फा.स. 158/डब्लू॰एफ॰डी॰/सी॰ओ॰टी॰/17-18/5538-46 - दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, रोड अंडर ब्रिज के पास, सेक्टर -21, द्वारका दिल्ली से दिल्ली-हरियाणा बार्डर के पास, द्वारका एक्सप्रेसवे पैके ज- II (खंड- ब) के निर्माण के कार्य हेतु नीचे दिए गए विवरण के अनुसार 3,88,884 वर्ग मीटर (38.88 हेक्टेयर) लगभग क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधाें से छूट प्रदान करती है।

3594 DG/2019 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 2. 63600636006360063600 पौधों का 100 % 100 % 100 % 100 % प्रतिपूरक वृक्षारोपण उपभोगी संस्था द्वारा किया जायेगा और उनका सात वष0 तक रखरखाव तथा सफलतापूर्वक स्थापना के बाद उपरोक्त 1 (1 (1 (1 (क) & (& (& (& (ख) के अनुसार िनगरानी की जाएगी । 3.3.3.3. उपभोगी संस्था अतिरिक्त साइट सुधार खच0 को भी जमा करेगी जो कि वृक्षारोपण के िलए उपयुक्त वृक्ष अिधकारी द्वारा गणना के रूप में साइट को उपयुक्त बनाने के िलए आवश्यक हो सकता है (जमा रािश के रूप में)। 4.4.4.4. 1:101:101:101:10 स्वदेशी प्रजातियों के 6666----8888 फीट की ऊँ चाई वाले पौधे 6360636063606360 वृक्षो को हटाये जाने के बदले में प्रतिपूरक वृक्षारोपण गैर-वन भूिम पर किया जाएगा । वृक्षारोपण की अनुमित के जारी होने के तीन महीने के अंदर निर्धारित की गई भूिम पर अतिरिक्त उपायों के साथ वृक्षारोपण साइट विशिष्ट वृक्षारोपण तकनीकों के बाद किया जाएगा और उसका रखरखाव भारतीय राष्ट्रीय राजमार्ग प्राधिकरण / उपभोगी संस्था द्वारा अपने स्वयं की लागत पर किया जाएगा ।
5.5.5.5. भारतीय राष्ट्रीय राजमार्ग प्राधिकरण / उपभोगी संस्था अपने स्वयं के निधियों का उपयोग करके निर्धारित की गई भूिम पर मृदा नमी संरक्षण कार्य की गतिविधियों को लागू करेगी।
6.6.6.6. भारतीय राष्ट्रीय राजमार्ग प्राधिकरण / उपभोगी संस्था यह सुनि?ित करेगी कि साइट विशिष्ट (प्रतिपूरक वृक्षारोपण का स्थान) वन्यजीव संरक्षण योजना अपने स्वयं के धन से सक्षम वन्यजीव पेशेवरों के माध्यम से कार्यान्वित की जाती है।
7.7.7.7. भारतीय राष्ट्रीय राजमार्ग प्राधिकरण / उपभोगी संस्था यह सुनि?ित करेगी कि इस प्रस्ताव की योजना को परिवBर्तत नहC किया जाएगा ।
8.8.8.8. िजस भूिम पर प्रतिपूरक वृक्षारोपण किया गया है, , , , उसका उपयोग संबंिधत वृक्ष अिधकारी की स्वीकृ ति के िबना अन्य प्रयोजन के िलए नहC किया जाएगा।
9.9.9.9. साइट को अतिDमण और बायोटिक हस्तक्षेप से सुरक्षित करना होगा ।
10.10.10.10. जहां कहC भी आवश्यक हो, , , , मृदा तैयार करने के िलए Eापक हस्तक्षेप करना आवश्यक होगा ।
11.11.11.11. दिल्ली वृक्ष laj{k.k अिधिनयम, 1994, 1994, 1994, 1994 की धारा 12121212 के अनुपालन में उपभोगी संस्था द्वारा विस्तृत वृक्षारोपण अनुसूची प्रस्तुत की जाएगी ।
12.12.12.12. भारतीय राष्ट्रीय राजमार्ग प्राधिकरण/ दिल्ली िवकास प्राधिकरण द्वारा साइट की तैयारी और वृक्षारोपण के िलए एक विस्तृत योजना प्रस्तुत किया जाएगा ।
