ंडेला कलाँ, (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, मु दिल्ली में दिल्ली परिवहन निगम बस डिपो- के निर्माण हेतु नीचे दिए गए विवरण के अनुसार 1.934 हेक्टेयर लगभग क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधों से छूट प्रदान करती है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] यह छूट निम्नलिखित शत(cid:22) के अधीन है।
(क) आवेदक दिल्ली परिवहन निगम को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 9,12,000/-रूपये (नौ लाख बारह हजार !पये मात्र) की राषि अग्रिम रूप में जमा करवानी होगी।

(ख) 160 पौधों का 100% प्रतिपूरक वृक्षारोपण लोक निर्माण विभाग द्वारा किया जायेगा और उनका सात वष(cid:28) तक रखरखाव तथा सफलतापूर्वक स्थापना के बाद निम्न प्रकार निगरानी की जाएगी :-
((cid:5)) देशी प्रजातियों के 160 पौधों का प्रतिपूरक वृक्षारोपण चारदीवारी के साथ किया जाएगा जिसकी लंबाई 680 मीटर और चौड़ाई 2.5 मीटर है और इसका कु ल क्षेत्रफल 1700 वर्ग मीटर है ।
(ग) वृक्षों की कटाई की अनुमति उनके स्वयं के जोखिम/ज़िम्मेदारी पर दी जाएगी और किसी भी अन्य Bक्ति के दावे के पक्षपात के िबना, जो वृक्षों की भूमि पर सही हो सकती है।
(घ) 16 वृक्षों को हटाए जाने के उपरान्त प्राप्त लकड़ी की नीलामी भूिम स्वामित्व संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार को राजस्व के रूप में जमा कर दी जाएगी।
(ड) वृक्ष काटे जाने के स्थल से लकड़ी ले जाने से पूर्व उक्त लकडियों की ढुलाई के लिए वृक्ष अधिकारी (पHिमी) से ढुलाई अनुमति प्राप्त करनी होगी।
(च) वृक्षों की ऊपरी शाखांए (लोप्स एंड टॉप्स) की लकड़ी को काटे जाने के पष्चात प्राप्त लकड़ी मु(त में दिल्ली नगर निगम के संबधित कर्मचारियों को सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाए और प्राप्त रसीद को उप-वन संरक्षक (पHिमी) को जमा की जाए।
(छ) वृक्षों की कटाई और प्रतिपूरक वृक्षारोपण की प्रगति निरीक्षण अधिकारी के माध्यम से उप-वन संरक्षक (पHिमी) को वृक्षो के पूर्ण िववरण के साथ संबन्धित गतिविधि उपरान्त जमा की जाएगी ।

NOTIFICATION
Delhi, the 28th March, 2019
F.No.47/WFD/COT/18-19/ 2479-88.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 1.934 hectare approx as detailed below for construction of DTC Bus Depot at Mundela Kalan, Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
(a) The applicant viz Delhi Transport Corporation shall make an advance deposit of an amount of Rs. 9,12,000 /- (Rupees Nine Lakh Twelve Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

Seven years and monitored till its successful establishment in following manner:-
(i) Compensatory Plantation of 160 saplings of native species will be planted along boundary wall which is 680m in length and 2.5m in width which makes a total area of 1700 sq. mtr.
(c) Permission for felling of all trees would be granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any right (s) over the land or the trees.
(d) The timber obtained from felling/ transplanting of 16 trees shall be auctioned by the land owning agency and the proceeds shall be deposited as revenue to the Government.
(e) Before shifting of timber if any, from site of removal of trees, transportation permission for transportation of the said wood shall be obtained from DCF/ Tree Officer (West).
(f) The lops and tops obtained on removal of trees shall be handed over by the Delhi Transport Corporation to the officials concerned of Municipal Corporation of Delhi for its use on public crematoria in Delhi free of cost and receipt so obtained may be deposited with DCF (West).
(g) The progress of felling of trees & compensatory plantation shall be submitted through Inspection Officer to DCF (West) after completion alongwith complete details of trees immediately.
