सं.फा. 6/13/2018-न्याय/अधी.विधि./834-838.—संविधान क अनुच्छेद 309 क परन्तुक द्वारा प्रदत्त शक्तियं एवं गृह मंत्र्ाालय भारत सरकार की अधिसूचना संख्या फां. 1/2/70/डीएच(एस) दिनांक 29 मई, 1970 एव अधिसूचना संख्या फां. 1/2/70/डीएच(एस) दिनांक 25 जुलाई, 1970 के द्वारा यथासंशोधित और इस संबंध में जारी अन्य सभी शक्तियों का प्रयग करते हुए रा'ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, दिल्ली उच्च न्यायालय के पराम"ार् से, दिल्ली न्यायिक सेवा नियमावली, 1970 का संशधन करने के लिए निम्नलिखित नियम बनाते हैंः-
1. संक्षिप्त शीर्षक एवं प्रारंभ .- (1) इन नियमं क दिल्ली न्यायिक सेवा (संशधन) नियमावली, 2019 कहा जायेगा।

ये नियम राजपत्र में प्रकाशन की तारीख क अस्तित्व में आ जायेंगे । 2. नियम 28 का संशधन .- दिल्ली न्यायिक सेवा नियमावली, 1970 (यहां बाद में 'नियमावली' क रूप
में संदर्भित) क नियम 28 क स्थान पर निम्नलिखित नियम प्रतिस्थापित किया जायेगा :-

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] "28 सीधी भर्ती द्वारा सेवा में की गई भर्ती अनुसूचित जाति, अनुसूचित जनजाति अर दिव्यांग उम्मीदवारं (विकलांग व्यक्तियं क अधिकार अधिनियम, 2016 की धारा 34 की उपधारा (1) में वर्णित किसी भी विकलांगता से पीड़ित) अर भूतपूर्व सैनिक जिनमें आपातकालीन कमीशन अधिकारी एवं शार्ट सर्विस कमीशन अधिकारी शामिल है, क लिए आरक्षण, विश्ष प्रतिनिधित्व एवं अन्य रियायतें जैसा कि कन्द्र सरकार द्वारा समय-समय पर जारी किए गए कानून या आदेशं द्वारा प्रदान किया जाता है यथा उपबंधित प्रावधान क अधिन हगीः
बशर्ते कि दिव्यांग उम्मीदवारं क कुशलता से मेडिकल बर्ड की संतुष्टि क अनुसार न्यायिक अधिकारी क रूप में अपने कर्तव्यं का निर्वहन करनें मे सक्षम हना चाहिए ज नियुक्ति क लिए उनक नाम की सिफारिश से पहले या बाद में गठित किए जा सकते हैं।"
3. परिशिष्ट का संशधनः-उक्त नियमं में परिशिष्ट में,-
(1) खंड (ii) क बाद, द्वितीय पैरा में, "शारीरिक रूप से विकलांग (–ष्टिहीन/न्यून –ष्टि) (गतिशीलता क प्रतिबंधित नहीं किया जाना चाहिए)/ऑर्थपेडिक रूप से" शब्दं क लिए, "विकलांगता वाले व्यक्ति" शब्दं क प्रतिस्थापित किया जायेगा। (2) पैरा-5 शीर्षक "मखिक परीक्षा" क लिए निम्नलिखित क प्रतिस्थापित किया जायेगाः-
"(5) मखिक परीक्षा : मखिक परीक्षा 150 अंक की हगी। कवल ऐसे अभ्यर्थियं क मखिक परीक्षा क लिए बुलाया जाएगा, जिन्हंने प्रत्येक लिखित पेपर में 40 प्रतिशत अंक अर कुल श्रेणियं में 50 प्रतिशत अंक प्राप्त किए हं, सिवाय आरक्षित श्रेणियं क उम्मीदवारं क मामले में, यानी अनुसूचित जाति, अनुसूचित जनजाति अर दिव्यांग व्यक्ति क मामले में प्रत्येक लिखित पेपर में अर्हक अंक 35 प्रतिशत अर कुल 45 प्रतिशत हंगे।
सेवा में नियुक्ति क लिए अनुशंसित हने की पात्रता क लिए मखिक परीक्षा में सामान्य श्रेणी क एक उम्मीदवार क न्यूनतम 50 प्रतिशत अंक अर आरक्षित श्रेणी क एक उम्मीदवार, यानी अनुसूचित जाति, अनुसूचित जनजाति अर विकलांग व्यक्ति क न्यूनतम 45 प्रतिशत अंक प्राप्त करने चाहिए।"

