फाफाफाफा....ससससंंंं. 97/डब्लू. ऍफ़. डी./सी. ओ97/डब्लू. ऍफ़. डी./सी. ओ97/डब्लू. ऍफ़. डी./सी. ओ97/डब्लू. ऍफ़. डी./सी. ओ.टी/17.टी/17.टी/17.टी/17----18/18/18/18/1698-1707.—दिल्ली वृक्ष संरक्षण अधिनियम, 1994 (1994 का दिल्ली अधिनियम 11) की धारा 29 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, धौला कु आँ मेट्रोस्टेशन के नजदीक टी-जंक्शन जिसमें राष्ट्रीय राजमार्ग को चौड़ा करना, राष्ट्रीय राजमार्ग-8 पर जंक्शन के अंत तक और डिफे न्स एरिया के पास टी-जंक्शन के सुधार सिहत एनएच – 8 पर डिफे न्स एरिया तक राष्ट्रीय राजमार्ग को चौडीकरण के सुधारहेतु नीचे दिए गएनिम्नलिखितविवरण के अनुसार कु ल परियोजना क्षेत्र 26.713 हैक्टेयर (लगभग) क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधाें से इसके द्वारा छूट प्रदान करती है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] यह छूट निम्नलिखित शर्तों के अधीन है। (क) आवेदक का सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 6,62,91,000/-रूपये (छ:
करोड़ बासठ लाख इक्यानवे हज़ार रूपये मात्र) की राशि अग्रिम रूप में जमा करवानी होगी।

उनकासफलतापूर्वकस्थापनातक िनगरानी कीजाएगी
(i) 100 % (11630) पौधों का उपभोगी संस्था यानि भारतीय राष्ट्रीय राजमार्ग प्राधिकरण की ओर से पAिमी वन प्रभाग द्वारा शाCी पार्क मेट्रो स्टेशन, यमुना नदी ओर ओल्ड आयरन ब्रिज पर 21.52 हेक्टेयर क्षेत्र में से 11.63 हेक्टेयर भूमि दिल्ली विकास प्राधिकरण पत्र संख्या. F.32(19)/17/IL/4654 dated 06/11/2017 द्वारा आवंटित की गई भूमि पर किया जायेगा । (ग) 12.28 हेक्टेयर के परियोजना क्षेत्र में 930 वृक्षों को काटा/ हटाया जाने के लिए सी.ई.सी. / माननीय सुप्रीम कोर्ट द्वारा मोफKलॉजिकल रिज के अंदर अनुमोदन किया गया है । सी.ई.सी. / माननीय सुप्रीम कोर्ट द्वारा मोफKलॉजिकल रिज के अंदर में यह एक ही परियोजना है जिसमें मोफKलॉजिकल रिज और गैर-मोफKलॉजिकल रिज दोनों शामिल हैं और 9300 पौधों का प्रतिपूरकवृक्षारोपण 9.3 हेक्टेयर में (उपरोक्त (ख) के अनुसार) दिल्ली विकास प्राधिकरण द्वारा कु ल 21.52 हेक्टेयर आवंटित क्षेत्र में किया जायेगा ।
(घ) शेष 233 वृक्षों के लिए गैर-मॉफKलॉजिकल रिज में अनुमति सरकार के अनुमोदन के अनुसार की जा रही हैजिसके लिए प्रावधान उपरोक्त (ख) के अनुसार, 2300 पोधों का प्रतिपूरक वृक्षारोपण दिल्ली विकास प्राधिकरण द्वारा प्रदान की गई कु ल 21.52 हेक्टेयर क्षेत्र में से 2.33 हेक्टेयर भूमि पर किया जायेगा
(ड) भारतीय राष्ट्रीय राजमार्ग प्राधिकरण मोफ़Kलॉजिकल रिज के अनुपात में परियोजना लगत का5% RMB Fund मेंजमा करेगा। इसके अतिरिक्तभारतीय राष्ट्रीय राजमार्ग प्राधिकरण 21.52 हेक्टेयर क्षेत्र में 21500 पौधों का प्रतिपूरक वृक्षारोपण हेतु चैन लिक फें सिग सहित लागत वन एवं वन्य जीव विभाग, दिल्ली सरकार को अYिम जमा करेगा । इस सम्बन्ध में उप-वन संरक्षक (पAिमी) द्वारा पत्र संख्याF.97/WFD/COT/17-18/PART-II/552-54 दिनांक 07.05.2018के पत्र को स(cid:31)ान में लें ।
(च) परियोजना क्षेत्र में कु ल 2142 वृक्षों में से गैर-मोफKलॉजिकल रिज में स्थित979 वृक्षों को हटाने/ गिराने का अनुमोदनपहले से ही भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को अधिसूचना सं F.97/WFD/COT/17-18/PART-II/552-54 दिनांक-07.05.2018 के माध्यमसे जारी की जा चुकी है और परियोजना के अंतर्गत 21.52 हेक्टेयर के कु ल क्षेत्रफल में 9790 पौधों का प्रतिपूरक वृक्षारोपण दिल्ली विकास प्राधिकरण द्वारा आवंटित भूमि पर (उपरोक्त (ख) के अनुसार) निद'शित किया जा चुका है ।
(छ) 1163 वृक्षोंके काटे/प्रत्यारोपण किएजानेके पAातप्राप्तलकड़ीकीनीलामीउपभोगीसंस्थाद्वाराकीजाएगीऔरउससे प्राप्तधनरािश सरकार को राजस्व के रूप में उपभोगी संस्था द्वारा जमाकीजाएगी।
(ज) भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा पेड़ों की ऊपरी शाखाएं (लोप्स एंड टॉप्स) की जलाऊ लकड़ी की प्रजातियों को काटे जाने के पश्चात प्राप्त जलाऊ लकड़ी मु"त में दिल्ली नगर निगम के संबधित कर्मचारियों को सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाए।
(झ) वृक्ष काटे जाने के स्थल से लकड़ी ले जाने से पूर्व उक्त लकडियों की ढुलाई के लिए वृक्ष अधिकारी (प(िcid:22)मी) से ढुलाई अनुमति प्राप्त करनी होगी।

