Qk-la. ⁵⁹@ड(cid:3)लू॰एफ॰ड़ी॰@सी॰ओ॰ट(cid:14)॰/18-19@2101-09.—दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, घुमनहेरा दिल्ली में दिल्ली परिवहन निगम बस िडपो- II के निर्माण हेतु नीचे दिए गए विवरण के अनुसार ².⁴⁰ हेक्टेयर (²⁴⁰⁵¹ वर्ग मीटर) लगभग क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधो से छूट प्रदान करती है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] यह छूट निम्नलिखित शर्तो के अधीन है।

(क) आवेदक दिल्ली परिवहन िनगम को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 25,65,000/-रूपये (प(cid:13)ीस लाख पेसठ हजार (cid:20)पये मात्र) की रािश अग्रिम रूप में जमा करवानी होगी।

(ख) दिल्ली परिवहन निगम द्वारा 100% प्रतिपूरक वृक्षारोपण किया जायेगा और उनका सात वष> तक रखरखाव तथा सफलतापूर्वक स्थापना के बाद निम्न प्रकार निगरानी की जाएगी :-

(i) 450 देशी प्रजातियों के पौधों का जो कि 6 से 8 फीट लंबे हो उनका प्रतिपूरक वृक्षारोपण उपभोगी संस्था द्वारा घुमनहेरा दिल्ली में प्रस्तावित बस डिपो- I&II की बाउं/ी वॉल के साथ 1ीन बेल्ट में किया जाएगा । (ग) वृक्षो की कटाई की अनुमति उनके स्वयं के जोखिम/ ज़िम्मेदारी पर दी जाएगी और किसी भी अन्य Jक्ति के दावे के पक्षपात के बिना, जो वृक्षो की भूमि पर सही हो सकती है ।

(घ) साइट से वृक्षो के प्रत्यारोपण शुरू होने से पहले सभी आवश्यक सांविधिक मंजूरी आवश्यक रूप से उपभोगी संस्था द्वारा प्राप्त की जाएगी ।

(ड) 45 वृक्षों को हटाए/ प्रत्यारोपण किए जाने के उपरान्त प्राप्त लकड़ी की नीलामी भूिम स्वामित्व संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार को राजस्व के रूप में जमा कर दी जाएगी।

(च) वृक्ष काटे जाने के स्थल से लकड़ी ले जाने से पूर्व उक्त लकडियों की ढुलाई के लिए वृक्ष अधिकारी (दक्षिणी) से ढुलाई अनुमति प्राप्त करनी होगी।

(छ) दिल्ली परिवहन निगम द्वारा वृक्षों की ऊपरी शाखांए (लोप्स एंड टॉप्स) की लकड़ी को काटे जाने के पश्चात प्राप्त लकड़ी मुUत में दिल्ली नगर निगम के संबधित कर्मचारियों को सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाए और प्राप्त रसीद को उप-वन संरक्षक (प4िमी) को जमा की जाये ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 (ज) वृक्षों की कटाई, प्रतिपूरक वृक्षारोपण और प्रत्यारोपण की प्रगति निरीक्षण अधिकारी के माध्यम से उप-वन संरक्षक (पि चमी) को वृक्षो के पूर्ण विवरण के साथ संबन्धित गतिविधि उपरान्त जमा की जाएगी ।

NOTIFICATION

Delhi, the 11th March, 2019

F.No. 59/WFD/COT/18-19/2101-09.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 2.40 hectare (24051 SQM) approx as detailed below for construction of DTC Bus Depot-II at Ghumanhera, Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-

a) The applicant viz Delhi Transport Corporation shall make an advance deposit of an amount of Rs. 25,65,000 /- (Rupees Twenty Five Lakh Sixty Five Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

b) 100% compensatory plantation of 450 will be raised and maintained by Delhi Transport Corporation for Seven years and monitored till its successful establishment in following manner:-

(i) Compensatory Plantation of 450 saplings of native species of 6'-8' height is required to be done by User Agency at green belt along with boundary wall of the proposed Bus Depot- I&II at Ghumanhera, Delhi.

c) Permission for felling/ transplantation of all trees would be granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any right (s) over the land or the trees.

d) Before the transplantation of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the user agency.

e) The timber obtained from felling/ transplanting of 45 trees shall be auctioned by the land owning agency and the proceeds shall be deposited as revenue to the Government.

f) Before shifting of timber if any, from site of removal of trees, transportation permission for transportation of the said wood shall be obtained from DCF/ Tree Officer (West).

g) The lops and tops obtained on removal of trees shall be handed over by the Delhi Transport Corporation to the officials concerned of Municipal Corporation of Delhi for its use on public crematoria in Delhi free of cost and receipt so obtained may be deposited with DCF (West).

h) The progress of felling of trees, compensatory plantation and transplantation shall be submitted through Inspection Officer to DCF (West) after completion alongwith complete details of trees immediately.
