Qk- la. ^144144144144////डडडडब्ल्यूब्ल्यूब्ल्यूब्ल्यू॰एफ॰डी॰॰एफ॰डी॰॰एफ॰डी॰॰एफ॰डी॰@सी॰ओ॰टी॰/सी॰ओ॰टी॰/सी॰ओ॰टी॰/सी॰ओ॰टी॰/18----19@^{4690469046904690}----^98989898.—दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त "kfDrयों का प्रयोग करते हुए रा'ट्रीय राजधानी क्षेत्र दिल्ली सरकार, राव तुला राम मेमोरियल, सरकारी अस्पताल, जाफरपुर, दिल्ली में मौजूदा हॉस्पिटल ब्लॉकों के निर्माण हेतु नीचे दिए गए विवरण के अनुसार 1.35 हेक्टेयर लगभग क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधो से छूट प्रदान करती है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] यह छूट निम्नलिखित "ार्तो के अधीन है।

1. आवेदक लोक निर्माण विभाग को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 13,11,000 /-रूपये (तेरह लाख ग्यारह हजार (cid:22)पये मात्र) की राि"ा अग्रिम रूप में जमा करवानी होगी।

2. देशी प्रजातियों के ²³⁰ पौधो का ¹⁰⁰% प्रतिपूरक वृक्षारोपण लोक निर्माण विभाग राव तुला राम मेमोरियल सरकारी अस्पताल, जाफ़रपुर, दिल्ली में उपलब्ध रिक्त क्षेत्र पर किया जायेगा और उनका सात वष< तक रखरखाव तथा सफलतापूर्वक स्थापना के बाद िनगरानी की जाएगी ।

3. ¹:¹⁰ स्वदेशी प्रजातियों के ⁶-⁸ फीट की ऊँ चाई वाले पौधे ²³ वृक्षो को हटाये/प्रत्यारोपण किए जाने के बदले मे प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के तीन महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण साइट विशिष्ट वृक्षारोपण तकनीकों के बाद किया जाएगा और उसका रखरखाव उपभोगी संस्था द्वारा अपने स्वयं की लागत पर किया जाएगा ।

4. उपभोगी संस्था लोक निर्माण विभाग अपने स्वयं के निधियों का उपयोग करके निर्धारित की गई भूमि पर बेहतर मिAी की नमी संरक्षण की गतिविधियों को लागू करेगी ।

5. उपभोगी संस्था यह सुनि0ित करेगी कि इस प्रस्ताव की योजना को परिवBतत नहC किया जाएगा ।

6. (अ) अनुमति जारी होने के तुरंत बाद पेड़ों का प्रत्यारोपण शुरू किया जाना चाहिए और इसे 3 महीने के अंतराल में पूरा किया जाना चािहए, जिसके बाद एक पूर्ण रिपोर्ट वृक्ष अधिकारी को प्रस्तुत की जानी चाहिए । स्थानांतरित किए जाने वाले वृक्षो की दूरी 4 मीटर (बिदु से बिदु) से कम नहC होनी चाहिए ।

(ब) वृक्षों के प्रत्यारोपण हेतु एक प्रस्तावित नीति दिल्ली सरकार मे िवचाराधीन है, इसिलए भविष्य की अनुमति में नीति के कार्यान्वयन के कारण प्रभावी होने वाले किसी भी बदलाव को संभावित प्रभाव के साथ सक्षम प्राधिकरण की मंजूरी के साथ उस सीमा तक संशोधित किया जाएगा ।

⁷. दिल्ली वृक्ष (संरक्षण) अिधिनयम, ¹⁹⁹⁴ में प्रावधानों के अनुसार प्रतिपूरक वृक्षारोपण के बारे में कार्य पूर्ण अभिलेख लोक निर्माण विभाग उपभोगी संस्था को प्रस्तुत करने होंगे ।

8. वृक्षो की प्रत्यारोपण की अनुमति उनके स्वयं के जोखिम/ ज़िम्मेदारी पर दी जाएगी और किसी भी अन्य Rक्ति के दावे के पक्षपात के बिना, जो वृक्षो की भूमि पर सही हो सकती है ।

9. 23 वृक्षों को हटाए/ प्रत्यारोपण किए जाने के उपरान्त प्राप्त लकड़ी की नीलामी भूिम स्वामित्व संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार को राजस्व के रूप में जमा कर दी जाएगी ।

10. वृक्षो को हटाने/ प्रत्यारोपण किए जाने से पहले सभी वैधानिक प्रावधानों का अनुपालन उपभोगी संस्था द्वारा किया जाएगा ।

11॰ वृक्ष काटे/प्रत्यारोपण किए जाने के स्थल से लकड़ी ले जाने से पूर्व उक्त लकडियों की ढुलाई के लिए वृक्ष अधिकारी 13. वृक्षों के प्रत्यारोपण और प्रतिपूरक वृक्षारोपण की प्रगित निरीक्षण अधिकारी के माध्यम से उप-वन संरक्षक (पEिमी) को वृक्षो के पूर्ण विवरण के साथ संबन्धित गतिविधि उपरान्त जमा की जाएगी ।

NOTIFICATION

Delhi, the 21st June, 2019

F.No.144/WFD/COT/18-19/ 4690-98 - In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 1.35 hectare approx as detailed below for construction of existing Hospital Blocks in Rao Tula Ram Memorial, Govt. Hospital at Jaffarpur, Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-

1. The applicant Public Works Department shall make an advance deposit of an amount of Rs. 13,11,000 /- (Rupees Thirteen Lakh and Eleven Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

2. 100% Compensatory Plantation of 230 saplings of native species will be raised and maintained by Public Works Department for Seven years and monitored till its successful establishment at Vacant Area available in Rao Tula Ram Memorial Hospital, Jaffarpur, Delhi..

3. 1:10 plants of indigenous species 6-8 feet height will be planted as compensatory plantation on non-forest land in lieu of removal/ transplantation of 23 no. of trees. The plantation will be done following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal/ transplantation permission and maintenance would be carried out there after by User agency with their own funds.

4. The User agency shall implement the improved soil moisture conservation activities on identified land using their own funds.

5. The User agency shall ensure that the plan of this proposal shall not be changed.

6. (i) Transplantation of trees must be initiated immediately after permission is issued and should be completed not later than 3 months, after which a completion report has to be submitted to the Tree Officer. The spacing of the translocated trees should not be less than 4 metres (point to point).

(ii). A draft policy on transplantation of trees is under active consideration with State Government of Delhi, therefore any change brought in to effect due to implementation of the policy in future permission would be modified to that extent with the approval of Competent Authority with prospective effect.

7. Completion of documentation regarding compensatory plantation as per provisions in DPTA, 1994 would be done by user agency.

8. The permission for transplantation of the trees would be granted at their own risk and without prejudice to the claim (S) of any other person/s who may be having right (s) over the land of the trees.

9. All statutory provisions shall be complied by User agency before the transplantation of trees from the site is commenced.

10. The timber obtained from felling/ transplanting of 23 trees shall be auctioned by the land owning agency and the proceeds shall be deposited as revenue to the Government.

11. Before shifting of timber if any, from site of removal/ transplantation of trees, transportation permission for transportation of the said wood shall be obtained from DCF/ Tree Officer (West).

12. The lops and tops obtained on removal of trees shall be handed over by the Public Works Department to the officials concerned of Municipal Corporation of Delhi for its use on public crematoria in Delhi free of cost and receipt so obtained may be deposited with DCF (West).

13. The progress of transplantation of trees & compensatory plantation shall be submitted through Inspection Officer to DCF (West) after completion alongwith complete details of trees immediately.
