(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 1. आवेदक सिंचाई एवं बाढ़ नियंत्रण िवभाग को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 1,07,73,000 /-रूपये (एक करोड़ सात लाख तेहत्तर हजार 4पये मात्र) की राशि अग्रिम रूप में जमा करवानी होगी।

| 2. | 180 वृक्षों का प्रत्यारोपण आर।डी॰ 17905 एम॰ से 18505 एम॰ के बीच चावला ब्रिज के बाएं किनारे के नजदीक प्रस्तावित है, साइट का अनुमानित क्षेत्र 42000 वर्ग मीटर है। प्रत्यारोपण उपरान्त इन प्रत्यारोपित वृक्षो के रखरखाव की ज़िम्मेदारी भी उपभोगी संस्था की होगी । |
2. देशी प्रजातियों के 1890 पौधो का 100% प्रतिपूरक वृक्षारोपण सिंचाई एवं बाढ़ नियंत्रण िवभाग द्वारा नीलोठी ब्रिज आर॰डी॰ 37280 एम॰ से चंदर विहार ब्रिज आर॰डी॰ 38960 एम॰ पर किया जायेगा और उनका सात वष% तक रखरखाव तथा सफलतापूर्वक स्थापना के बाद िनगरानी की जाएगी ।
3. वृक्षारोपण की अनुमति के जारी होने के तीन महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण साइट विशिष्ट वृक्षारोपण तकनीकों के बाद किया जाएगा और उसका रखरखाव उपभोगी संस्था द्वारा अपने स्वयं की लागत पर किया जाएगा ।
4. उपभोगी संस्था सिंचाई एवं बाढ़ नियंत्रण िवभाग अपने स्वयं के निधियों का उपयोग करके निर्धारित की गई भूमि पर मृदा नमी संरक्षण कार्य की गतिविधियों को लागू करेगी ।
5. उपभोगी संस्था यह सुनि:ित करेगी कि इस प्रस्ताव की योजना को परिव;र्तत नह< किया जाएगा ।
6. (अ) अनुमति जारी होने के तुरंत बाद पेड़ों का प्रत्यारोपण शुरू किया जाना चाहिए और इसे 3 महीने के अंतराल में पूरा किया जाना चािहए, जिसके बाद एक पूर्ण रिपोर्ट वृक्ष अधिकारी को प्रस्तुत की जानी चाहिए । स्थानांतरित किए जाने वाले वृक्षो की दूरी 4 मीटर (बिंदु से बिंदु) से कम नह< होनी चाहिए ।
(ब) वृक्षों के प्रत्यारोपण हेतु एक प्रस्तावित नीति दिल्ली सरकार मे िवचाराधीन है, इसलिए भविष्य की अनुमति में नीित के कार्यान्वयन के कारण प्रभावी होने वाले किसी भी बदलाव को संभावित प्रभाव के साथ सक्षम प्राधिकरण की मंजूरी के साथ उस सीमा तक संशोधित किया जाएगा ।
7. दिल्ली वृक्ष (संरक्षण) अिधिनयम, 1994 में प्रावधानों के अनुसार प्रतिपूरक वृक्षारोपण के बारे में कार्य पूर्ण अभिलेख उपभोगी संस्था सिंचाई एवं बाढ़ नियंत्रण विभाग को प्रस्तुत करने होंगे ।
8. वृक्षो की प्रत्यारोपण/हटाए जाने की अनुमति उनके स्वयं के जोखिम/ज़िम्मेदारी पर दी जाएगी और किसी भी अन्य Lक्ति के दावे के पक्षपात के बिना, जो वृक्षो की भूमि पर सही हो सकती है ।
9. 189 वृक्षों को हटाए/प्रत्यारोपण किए जाने के उपरान्त प्राप्त लकड़ी की नीलामी भूिम स्वामित्व संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार को राजस्व के रूप में जमा कर दी जाएगी ।
10. वृक्षो को हटाने/प्रत्यारोपण किए जाने से पहले सभी वैधानिक प्रावधानों का अनुपालन उपभोगी संस्था द्वारा किया जाएगा ।
11. वृक्ष काटे /प्रत्यारोपण किए जाने के स्थल से लकड़ी ले जाने से पूर्व उक्त लकडियों की ढुलाई के लिए वृक्ष अधिकारी (प7िमी) से ढुलाई अनुमति प्राप्त करनी होगी।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 12. वृक्षों की ऊपरी शाखांए (लोप्स एंड टॉप्स) की लकड़ी को काटे जाने के पश्चात प्राप्त लकड़ी मु?त में दिल्ली नगर निगम के संबधित कर्मचारियों को सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाए और प्राप्त रसीद को उप-वन संरक्षक (प7िमी) को जमा की जाये ।
13. वृक्षों के प्रत्यारोपण और प्रतिपूरक वृक्षारोपण की प्रगति निरीक्षण अधिकारी के माध्यम से उप-वन संरक्षक (प7िमी) को वृक्षो के पूर्ण विवरण के साथ संबन्धित गतिविधि उपरान्त जमा की जाएगी ।