13.13.13.13. ((((क) अनुमित जारी होने के तुरंत बाद पेड़ों का प्रत्यारोपण शुरू किया जाना चािहए और इसे 3333 महीने के अंतराल में पूरा किया जाना चािहए, , , , िजसके बाद एक पूर्ण रिपोर्ट वृक्ष अिधकारी को प्रस्तुत की जानी चािहए । स्थानांतरित किए जाने वाले वृक्षो की दूरी 4444 मीटर (बिंदु से बिंदु) से कम नहC होनी चािहए ।
((((ख) वृक्षों के प्रत्यारोपण हेतु एक प्रस्तावित नीित दिल्ली सरकार में िवचाराधीन है, , , , इसिलए भविष्य की अनुमित में नीित के कार्यान्वयन के कारण प्रभावी होने वाले किसी भी बदलाव को संभािवत प्रभाव के साथ सक्षम प्राधिकरण की मंजूरी के साथ उस सीमा तक संशोिधत किया जाएगा ।
14.14.14.14. दिल्ली वृक्ष laj{k.k अिधिनयम, 1994, 1994, 1994, 1994 के प्रावधानों के अनुसार प्रतिपूरक वृक्षारोपण के संबंध में प्रलेखन का समापन उपभोगी संस्था द्वारा किया जाएगा ।
15.15.15.15. भारतीय राष्ट्रीय राजमार्ग प्राधिकरण/ उपभोगी संस्था द्वारा प्रस्तावित 6360636063606360 वृक्षों के अलावा किसी भी वृक्ष की कटाई / प्रत्यारोपण एक अपराध होगा ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 16.16.16.16. वृक्षों की कटाई / प्रत्यारोपण को नियंत्रित करने वाली सामान्य शतL लागू होंगी ।
17.17.17.17. प्रस्तावित वृक्षों के प्रत्यारोपण के िलए उपभोगी संस्था द्वारा पर्याप्त स्थान उपलब्ध कराना होगा, , , , जैसा कि उनके द्वारा आNासन दिया गया है ।
18.18.18.18. 2624262426242624 वृक्षों की कटाई और 3736373637363736 वृक्षों के प्रत्यारोपण की अनुमित अर्थात 6360636063606360 वृक्षो को हटाने के िलए उनके स्वयं के जोिखम पर दी जाएगी और किसी भी अन्य Eक्ति के दावे के पक्षपात के िबना अनुमित दी जाएगी, , , , जो वृक्षों और भूिम पर सही हो सकती है ।
19.19.19.19. वृक्षों को हटाने/ प्रत्यारोपण किए जाने से पहले सभी वैधािनक प्रावधानों का अनुपालन उपभोगी संस्था द्वारा किया जाएगा ।
20.20.20.20. वृक्षों का सम्पूर्ण प्रगति िववरण संबंिधत निरीक्षण अिधकारी के माध्यम से हटाने/ िगराने, , , , प्रत्यारोपण एवं प्रतिपूरक वृक्षारोपण की प्रगति रिपोर्ट उपभोगी संस्था द्वारा प्रस्तुत की जाएगी ।
21.21.21.21. वृक्षों को हटाने/ प्रत्यारोपण के स्थल से लकड़ी ले जाने से पूर्व उक्त लकडियों की ढुलाई के लिए वृक्ष अधिकारी (पि(cid:3)मी½ से ढुलाई अनुमति प्राप्त करनी होगी।
22.22.22.22. वृक्षों को हटाने/ प्रत्यारोपण किए जाने के उपरान्त प्राप्त लकड़ी की नीलामी भू-स्वामित्व संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार को राजस्व के रूप में जमा कर दी जाएगी```` वृक्षों की ऊपरी शाखांए (लोप्स एंड टॉप्स) की लकड़ी को काटे जाने के पश्चात प्राप्त लकड़ी मुQत में िनकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाए ।
23.23.23.23. किथत आरोप के तहत 400400400400 वृक्षों को हटाने की जांच अभी भी वृक्ष अिधकारी (प?िम) द्वारा चल रही है तथा इस मामले में जारी किए गए परिणाम / आदेश के िलए भारतीय राष्ट्रीय राजमार्ग प्राधिकरण के िलए बाध्य होंगे।
