सं.डीसी/ओपीएस/टीपीटी/2014/26079.-जबकि मोटर वाहन अधिनियम, 1988 की धारा 212 की उपधारा (1) की अपेक्षानुसार दिल्ली मोटर वाहन नियमावली, 1993 का पुनः संशोधन करने के लिए नियमों का प्रारूप दिनांक 26.10.2018 की अधिसूचना सं. फा़. डीसी/ओप्स/टीपीटी/2014/445 के अनुसार दिल्ली राजपत्र भाग-4 असाधारण में, जिस तिथि को उक्त अधिसूचना वाला दिल्ली के राजपत्र की प्रतियां जनता को उपलब्ध कराई गई थी, उस तिथि से तीस दिन की अवधि बीतने से पहले इससे प्रभावित होने वाले सभी व्यक्तियों से आपत्तियां तथा सुझाव आमंत्रित करने के लिए प्रकाशित किया गया था, और जबकि उक्त राजपत्र अधिसूचना की प्रतियां जनता को 26 अक्तूबर, 2018 को उपलब्ध कराई गईं थी;
और जबकि उक्त प्रारूप नियमावली के संबंध में जनता से कोई भी आपत्ति एवं सुझाव प्राप्त नहीं हुए हैं।
अब इसलिए मोटर वाहन अधिनियम, 1988 (1988 का 59) की धारा 65 के साथ पठित दिल्ली मोटर वाहन नियमावली, 1993 के नियम 2 (q) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए दिल्ली मोटर वाहन नियमावली, 1993 का पुनः संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :-
नियम
1. संक्षिप्त शीर्षक एवं प्रारम्भ :- (1) इन नियमों को दिल्ली मोटर वाहन (प्रथम संशोधन) नियम, 2019 कहा जाएगा।
(2) ये दिल्ली राजपत्र में अपनी प्रकाशन तिथि से प्रभावी होगा।
2. नियम 34क (1) का संशोधन दिल्ली मोटर वाहन नियमावली, 1993 के नियम 34क के उपनियम (1) में 2980 DG/2019
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] निम्नलिखित को प्रतिस्थापित किया जाएगा :-
''किसी भी गैर-परिवहन चार पहिया वाहन एवं दो पहिया वाहन की स्थिति में निम्न
तालिका के कॉलम 1 में यथानििnZ'V कोई पंजीकरण अंक उपलब्ध पंजीकरण
श्रृंखलाओं में से किसी श्रृंखला में आबंटन श्रेणी 1, 2, 3, एवं 4 के संबंध में खुली
निलामी द्वारा सर्वाधिक बोली देने वाले को अतिरिक्त शुल्क का भुगतान करने पर
दिया जाएगा तथा श्रेणी 5 एवंम् 6 के संबंध में निम्न तालिका वर्णित अतिरिक्त "kqYd
का भुगतान करने पर दिया जाएगा।

| 6 | नए गैर परिवहन चार पहिया वाहन या दो पहिया वाहन की खरीद पर मौजूदा पंजीकरण चिन्ह का प्रतिधारण | प्रतिधारण करने वाले पंजीकरण चिन्ह की श्रेणी के न्यूनतम आरक्षित मूल्य का 10% या 25,000 / - रूपये जो भी अधिक हो। | प्रतिधारण करने वाले प जीकरण ं चिन्ह की श्रेणी के न्यूनतम आरक्षित मूल्य का / - 10% या 25,00 रूपये जो भी अधिक हो। | यथा लागू कॉलम 2 या 3 में यथाउल्ल्खिित अतिरिक्त शुल्क के भुगतान पर प्रतिधारण की अनुमति दी जायेगी। |
| पंजीकरण चिन्ह के प्राधिकरण की अनुमति तभी होगी जबकि पंजीकरण चिन्ह आवेदन की तिथि पर, आवेदक के नाम पर कम से कम तीन वर्षो से पंजीकृत होना चाहिए। |
यह अधिसूचना परिवहन मंत्री, दिल्ली सरकार के अनुमोदन से जारी की गई है।

Delhi, the 20th June 2019
No. DC/OPS/Tpt./2014/26079.—Whereas the draft rules further to amend the Delhi Motor Vehicles Rules, 1993 were published as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988, vide Notification No. F.DC/OPS/TPT/2014/445 dated 26.10.2018 in the Delhi Gazette, Extraordinary inviting objections and suggestions from all persons likely to be affected thereby, before expiry of the period of thirty days from the date on which copies of the Delhi Gazette containing the said notification were made available to public.
And whereas, copies of the said Gazette notification were made available to the public on the 26th October, 2018.
And whereas, no objection and suggestion has been received from the public in respect of the said draft rules.
Now, therefore, in exercise of the powers conferred by section 65, read with rule 2(q) of the Delhi Motor Vehicles Rules, 1993, the following rules further to amend the Delhi Motor Vehicles Rules, 1993 are hereby made, namely :-
Rules
Short Title and Commencement 1 (1) These rules may be called the Delhi Motor Vehicles (First Amendment)
Rules, 2019.
(2) They shall come into force on the date of their publication in the Delhi
Gazette.
Amendment in Rule
2 In the Delhi Motor Vehicles Rules, 1993, in Rule 34A, for sub-rule(1), the 34 A (1)
following shall be substituted,
"In case of non-transport four wheeled vehicle and two wheeled
vehicle, the assignment of registration mark as specified in column
1 of the table given below, in any available series of registration
marks shall be made available only on payment of additional fee to
the highest bidder selected through open auction in respect of
category 1, 2, 3 & 4 and on payment of additional fee in respect of
category 5 & 6 as per table given below :-

| The Retention of registration mark will be allowed, only if the registration mark has remained registered in the name of the applicant for a minimum period of three years, as on the date of application for retention. |