NOTIFICATION
Delhi, the 4th July, 2019
F.No.126/WFD/COT/18-19/5131-39.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 2.2841 hectare approx as detailed below for construction of N.G. Pond Drain, Najafgarh, Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. The applicant i.e Irrigation & Flood Control Department shall make an advance deposit of an amount of Rs. 1,07,73,000 /- (Rupees One Crore Seven Lakh and Seventy Three Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

| 2. | The Transplantation of 180 trees is proposed to be carried near left bank downstream of Chawla Bridge between RD 17905 M to 18505 M. the approximate area of the site is 42000 Sq. mtr. Post transplantation care of the trees will be ensured by the project proponent. |
2. 100% Compensatory Plantation of 1890 saplings of native species will be raised and maintained by Irrigation & Flood Control Department for Seven years and monitored till its successful establishment at Nilothi Bridge RD 37280 M to Chander Vihar Bridge RD 38960M.
3. The plantation will be done following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal/ transplantation permission and maintenance would be carried out there after by User agency with their own funds.
4. The User agency shall implement the improved soil moisture conservation activities on identified land using their own funds.
5. The User agency shall ensure that the plan of this proposal shall not be changed.
6. (a) Transplantation of trees must be initiated immediately after permission is issued and should be completed not later than 3 months, after which a completion report has to be submitted to the Tree Officer. The spacing of the translocated trees should not be less than 4 metres (point to point).
(b). A draft policy on transplantation of trees is under active consideration with State Government of Delhi, therefore any change brought in to effect due to implementation of the policy in future permission would be modified to that extent with the approval of Competent Authority with prospective effect.
7. Completion of documentation regarding compensatory plantation as per provisions in DPTA, 1994 would be done by user agency.
8. The permission for felling/ transplantation of the trees would be granted at their own risk and without prejudice to the claim (S) of any other person/s who may be having right (s) over the land of the trees.
9. All statutory provisions shall be complied by User agency before the felling/ transplantation of trees from the site is commenced.
10. The timber obtained from felling/ transplanting of 189 trees shall be auctioned by the land owning agency and the proceeds shall be deposited as revenue to the Government.
11. Before shifting of timber if any, from site of removal/ transplantation of trees, permission for transportation of the said wood shall be obtained from DCF/ Tree Officer (West).
12. The lops and tops obtained on removal of trees shall be handed over by the Irrigation & Flood Control Department to the officials concerned of Municipal Corporation of Delhi for its use on public crematoria in Delhi free of cost and receipt so obtained may be deposited with DCF (West).
13. The progress report of transplantation of trees & compensatory plantation shall be submitted through Inspection Officer to DCF (West) after completion alongwith complete details of trees immediately.