24.24.24.24. परिवहन भवन में दिनांक 03030303 अक्तू बर, 2018, 2018, 2018, 2018 को अपराSन 02020202 बजे द्वारका एक्सप्रेसवे के कार्यान्वयन से संबंिधत (रा॰रा॰ 248248248248 बी॰ बी॰) (बिंदु संख्या XIV) XIV) XIV) XIV) माननीय मंत्री, , , , सड़क परिवहन और राजमार्ग मंत्रालय की अध्यक्षता में Uई बैठक के कार्यवृत्त के अनुसार दिल्ली िवकास प्राधिकरण उपभोगी संस्था की ओर से 6360636063606360 वृक्षों की कटाई के एवज में 100 % 100 % 100 % 100 % प्रतिपूरक वृक्षारोपण करेगा, , , , जिसमें कहा गया है कि:
उपाध्यक्ष, , , , दिल्ली िवकास प्राधिकरण ने उल्लेख किया कि प्रतिपूरक वृक्षारोपण का कार्य दिल्ली िवकास प्राधिकरण द्वारा किया जाना है, , , , वे यह सुनि?ित करेंगे कि प्रतिपूरक वृक्षारोपण योजना के अनुसार आवश्यक संख्या में वृक्ष लगाए जाएं और इस प्रतिपूरक वृक्षारोपण के सत्यापन का कार्य उन्हC के द्वारा किया जायेगा, , , , इसके िलए वे वन िवभाग के साथ समन्वय करें। वन िवभाग ने प्रतिपूरक वृक्षारोपण के िलए दिल्ली िवकास प्राधिकरण के साथ समन्वय करने और उसी के सत्यापन को सुनि?ित करने के िलए भी सहमित Eक्त की है। प्रमुख आयुक्त (उद्यान।) दिल्ली िवकास प्राधिकरण ने यह भी आNासन दिया कि वे वृक्षों की प्रजातियां जो वे प्रतिपूरक वृक्षारोपण स्थल में लगाएंगे, , , , वे पौधे होंगे जो दिल्ली वृक्ष laj{k.k अिधिनयम, 1994, 1994, 1994, 1994 में वृक्षों की परिभाषा के अनुसार हैं । उपाध्यक्ष, , , , दिल्ली िवकास प्राधिकरण ने पुष्टि की है कि इस मामले में जो भूिम निर्धारित की गई थी, , , , यदि वृक्षारोपण के िलए वह भूिम अपर्याप्त पायी गयी, , , , तो शेष वृक्षारोपण दिल्ली िवकास प्राधिकरण द्वारा उपलब्ध अन्य भूिम खंड पर किया जाएगा।

NOTIFICATION
Delhi, the 12th July, 2019
F.No.158/WFD/COT/17-18/5538-46.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 3,88,884 Sq. Mtr. Acres. (38.88 ha.) approx as detailed below for the work of construction of Dwarka Expressway Package-II (Part-B) from road under Bridge, Near Sector-21, Dwarka, Delhi to Delhi-Haryana Border from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is in continuation to the earlier Notification issued vide F.No. 158/WFD/COT/17-18/2204-12 dated 13.03.2019 for 2675 trees and subject to fulfillment of the following conditions:-
1. The applicant i.e National Highway Authority of India shall make an advance deposit of an amount of Rs. 36,25,20,000 /- (Rupees Thirty Six Crore Twenty Five Lakh and Twenty Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

2. 100% Compensatory Plantation of 63600 saplings of native species will be raised and maintained by NHAI for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.
