निदेसहायक निदेसहायक निदेसहायक निदेश्श्श्शक, ािक, ािक, ािक, श्श्श्शिक्षा ाक्षा ाक्षा ाक्षा ((((श्श्श्शारीरिक)ाारीरिक)ाारीरिक)ाारीरिक) भर्ती विनियम, 2018 कहा जाये।
(2) ये दिल्ली राजपत्र में उनके प्रकाशन की तिथि से प्रभावी होंगे।
पदों की संख्या, वर्गीकरण तथा वेतन मैट्रिक्स में स्तर :- उक्त पदों की संख्या, इसका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर, उसके साथ 2. पदों की संख्या, वर्गीकरण तथा वेतन मैट्रिक्स में स्तर पदों की संख्या, वर्गीकरण तथा वेतन मैट्रिक्स में स्तर पदों की संख्या, वर्गीकरण तथा वेतन मैट्रिक्स में स्तर संलग्न इन विनियमों के साथ संलग्न अनुसूची के कॉलम 2 से 4 में यथाविनिर्दिष्ट होंगे।
3. भर्ती पद्धति, आयु सीमा, योग्यताएं इत्यादिभर्ती पद्धति, आयु सीमा, योग्यताएं इत्यादिभर्ती पद्धति, आयु सीमा, योग्यताएं इत्यादिभर्ती पद्धति, आयु सीमा, योग्यताएं इत्यादि :- उक्त पद की भर्ती पद्धति, आयु सीमा, योग्यताएं तथा उससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम 5 से 13 में यथाविनिर्दिष्ट होंगे।

(क) जिसने किसी ऐसे व्यक्ति से विवाह किया है जिसका जीवित पति/पत्नी है; या
(ख) जिसने जीवित पत्नी/पति के रहते हुए किसी अन्य व्यक्ति के साथ विवाह किया है,
वह उक्त पद पर नियुक्ति के लिये अयोग्य होगा :
उपबंध है कि सरकार यदि इस बात से संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति या अन्य पार्टी पर लागू व्यक्तिगत कानून के अन्तर्गत अनुमति योग्य है तथा ऐसा करने के अन्य आधार हैं तब किसी व्यक्ति को इस नियम के प्रचालन से छूट प्रदान की जा सकती है।
5. छूट प्रदान करने की शक्ति :-छूट प्रदान करने की शक्ति :-छूट प्रदान करने की शक्ति :-छूट प्रदान करने की शक्ति :- जहां राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार का मत है कि ऐसा करना आवश्यक या समीचीन है तो वह आदेश द्वारा तथा कारणों को लिखित में अभिलेखबद्ध करते हुए तथा संघ लोक सेवा आयोग के साथ परामर्श से तथा सरकार के पूर्व अनुमोदन से व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन विनियमों के उपबंधों से छूट प्रदान कर सकती है।
6. बचाव :-बचाव :-बचाव :-बचाव :- इस विनियम में कोई भी बात इस संबंध में भारत सरकार द्वारा समय-समय पर जारी आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, भूतपूर्व सैनिक तथा अन्य विशेष व्यक्तियों के वर्गों के लिये अपेक्षित आरक्षण, आयु सीमा में छूट एवं अन्य रियायतों पर प्रभाव नहीं डालेगी।

| टीप-1 टीप-1.... अन्यथा सुयोग्य उम्मीदवारों के मामले में योग्यताएं संघ लोक टीप-1 टीप-1 सेवा आयोग के विवेक पर शिथिलनीय है। टीप-2 टीप-2.... यदि चयन की किसी अवस्था में संघ लोक सेवा आयोग के टीप-2 टीप-2 अभिमत से अनुसूचित जाति/जनजातियों के लिए आरक्षित रिक्त पदों को भरने के लिए अपेक्षित अनुभव रखने वाले इन जातियों के उम्मीदवारों के पर्याप्त संख्या में मिलने की संभावना नहीं है, तो अनुभव संबंधी योग्यताएं कारणों को लिखित में अभिलेखबद्ध करते हुए संघ लोक सेवा आयोग के विवेक पर शिथिलनीय है। | |||

Delhi, the 7th May, 2018
No.F.4(30)/RR/LB/2018/CD-000250424/5101-09.—The following regulations, made by the Municipal Corporation of Delhi in exercise of the powers conferred by section 98 read with sub-section (2) of Section 480 and sub-4 DELHI GAZETTE : EXTRAORDINARY PART IV] section (3) of section 484A of the Delhi Municipal Corporation Act, 1957 (66 of 1957) and in supersession of recruitment regulations relating to the post of Assistant Director of Education (Physical) notified vide No. F.13 (103)/99/UD dated, the 27th March,1995 except as respects things done or omitted to be done such before supersession, after consultattion with Union Public Service Commission and approval of the Lt. Governor of the National Capital Territory of Delhi, read with Government of India, Ministry of Home Affairs, notification Number S.O. 3159 dated the 19th October, 1966 the following recruitment regulations for regulating the method of recruitment to the post of Assistant Director of Education (Physical) in North, South and East Delhi Municipal Corporations, are hereby published for information; namely:-
1. Short title and commencement.–(1) These regulations may be called Assistant Director of Education (Physical) Recruitment Regulations, 2018.
(2) They shall come into force on the date of their publication in the Delhi Gazette.
2. Number of posts, classification and Level in Pay Matrix. - The number of the said posts, their classification and Level in Pay Matrix attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these regulations.
3. Method of recruitment, age-limit, qualification etc. - Method of recruitment, age-limit, qualifications and other matters relating to the said posts, shall be as specified in columns 5 to 13 of the said Schedule.
4. Disqualification. – No person, -
(a) Who has entered into or contracted a marriage with a person having a spouse living; or
(b) Who, having a spouse living, has entered into or contracted marriage with any person;
shall be eligible for appointment to the said post :
Provided that Government, may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation.
5. Power to relax. – Where the Government of the National Capital Territory of Delhi is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with Union Public Service Commission, relax any of the provisions of these regulations with respect to any class or category of persons or posts.
6. Saving. – Nothing in these regulations shall affect reservations, relaxation of age limit and other concessions required to be provided for candidates of Scheduled Castes, Scheduled Tribes, Ex-Servicemen and other special categories of persons, in accordance with the orders issued by the Government of India from time to time, in this regard.