NOTIFICATION
Delhi, the 24th May, 2018
No.F.97/WFD/COT /17-18/1698-1707.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of the National Capital Territory of Delhi, hereby, in public interest, from out of the total project area of 26.713 ha (approx), exempts the following area as detailed below for improvement of T-Junction near Dhaula Kuan Metro Station for Widening of National Highway from Dhaula Kuan up to end of Junction on NH-8 and improvement of T-Junction near Defence Area including widening of National Highway up to Defence area on NH-8, New Delhi, from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
(a) The applicant shall make an advance deposit of an amount of Rs. 6,62,91,000 /- (Rupees Six Crore Sixty Two Lakh Ninety One Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows:

(b) The compensatory plantation as shown below will be raised and maintained for Seven years and monitored till its successful establishment:-
(ii) 11630 Nos. by the West Forest Division on behalf of User Agency i.e NHAI over 11.63 ha. (approx) area from out of the total 21.52 ha. Land at Shastri Park Metro Station, River Yamuna and Old Iron Bridge allotted by DDA vide letter No. F.32(19)/17/IL/4654 dated 06/11/2017.
(c) The felling of 930 trees in project area of 12.28 ha. falling inside morphological ridge is granted approved by CEC/ Hon'ble Supreme Court as it is a single project consisting morphological ridge as well as non- morphological ridge and against which compensatory plantation of 9300 trees will be done in 9.3 ha. approx.
out of total project area of 21.52 ha. allotted by DDA vide (b) above.
4 DELHI GAZETTE : EXTRAORDINARY PART IV](d) The permission for remaining 233 trees in non-Morphological Ridge is being issued as per approval of Govt. against which compensatory plantation of 2330 trees in 2.33 ha. area approx out of the total area of 21.52 ha.
allotted by DDA vide (b) above.
(e) The NHAI shall deposit 5% of the project cost proportionate to the morphological ridge area with RMB fund together with cost of raising 21,500 plants including chain link fencing over the total compensatory plantation land of 21.52 ha. in advance with Forest Department of Govt. of NCT of Delhi. In this connection Deputy Conservator of Forests (West) letter No. F.97/WFD/COT/17-18/PART-II/552-54 dated 07.05.2018 may also be referred.
(f) The felling approval of another 979 trees falling in non-morphological ridge has already been issued to NHAI earlier out of the total 2142 trees in the project area vide notification No. F.97/WFD/COT/17-18/8075-83 dated 25.01.2018 and against which a compensatory plantation of 9790 has been directed in the total area of 21.52 ha.
allotted by DDA vide (b) above against the said project.
(g) The timber obtained from felling/ transplanting of 1163 trees shall be auctioned by the land owning agency and deposit the proceeds as revenue to the government.
(h) The lops and tops obtained on removal of firewood species of trees shall be handed over by the National Highway Authority of India (NHAI) to the officials concerned of MCD for use in public crematoria of Delhi as firewood, free of cost.
(i) Before shifting of wood if any, from site of removal of trees, transportation permission for transportation of the said wood shall be obtained from Tree Officer (West).