3. User agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer concerned (as deposits).
[PART IV DELHI GAZETTE : EXTRAORDINARY 54. 1:10 plants of native species 6-8 feet height will be planted as compensatory plantation on non-forest land in lieu of removal of 6360 no. of trees. The plantation will be done following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance would be carried out there after by NHAI/ User agency with their own funds.
5. The NHAI/ User agency shall implement the improved soil moisture conservation activities on identified land using their own funds.
6. The NHAI/ User agency shall ensure that the site specific (Compensatory plantation site) wildlife conservation plan is implemented through competent wildlife professionals from their own funds.
7. The NHAI/ User agency shall ensure that the plan of this proposal shall not be changed.
8. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval of Tree Officer concerned.
9. Site will have to be secured from encroachment and biotic interference.
10. Extensive interventions will have to be undertaken for soil preparation, wherever required.
11. Detailed plantation schedule will have to be submitted by user agency in compliance with Section 12 of Delhi Preservation of Trees Act, 1994.
12. NHAI/ DDA shall submit a detailed plan for site preparation and plantation.
13. (a) Transplantation of trees must be initiated immediately after permission is issued and should be completed not later than 3 months, after which a completion report has to be submitted to the Tree Officer. The spacing of the translocated trees should not be less than 4 metres (point to point).
(b). A draft policy on transplantation of trees is under active consideration with State Government of Delhi, therefore any change brought in to effect due to implementation of the policy in future permission would be modified to that extent with the approval of Competent Authority with prospective effect.
14. Completion of documentation regarding compensatory plantation as per provisions in DPTA, 1994 would be done by user agency.
15. Felling/transplant of any trees apart from the proposed 6360 trees by NHAI would constitute an offence.
16. Usual conditions governing felling/transplant of trees would be applicable.
17. Adequate space will have to be provided by user agency for transplantation of proposed trees as assured by them.
18. Permission for felling of 2624 trees and transplantation of 3736 trees i.e., removal of all 6360 tress would be granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
19. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the user agency.
20. Progress report of felling, transplanting & Compensatory Plantation shall be submitted through inspection officer concerned along with complete details of trees.
21. For shifting of timber from site of removal/ transplantation of trees, permission for transport of the said wood shall be obtained from the DCF (West)/ Tree Officer.
22. The timber obtained from removal of felling shall be auctioned by the user agency and deposit the proceeds as Govt. revenue. Lops and tops of the trees, will be sent/ supplied to the nearest public crematoria free of cost.
23. As investigation/ inquiry of alleged removal of 400 trees is still underway by Tree Officer (West) the outcome/ order issued in this matter shall be binding on NHAI.
24. On behalf of NHAI, DDA will carry out 100% compensatory plantation in lieu of removal of these 6360 Nos. of trees as per the minutes of meeting held on 3rd October, 2018 at 2:00 PM under the Chairmanship of Minister, RT&H, at Transport Bhawan regarding Implementation of Dwarka Expressway (NH-248BB), point No. (XIV), which quotes as:
VC, DDA mentioned that as the work of compensatory plantation is to be done by DDA, they would ensure that the required number of trees as per compensatory plantation scheme is planted and the onus of verification of this compensatory plantation lies with them for which they will coordinate with Forest Dept. forest Dept. also agreed to this for further coordinating with DDA for taking up compensatory plantation and ensuring verification of the same. PC (Hort.) DDA also assured that the species of trees they would plant in the compensatory plantation site shall be those trees which are in accordance with the definition of the trees in DPTA, 1994. VC, DDA confirmed that in case land identified was found to be insufficient for plantation, balance plantation would be done on other land parcels available with DDA".
6 DELHI GAZETTE : EXTRAORDINARY PART IV]25. Transplantation of 3736 native trees shall be ensured by User Agency in the area 94.42 Hectares proposed by them for compensatory tree transplantation.
26. All the terms and conditions specified in the Notification No. F.158/WFD/COT/17-18/2204-12, Dated:
13/03/2019 will be compiled by NHAI.
