स्ांस्ांस्ांस्ां.... फाफाफाफा.... 23(1362)23(1362)23(1362)23(1362)////सीएपीसीएपीसीएपीसीएपी////परिपरिपरिपरि....////2016-पार्ट-12016-पार्ट-12016-पार्ट-12016-पार्ट-1////307307307307....————जबकि मोटर वाहन अधिनियम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) की अपेक्षानुसार दिल्ली मोटर वाहन नियमावली, 1993 का पुनः संशोधन करने के लिये नियमों का प्रारूप राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार की दिनांक 6 सितम्बर, 2017 की अधिसूचना सं. फा. 23(1362)/सीएपी/परि./2016-पार्ट-1/204 के अनुसार दिल्ली राजपत्र भाग-चार असाधारण में, जिस तिथि को उक्त अधिसूचना वाले दिल्ली के राजपत्र की प्रतियां जनता को उपलब्ध कराई गई थी, उस तिथि से पैंतालिस दिन की अवधि बीतने से पहले इससे प्रभावित होने वाले सभी व्यक्तियों से आपत्तियां तथा सुझाव आमंत्रित करने के लिये प्रकाशित किया गया था;
और जबकि उक्त राजपत्र अधिसूचना की प्रतियां जनता को 06 सितम्बर, 2017 से उपलब्ध कराई गई थी;
और जबकि उक्त प्रारूप नियमावली के संबंध में जनता से कोई भी आपति एवं सुझाव प्राप्त नहीं हुए हैं। अब इसलिए मोटर वाहन अधिनियम, 1988 (1988 का 59) की धारा 2 के खंड (41) के साथ पठित धारा 111 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, दिल्ली मोटर वाहन नियमावली, 1993 का पुनः संशोधन करने के लिये निम्नलिखित नियम बनाते हैं, अर्थात् :-

1. संक्षिप्त संक्षिप्त संक्षिप्त संक्षिप्त श्श्श्शीाीाीाीर्षर्षर्षर्षक एवं प्रारंभक एवं प्रारंभक एवं प्रारंभक एवं प्रारंभ.—(1) इन नियमों को दिल्ली मोटर वाहन (संशोधन), नियमावली, 2018 कहा जायेगा। (2) ये दिल्ली राजपत्र में अपनी प्रकाशन की तिथि से लागू होगी।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 1. नियम 99 का संनियम 99 का संनियम 99 का संनियम 99 का संष्ष्ष्षोधन :-ाोधन :-ाोधन :-ाोधन :- दिल्ली मोटर वाहन नियमावली, 1993 के नियम 99 में उपनियम (3) में ,- (i) खंड (क) के स्थान पर निम्नलिखित को प्रतिस्थापित किया जायेगा, अर्थात्ः-
''(क) - प्रदूषण जांच केन्द्र का प्राधिकार ः- कोई भी सर्विस स्टेशन वर्कशाप प्रदूषण जांच केन्द्र के रूप में कार्य नहीं करेगा जब तक कि उसके पास परिवहन आयुक्त, परिवहन विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार या परिवहन आयुक्त द्वारा अधिकृत परिवहन विभाग का अधिकारी द्वारा वैद्य प्राधिकार प्रदान न किया गया हो।''
(ii) खंड (घ) उपखंड (iii) के स्थान पर निम्नलिखित को प्रतिस्थापित किया
जायेगा, अर्थात् :-
''(iii) परिवहन आयुक्त या परिवहन आयुक्त द्वारा अधिकृत परिवहन विभाग का अधिकारी अपने विवेकाधिकार से सुनवाई के पष्चात् या ऐसी जांच के पष्चात् जिसे वह सही व उचित समझे, उक्त प्रदूषण जांच केन्द्र को निलंबित/रद्द कर सकता है।''

NOTIFICATION
Delhi, the 10th July, 2018
No.F.23(1362)/CAP/TPT/2016-Part-I/307.—Whereas the draft rules further to amend the Delhi Motor Vehicles Rules, 1993, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), by the Government of the National Capital Territory of Delhi, vide Notification No.F23(1362)/CAP/TPT/2016-Part-I/204 dated the 6th September, 2017 in the Delhi Gazette, Extraordinary, inviting objections and suggestions from all persons likely to be affected thereby, before expiry of the period of forty five days from the date on which copies of the Delhi Gazette containing the said notification were made available to public;
And whereas, copies of the said Gazette notification were made available to the public on the 6th September, 2017;
And whereas, the objections and suggestions received from the public in respect of the said draft rules are nil;
Now, therefore, in exercise of the powers conferred by section 111, read with clause (41) of section 2 of the Motor Vehicles Act, 1988 (59 of 1988), the Lieutenant Governor of National Capital Territory of Delhi hereby makes the following rules further to amend the Delhi Motor Vehicles Rules, 1993, namely:-
RULES
1. (1) These rules may be called the Delhi Motor Vehicles (Amendment) Rules, Short title and Commencement. –
2018.
(2) They shall come into force on the date of their publication in the Delhi Gazette.
Amendment of
2. In the Delhi Motor Vehicles Rules, 1993, in rule 99, in sub-rule (3), -[PART IV DELHI GAZETTE : EXTRAORDINARY 3
rule 99–
(i) for clause (a) the following shall be substituted, namely:-
"(a) – Authorization of Pollution Checking Centre:- No service station workshop shall act as pollution checking centre unless it holds valid authorization granted by the Commissioner (Transport), Transport Department, Government of National Capital Territory of Delhi or an officer of Transport Department authorized by the Commissioner (Transport)."
(ii) for sub-clause (iii) of clause (d), the following shall be
substituted, namely:-
"(iii) – The Commissioner (Transport) or an officer of the Transport Department authorized by the Commissioner (Transport) may at its discretion, suspend/ cancel the authorization of the said pollution checking centre after hearing the accused or after making such enquiry as it deems just and proper."
