la-Qk- ,Q 211¼17½@Mhvk ,Q ,l@,p D;w@2017&965&85.—जबकि, गुटका, पान मसाला सुवासित/सुगन्धित तम्बाकू, खर्रा और इसी प्रकार के अन्य उत्पाद जिनमें तम्बाकू है, चाहे किसी भी नाम से पुकारा जाए, ग्राहकों के स्वास्थ्य को भारी क्षति पहुंचा सकते हैं और ये आने वाली भावी पीढ़ियों की जैविक संरचना में परिवर्तन करके उन पर प्रतिकूल प्रभाव भी डाल सकते हैं;
जबकि, तम्बाकू, चाहे सुस्वाद, सुगन्धित हो या अन्य घटकों जैसे निकोटीन, भारी धातु, एन्टी-केकिंग एजेंट (घटकों के रूप में विशेष रूप से अनुमत्त सीमा तक) चांदी के वर्क बाइंडर्स की सुस्वाद सुगन्ध, सुगन्ध, प्रतिबंधित रसायन के साथ मिश्रित किया गया हो या इन घटकों में कोई एक (उक्त घटक इसके बाद सामूहिक रूप से या अलग रूप से जैसा संदर्भ में अपेक्षित हो, उक्त व्यसन के रूप में संदर्भित है) खाद्य संरक्षा एवं मानक अधिनियम, 2006 की धारा 3 के खंड (ञ) के अन्तर्गत ''खाद्य पदार्थ'' है;
जबकि, केन्द्र सरकार ने तम्बाकू और निकोटिन वाले उत्पादों को खाद्य संरक्षा एवं मानक (निषेद्य तथा बिक्री पर प्रतिबंध) विनियम, 2011 के विनियम, 2.3.4 तथा खाद्य संरक्षा मानक (खाद्य उत्पाद मानक तथा खाद्य व्यसन), विनियम, 2011 के विनियमों 3.1.7 के अन्तर्गत एंटी केकिंग एजेंट (विस्तारित अनुमति से परे) में प्रतिबंधित किया है;

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] जबकि, उक्त खाद्य पदार्थों का उपभोग मानव स्वास्थ्य और तंदुरूस्ती के लिए हानिकारक होगा और जबकि इन खाद्य पदार्थों को बिना प्रतिबंध के अनुमत किया जाता है तो ऐसा करना वर्तमान एवं भावी पीढ़ियों की तंदुरूस्ती से समझौता होगा;
जबकि, कानून के अधीन तथा जन स्वास्थ्य के हित में ऐसे किसी खाद्य पदार्थ के विनिर्माण, भंडारण, वितरण या बिक्री पर प्रतिबंध लगाने हेतु आयुक्त, खाद्य संरक्षा उत्तरदायी है और जबकि खाद्य संरक्षा एवं मानक अधिनियम, 2006 की धारा 30(2)(क) के अन्तर्गत यह आदेश करने के लिए विधिवत् प्राधिकृत है;
अब इसलिए, खाद्य संरक्षा तथा मानक अधिनियम, 2006 की धारा 30 की उपधारा (2) के खंड (क) के द्वारा प्रदत्त इन शक्तियों का प्रयोग करते हुए, अधोहस्ताक्षरी, आयुक्त ( खाद्य संरक्षा), राष्ट्रीय राजधानी क्षेत्र दिल्ली, राष्ट्रीय राजधानी क्षेत्र दिल्ली में सरकारी राजपत्र में इस अधिसूचना के प्रकाशन की तिथि से एक वर्ष की अवधि के लिए तम्बाकू के विनिर्माण, भंडारण, वितरण या बिक्री का जन स्वास्थ्य के हित में प्रतिबंधित करता है, जो उक्त व्यवसन में किसी के साथ या तो सुगन्धित, सुवासित या मिश्रित की गई हो और चाहे गुटका, पान मसाला, सुगंधित, सुवासित तम्बाकू या खर्रा के नाम से या रूप हो या अन्यथा किसी भी नाम से पुकारा जाए चाहे यह पैकेज में हो या बिना पैकेज के हो तथा/अथवा एक उत्पाद के रूप में बेची गई हो, अथवा पैकेज में अलग उत्पादों के रूप में बेची या वितरित इस प्रकार से की जाय ताकि सेवन करने के लिए उपभोक्ता द्वारा सुविधापुर्वक मिलाया जा सके।

NOTIFICATION
Delhi, the 13th April, 2019
No.F.211(17)/DOFS/HQ/2017/965-85.—WHEREAS, Gutka, Pan Masala, Flavoured / Scented Tobacco, Kharra and similar products containing tobacco by whatsoever name called, cause damage to the health of consumers and their adverse impact could also lead to alterations of the genetic make-up of future generations;
WHEREAS, tobacco, whether flavoured, scented or mixed with other ingredients such as heavy metals, anti- caking agents (except to the extent specifically permitted as ingredients), silver leaf, binders, flavours, scents, fragrances, prohibited chemicals, or any one of these ingredients (the said ingredients are hereafter collectively or individually, as the context requires, referred to as "the said additives") are "food" under clause (j) of section 3 of the Food Safety and Standards Act, 2006;
WHEREAS, the Central Government has prohibited products containing tobacco and nicotine under regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011 and anti- caking agents (beyond the extent permitted) under regulation 3.1.7 of The Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 ;
WHEREAS, the said food articles if consumed will endanger human health and well-being and whereas if consumption of these food articles is allowed without prohibition the well being of current and future generations will be compromised;
WHEREAS, under the law and in the interest of public health, Commissioner Food Safety is responsible for prohibiting in the interest of public health the manufacture, storage, distribution or sale of any article of food, and whereas the undersigned is duly authorized under section 30(2)(a) of the Food Safety and Standards Act, 2006, to make this order ;
[PART IV DELHI GAZETTE : EXTRAORDINARY 3Therefore, in exercise of these powers conferred by clause (a) of sub section (2) of section 30 of the Food Safety and Standards Act, 2006, the undersigned, Commissioner (Food Safety), National Capital Territory of Delhi, prohibit in the interest of public health for a period of one year from the date of publication of this Notification in the official gazette, in the National Capital Territory of Delhi the manufacture, storage, distribution, or sale of tobacco which is either flavoured, scented or mixed with any of the said additives, and whether going by the name or form of gutka, pan masala, flavoured/scented tobacco, kharra, or otherwise by whatsoever name called, whether packaged or unpackaged and/or sold as one product, or though packaged as separate products, sold or distributed in such a manner so as to easily facilitate mixing by the consumer.
