2017 165 315 —केन्द्रीय मोटर वाहन नियम, 1989 के नियम 118 के उप-नियम (2) तथा मोटर वाहन अधिनियम, 1988 (1988 का अधिनियम सं. 59) की धारा 2 के खंड (41) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल दिनांक 24-2-2003 की पूर्ववर्ती अधिसूचना सं. पीसीओ/एसटीए/II/2001/पीएफ-2/194 के अधिक्रमण में एतद्द्वारा आदेश देते हैं कि 01 अक्तूबर, 2015 से पूर्व पंजीकृत प्रत्येक परिवहन वाहन, जिनमें स्पीड गवर्नर पहले से लगा नहीं है (गति नियंत्रक उपकरण या गति सीमित करने की कार्यप्रणाली) और केन्द्रीय मोटर वाहन नियम, 1989 के नियम 118 के उप-नियम (1) के प्रथम परन्तु के अन्तर्गत नहीं आते है उन वाहनों में ऑपरेटरों द्वारा एआईएस मानक 018/2001 के अनुरूप, जैसाकि समय-समय पर संशोधन हुए हैं स्पीड गवर्नर (गति नियंत्रक उपकरण या गति सीमित करने की कार्यप्रणाली) लगाई जाए या सुसज्जित की जाए, जिनकी प्री-सेट अधिकतम गति निम्न प्रकार विनिर्दिष्ट है :-

बशर्ते उपरोक्त सारण्ीबद्ध (iii) में वर्णित वाहनों की श्रेणियों में से प्रत्येक भारी एवंम मझौला परिवहन वाहन, तथा चार पहियों वाला हल्का माल वाहक वाहन जो केवल राष्ट्रीय राजधानी क्षेत्र दिल्ली या राष्ट्रीय राजधानी क्षेत्र के भीतर चलाने के परमिट के तहत आते है एवंम् सभी परिवहन वाहन जिन्हें परमिट की आवश्यकता से छूट प्राप्त है जोकि 01 अक्तूबर, 2015 को या उसके बाद पंजीकृत है को भारत के मान्नीय सर्वोच्च न्यायालय के एम.सी. मेहता बनाम भारत संघ के मामले में 1985 के डब्ल्यू पी (सी) सं. 13029 के दिनांक 20 नवम्बर, 1997 के आदेशानुसार को भी स्पीड गवर्नर (गति नियंत्रक उपकरण या गति सीमित करने वाली कार्यप्रणाली) लगे या सुसज्जित होने चाहिए जिनकी अधिकतम प्री-सेट गति 40 कि.मी. प्रति घंटा होगी।
(2) प्रत्येक स्पीड गवर्नर (गति नियंत्रक उपकरण या गति सीमित करने वाली कार्यप्रणाली) विशेष मॉडल के लिए केन्द्रीय मोटर वाहन नियम, 1989 के नियम 126 के अंतर्गत विनिर्दिष्ट किसी भी जांच एजेंसी द्वारा अनुमोदित (टाइप अप्रूव्ड्) होनी चाहिए।
(3) स्पीड लिमिटिंग डिवाइस का रेट्रो फिटमेंट समय-समय पर सड़क परिवहन और राजमार्ग मंत्रालय, भारत सरकार और मान्नीय सर्वोच्च न्यायालय समिति द्वारा जारी दिशा निर्देशों के अनुसार होगा।
(4) प्रत्येक गति नियंत्रक उपकरण को संबंधित वाहन विनिर्माता या संबंधित गति नियंत्रक उपकरण के निर्माता या उनके प्राधिकृत प्रतिनिधि, जिसने भी गति नियंत्रक उपकरण लगाया है वो राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के परिवहन विभाग द्वारा विनिर्दिष्ट सील लगाएगा।
(5) प्रत्येक वाहन का मालिक/ड्राइवर जिसमें स्पीड गवर्नर लगा है (गति नियंत्रक उपकरण या गति सीमित करने वाली कार्यप्रणाली) संबंधित वाहन विनिर्माता या संबंधित स्पीड गवर्नर के निर्माता (गति नियंत्रक उपकरण या गति सीमित करने वाली कार्यप्रणाली) या उनके प्राधिकृत प्रतिनिधि, जिसने स्पीड गवर्नर लगाया हो, द्वारा जारी एक प्रमाण-पत्र वाहन के फिटनेस के प्रमाण-पत्र के प्रदान करने या उसके नवीनीकरण के लिए प्रस्तुत करते समय उपलब्ध कराएगा, जोकि उपरोक्त विनिर्दिष्ट अधिकतम प्री-सेट स्पीड की पुष्टि करेगा।
बशर्ते कि यह प्रमाण पत्र, फिटनेस के प्रमाण पत्र प्रदान या नवीकरण के लिए वाहन के प्रस्तुत करने की तिथि से पन्द्रह दिनों के अंदर जारी किया गया हो।

NOTIFICATION
Delhi, the 17th July, 2018
F. No. MLO(VIU)/TPT/2017/165/315.—In exercise of the powers conferred by sub-rule (2) of rule 118 of the Central Motor Vehicles Rules, 1989 and clause (41) of section 2 of the Motor Vehicles Act, 1988 (Act No. 59 of 1988) the Lieutenant Governor of the National Capital Territory of Delhi, in supersession of earlier notification bearing No. PCO/STA/II/2001/PF-2/194, dated 24.02.2003, hereby orders that, every transport vehicle registered prior to the 1st October, 2015, which are not already fitted with a speed governor (speed limiting device or speed limiting function), and are not covered under the first proviso to sub-rule (1) of rule 118 of the Central Motor Vehicles Rules, 1989 shall be equipped or fitted by the operator of those vehicles[PART IV DELHI GAZETTE : EXTRAORDINARY 3 with a speed governor (speed limiting device or speed limiting function) conforming to the AIS Standard 018/2001, as amended from time to time, having maximum pre-set speed as specified below:

Provided that out of the categories of vehicles mentioned in (iii) tabulated above and registered on or after 1st October, 2015 & covered by the Hon'ble Supreme Court Order dated 20TH November 1997, in the matter of M.C. Mehta Vs Union of India & Ors. in WP(C) No.13029 of 1985 i.e. heavy and medium transport vehicles, and light goods vehicles being four wheeler shall also be equipped or fitted with a speed governor (speed limiting device or speed limiting function) having maximum pre-set speed of 40 Kilometer per hour.
(2) Every speed governor (speed limiting device or speed limiting function) shall be type approved for the particular model of the vehicle by any one of the testing agencies specified under rule 126 of the Central Motor Vehicles Rules, 1989.
(3) The retro-fitment of Speed Limiting Device shall be in accordance with guidelines issued by the Ministry of Road Transport and Highways, Govt of India and Hon'ble Supreme Court Committee on Road Safety from time to time.
(4) Every speed limiting device shall be sealed by the concerned vehicle manufacturer or the manufacture of concerned speed limiting device or their authorized representative, whosoever fitted the speed limiting device with a type of seal specified by the Transport Department, Government of NCT of Delhi.
(5) The owner / driver of every vehicle equipped with the speed governor (speed limiting device or speed limiting function) shall produce a certificate issued by the concerned vehicle manufacturer or the manufacturer of concerned speed governor (speed limiting device or speed limiting function) or their authorized representative, whosoever fitted the speed governor, confirming the maximum pre-set speed specified herein above, at the time of production of vehicle for grant or renewal of certificate of fitness.
Provided that the issuance of said certificate should have been made within fifteen days prior to the date of production of vehicle for grant or renewal of certificate of fitness.
