Qk-l- 54@MCyw-,Q-Mh-@lh-vks-Vh-@18-19@2602-11—दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, सेक्टर-37, रोहिणी, दिल्ली-110085 में चारदीवारी सहित दो क्लस्टर बस डिपों का निर्माण हेतु नीचे दिए गए विवरण के अनुसार 4.9 हेक्टेयर लगभग क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधों से छूट प्रदान करती है।

यह छूट निम्नलिखित शर्तों के अधीन है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] (क) आवेदक दिल्ली परिवहन निगम को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 12,54,000/-रूपये (बारह लाख चव्वन हजार रुपये मात्र) की राषि अग्रिम रूप में जमा करवानी होगी।

(ख) 220 पौधों का 100% प्रतिपूरक वृक्षारोपण लोक निर्माण विभाग द्वारा किया जायेगा और उनका सात वर्षों तक रखरखाव तथा सफलतापूर्वक स्थापना के बाद निम्न प्रकार निगरानी की जाएगीः-
(i) देशी प्रजातियों के 220 पौधों का प्रतिपूरक वृक्षारोपण डिपो की चारदीवारी के साथ, ग्रीन पर किया जाएगा जिसकी लंबाई 1230 मीटर और चौड़ाई 2.5 मीटर है और जिसका कुल क्षेत्रफल 3075 वर्ग मीटर है।
(ग) वृक्षों की कटाई/प्रत्यारोपण की अनुमति उनके स्वयं के जोखिम/ज़िम्मेदारी पर दी जाएगी और किसी भी अन्य व्यक्ति के दावे के पक्षपात के बिना, जो वृक्षों की भूमि पर सही हो सकती है।
(घ) 22 वृक्षों को हटाए/ प्रत्यारोपण किए जाने के उपरान्त प्राप्त लकड़ी की नीलामी भूिम स्वामित्व संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार को राजस्व के रूप में जमा कर दी जाएगी।
(ड) वृक्ष काटे जाने के स्थल से लकड़ी ले जाने से पूर्व उक्त लकड़ियों की ढुलाई के लिए वृक्ष अधिकारी (पश्चिमी) से ढुलाई अनुमति प्राप्त करनी होगी।
(च) वृक्षों की ऊपरी शाखांए (लोप्स एंड टॉप्स) की लकड़ी को काटे जाने के पश्चात प्राप्त लकड़ी मु1त में दिल्ली नगर निगम के संबधित कर्मचारियों को सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाए और प्राप्त रसीद को उप-वन संरक्षक (प5िमी) को जमा की जाये ।
(छ) वृक्षों की कटाई, प्रतिपूरक वृक्षारोपण और प्रत्यारोपण की प्रगति निरीक्षण अधिकारी के माध्यम से उप-वन संरक्षक (पश्चिमी) को वृक्षों के पूर्ण विवरण के साथ संबन्धित गतिविधि उपरान्त जमा की जाएगी ।

NOTIFICATION
Delhi, the 2nd April, 2019
F.No.54/WFD/COT/18-19/ 2602-11.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 4.9 hectare approx as detailed below for construction of two Cluster Bus Depots including Boundary wall at Sector-37, Rohini, Delhi-110085 from the provision of sub- section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
[PART IV DELHI GAZETTE : EXTRAORDINARY 3(a) The applicant Transport Department shall make an advance deposit of an amount of Rs. 12,54,000 /- (Rupees Twelve Lakh Fifty Four Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

(b) 100% compensatory plantation of 220 will be raised and maintained by Public Works Department for Seven years and monitored till its successful establishment in following manner:-
(i) Compensatory Plantation of 220 saplings of native species will be planted along the green belt with boundary wall of the depot. Total length of the boundary wall is 1230 m and width of the belt is 2.5 m i.e, making a total area of 3075 sq. mtr.
(c) Permission for felling/ transplantation of all trees would be granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any right (s) over the land or the trees.
(d) The timber obtained from felling/ transplanting of 22 trees shall be auctioned by the land owning agency and the proceeds shall be deposited as revenue to the Government.
(e) Before shifting of timber if any, from site of removal/ transplantation of trees, transportation permission for transportation of the said wood shall be obtained from DCF/ Tree Officer (West).
(f) The lops and tops obtained on removal of trees shall be handed over by the Transport Department to the officials concerned of Municipal Corporation of Delhi for its use on public crematoria in Delhi free of cost and receipt so obtained may be deposited with DCF (West).
(g) The progress of felling of trees, compensatory plantation and transplantation shall be submitted through Inspection Officer to DCF (West) after completion alongwith complete details of trees immediately.
