Qk-l. vkj- 510@Vh-vks- (,l-)@Vh- lh- Qsfyax@18-19@903-11.—दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, एस.एल.एफ. ओखला, नई दिल्ली से जुड़े तेहखंड में 200 टीपीडी वेस्ट टू एनर्जी प्लांट की स्थापना हेतु नीचे दिए गए विवरण के अनुसार 15 एकड़ (607020.8 वर्ग मीटर) लगभग क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबधों से छूट प्रदान करती है।

यह छूट निम्नलिखित शर्तों के अधीन है।
(क) आवेदक तेहखंड वे(cid:17)ट टू इलेि(cid:22)(cid:23)(cid:24)सट(cid:26) (cid:27)ोजे(cid:22)ट (cid:24)ल(cid:24)मटेड को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 1,16,85,000 /-रूपये (एक करोड़ सोलह लाख पचासी हजार $पये मा&) की राशि अग्रिम रूप में जमा करवानी होगी।

| 2. | कीकर के अतिरिक्त शीशम एवं अन्य प्रजातियों के अवस्थित 45 वृक्षों का प्रत्यारोपण उपयुक्त स्थान पर उपभोगी संस्था द्वारा स्वयं की लागत पर किया जाएगा । प्रत्यारोपण उपरान्त इन प्रत्यारोपित वृक्षों के रखरखाव की ज़िम्मेदारी भी उपभोगी संस्था की होगी । |
(ख) 2050 स्वदेशी प्रजातियों के पौधों का जो कि 6 से 8 फीट लंबे हो उनका 100% प्रतिपूरक वृक्षारोपण किया जायेगा और उनका सात वषG तक रखरखाव तथा सफलतापूर्वक स्थापना के बाद निम्न प्रकार निगरानी की जाएगी :-
(i) प्रतिपूरक वृक्षारोपण उपभोगी संस्था द्वारा एस.एल.एफ. ओखला नई दिल्ली से जुड़े तेहखंड में परियोजना स्थल में एवं उसके आस-पास किया जाएगा;
(ii) एस.एल.एफ. ओखला, नई दिल्ली से जुड़े तहखंड में परियोजना स्थल के भीतर परियोजना क्षेत्र की परिधि में 45 मौजूदा वृक्षों का प्रत्यारोपण उपयुक्त स्थान पर उनकी अपनी लागत पर किया जायेगा ।
(iii) माननीय उJतम न्यायालय ने T.N. Godavarman Thirumulpad बनाम Union of India & Ors. में I.A No. 127530/2018 और 127531/2018 (न्यायालय के आदेश के स्पष्टीकरण और आवेदन 16.07.2018 को I.A. 138808/2017 में पारित) को निपटाते Rए 26.09.2018 को आदेश पारित किया । इस आदेश के अनुपालन में परियोजना प्रस्तावक द्वारा 2100 पौधों का प्रतिपूरक वृक्षारोपण 205 वृक्षों के हटाने/ प्रत्यारोपण के बदले मे पहले ही किया जा चुका है यह जानकारी पत्र संख्या TWEPL/18-19/008 दिनांक 30.11.2018 द्वारा दी गयी है । 205 वृक्षों को हटाने/ प्रत्यारोपण की स्वीकृ ति देने से पहले उप-वन संरक्षक (दक्षिणी) द्वारा 2100 पौधों का प्रतिपूरक वृक्षारोपण का सत्यापन किया जाएगा ।
(ग) 205 वृक्षों को हटाए/ प्रत्यारोपण किए जाने के उपरान्त प्राप्त लकड़ी की नीलामी भूिम स्वामित्व संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार को राजस्व के रूप में जमा कर दी जाएगी।
(घ) शेष 272 वृक्षों को किसी भी तरह से िगराया अथवा उनको हानि नहX की जाएगी ।
(ड) वृक्ष काटे जाने के स्थल से लकड़ी ले जाने से पूर्व उक्त लकडियों की ढुलाई के लिए वृक्ष अधिकारी (दक्षिणी) से ढुलाई अनुमति प्राप्त करनी होगी।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 (च) तेहखंड वेस्ट टू इलेक्ट्रिसिटी प्रोजेक्ट लिमिटेड द्वारा वृक्षों की ऊपरी शाखांए (लोप्स एंड टॉप्स) की लकड़ी को काटे जाने के पश्चात प्राप्त लकड़ी मु]त में दिल्ली नगर निगम के संबधित कर्मचारियों को सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाए और प्राप्त रसीद को उप-वन संरक्षक (दक्षिणी) को जमा की जाये ।
(छ) वृक्षों की कटाई, प्रतिपूरक वृक्षारोपण और प्रत्यारोपण की प्रगति निरीक्षण अधिकारी के माध्यम से उप-वन संरक्षक (दक्षिण) को वृक्षों के पूर्ण विवरण के साथ संबन्धित गतिविधि उपरान्त जमा की जाएगी ।

NOTIFICATION
Delhi, the 30th January, 2019
F.No. R.510/TO(S)/TC-Felling/18-19/903-11.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 15 Acres. (60702.8 SQM) approx as detailed below for "setting up of 200 TPD Waste to Energy Plant" at Tehkhand, adjoining existing SLF Okhla, New Delhi from the provision of sub- section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:—
a) The applicant viz Tehkhand Waste to Electricity Project Limited shall make an advance deposit of an amount of Rs. 1,16,85,000 /- (Rupees One Crore Sixteen Lakh Eighty Five Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

successful establishment in following manner:—
(i) Compensatory Plantation of 2050 saplings of indigenous species of 6'-8' height is required to be done by User Agency in and around the project site at Tehkhand, adjoining existing SLF Okhla, New Delhi;
(ii) Transplanting of 45 number of existing trees along the periphery of the project area within the project site at Tehkhand, adjoining existing SLF Okhla, New Delhi at their own cost.
(iii) The Hon'ble Supreme Court disposed off the Interlocutory Application Nos. 127530/2018 and 127531/2018 (Applications for impleadment and clarification of Court's order dated 16.07.2018 passed in I.A No. 138808/2017) in T.N. Godavarman Thirumulpad versus Union of India & Ors., vide order dated 26.09.2018. In compliance of the order dated 26.09.2018, the project proponent has already planted 2100 saplings against the 205 No. of felling of trees as per their letter No. TWEPL/18-19/008 dated 30.11.2018, which would be verified by DCF (South) before granting permission for felling/ transplantation of 205 trees.
c) The timber obtained from felling/ transplanting of 205 trees shall be auctioned by the land owning agency and the proceeds shall be deposited as revenue to the Government.
d) The balance 272 trees in the site being saved shall not be felled/ harmed.
e) Before shifting of timber if any, from site of removal of trees, transportation permission for transportation of the said wood shall be obtained from DCF/ Tree Officer (South).
f) The lops and tops obtained on removal of trees shall be handed over by the Tehkhand Waste to Electricity Project Limited to the officials concerned of Municipal Corporation of Delhi for its use on public crematoria in Delhi free of cost and receipt so obtained may be deposited with DCF (South).
g) The progress of felling of trees, compensatory plantation and transplantation shall be submitted through Inspection Officer to DCF (South) after completion alongwith complete details of trees immediately.