NOTIFICATIONS
Delhi, the 3rd May, 2019
No. F.6/13/2018-Judl./Suptlaw/834-838.—In exercise of the powers conferred by the proviso to article 309 of the Constitution read with Government of India, Ministry of Home Affairs Notification No.F.1/2/70/DH(S) dated the 29th May, 1970 as amended by Notification No.F.1/2/70-DH(S) dated the 25th July, 1970 and all other powers enabling him in this behalf, the Lieutenant Governor of National Captial Territory of Delhi in consultation with the High Court of Delhi is pleased to make the following rules further to amend the Delhi Judicial Service Rules, 1970, namely: - 1. Short title and commencement. - (1) These rules may be called the Delhi Judicial Service
(Amendment) Rules, 2019.
(2) They shall come into force on the date of their
publication in the Official Gazette.
2. Amendment of rule 28. -
In the Delhi Judicial Service Rules, 1970, (hereinafter referred to
as the said rules) for rule 28, the following shall be substituted, namely: -
"28. Recruitment made to the service by direct recruitment shall be subject to provisions regarding reservation, special representation and other concessions for the Scheduled Castes, Scheduled Tribes and Persons with Disability candidates (suffering from any of the disabilities mentioned in sub-section (1) of section 34 of the Rights of Persons with Disabilities Act, 2016) and ex-servicemen including Emergency Commissioned Officers and Short Service Commissioned Officers, as provided by law or orders issued by the Central Government from time to time:
[PART IV DELHI GAZETTE : EXTRAORDINARY 3Provided that the Persons with Disability candidates should be capable of efficiently discharging their duties as Judicial Officer as per the satisfaction of the Medical Board that may be constituted before or after their names are recommended for appointment."
3. Amendment of Appendix: In the said rules, in the Appendix, -
(1) after clause (ii), in para second, for the words, "Physically Handicapped (Blind / Low Vision) (mobility not to be restricted) / Orthopaedically" the words, "Persons with Disability" shall be substituted.
(2) for para-5, titled as "Viva Voce", the following shall be substituted, namely: -
"(5) Viva Voce : Viva-Voce will carry 150 marks. Only such candidates will be called for viva voce who have obtained 40% marks in each written paper and 50% marks in the aggregate except in the case of candidates belonging to reserved categories, i.e. Scheduled Castes, Scheduled Tribes and Persons with Disability in whose case the qualifying marks shall be 35% in each written paper and 45% in the aggregate.
A candidate of general category must secure minimum 50% marks and a candidate of reserved category, i.e. Scheduled Castes, Scheduled Tribes and Persons with Disability must secure minimum 45% marks in viva-voce to be eligible for being recommended for appointment to the service."

इन नियमं क दिल्ली उच्चतर न्यायिक सेवा (संशधन) नियमावली, 2019 कहा जायेगा । ये नियम राजपत्र में प्रकाशन की तारीख क अस्तित्व में आ जायेंगे । 2. नियम 22 का संशधन .- दिल्ली उच्चतर न्यायिक सेवा नियमावली, 1970 क नियम 22 क स्थान पर
निम्नलिखित नियम प्रतिस्थापित किया जायेगा।
"22 सीधी भर्ती द्वारा सेवा में की गई भर्ती अनुसूचित जाति, अनुसूचित जनजाति अर दिव्यांग उम्मीदवारं (विकलांग व्यक्तियं क अधिकार अधिनियम, 2016 की धारा 34 की उपधारा (1) में वर्णित किसी भी विकलांगता से पीड़ित) क लिए आरक्षण एवं अन्य रियायतें (आयु छूट क अलावा) जैसा कि कन्द्र सरकार द्वारा समय-समय पर जारी किए गए कानून या आदेशं द्वारा प्रदान किया जाता है यथा उपबंधित प्रावधान क अधिन हगीः
बशर्ते कि दिव्यांग उम्मीदवारं क कुशलता से मेडिकल बर्ड की संतुष्टि क अनुसार न्यायिक अधिकारी क रूप में अपने कर्तव्यं का निर्वहन करनें मे सक्षम हना चाहिए ज नियुक्ति क लिए उनक नाम की सिफारिश से पहले या बाद में गठित किए जा सकते हैं।"

Provided that the Persons with Disability candidates should be capable of efficiently discharging their duties as Judicial Officer as per the satisfaction of the Medical Board that may be constituted before or after their names are recommended for appointment."
