फा.सं. डीपीसीसी/(3)(3)(8-15)/प्रशा.-14/300.—जल (प्रदूषण निवारण एवं नियंत्रण) अधिनियम, 1974 की धारा 12 की उपधारा (3क) के साथ पठित धारा 2 के खंड (i) द्वारा प्रदा शक्तियों का प्रयोग करते हुए, अध्यक्ष, दिल्ली प्रदूषण नियंत्रण समिति, माननीय उपराज्यपाल, राष्ट्रीय राजधानी क्षेत्र दिल्ली के पूर्वानुमोदन से एतद्द्वारा दिल्ली प्रदूषण नियंत्रण समिति में सहायक विधि अधिकारी के भर्ती विनियम, 2017 में संशोधन हेतु :-
1. संक्षिप्त शीर्षक तथा प्रारंभः-(i) इन विनियमों को दिल्ली प्रदूषण नियंत्रण समिति के सहायक विधि अधिकारी, भर्ती (संशोधन) विनियम, 2019 कहा जाए।
(ii). ये सरकारी राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।
2. दिल्ली प्रदूषण नियंत्रण समिति में सहायक विधि अधिकारी के भर्ती विनियम, 2017 की अनुसूची में कॉलम 4, 7 एवं 11 को बदलकर निम्नलिखित को स्थानापन्न किया जाता हैः-
| "वेतन मैट्रिक्स में स्तर | सीधी भर्ती वाले उम्मीदवारों से अपेक्षित शैक्षिक तथा अन्य योग्यताएॅं | यदि पदोन्नति/प्रतिनियुक्ति/स्थानान्तरण द्वारा भर्ती होनी हो तो ग्रेड जिनसे पदोन्नति/प्रतिनियुक्ति/ स्थानान्तरण किया जाना है |

| (रूपये 44900-142400) ( पूर्व संशोधित पे बैंड-2, रूपये 9300-34800 ग्रेड पे-4600/-रुपए) | में स्नातक की उपाधि ( 2) विधिक प्रैक्टिशनर के रूप में चार वर्ष का अनुभव या सरकारी विभाग/ सार्वजनिक क्षेत्र के उपक्रम में विधिक कार्य का चार वर्ष का अनुभव | 9300-34800 ग्रेड पे-4200/-रुपये) में पांच वर्ष की नियमित सेवा वाले विधि सहायक ट ीप : जिन कनिष्ठ अधिकारियों ने अपनी अर्हक/पात्रता सेवा पूरी कर ली है वे पदोन्नति के लिए विचारणीय हैं। उनके वरिष्ठ अधिकारी भी पदोन्नति के लिए विचारणीय होंगे बशर्त कि उनके लिए अपेक्षित ं े अर्हक/पात्रता सेवा ऐसी अपेक्षित अर्हक/पात्रता सेवा की अवधि के आधे से न्यून या दो वर्ष से कम न हो और उन्होंने आगामी उच्च ग्रेड पर पदोन्नति के लिए अपनी परिवीक्षा अवधि अपने कनिष्ठ अधिकारियों क साथ सफलतापूर्वक पूरी कर ली होे, जिन्होंने (कनिष्ठ अधिकारी) े उतनी अर्हक/पात्रता पहले ही पूरी कर ली है। प ्रतिनियुक्तिः- केन्द्रीय/ राज्य सरकार/संघ राज्य क्षेत्र प्रशासन या केन्द्रीय/राज्य स्वायत्त निकाय या सांवधिक निकायों के निम्नलिखित अधिकारीः- क . (1) नियमित आधार पर समरूप पदधारण करने वाले; अथवा (2) वेतन मैट्रिक्स में स्तर -6 (पूर्व संशोधित पे बैंड-2 9300-34800/-रुपये ग्रेड पे 4200/-रुपये)े के पद में कम से कम पांच वर्ष की नियमित सेवा रखने वाले; तथा ( ख) कालम (7) के अन्तर्गत सीधी भर्ती के लिये निर्धारित योग्यताएँ एवं अनुभव रखने वाले। ( प्रतिनियुक्ति की अवधि सामान्यतः तीन वर्ष से अधिक नहीं होगी) न ोटः भरक श्रेणी के विभागीय अधिकारी जो कि पदोन्नति की सीधी श्रृखंला में हैं वे प्रतिनियुक्ति पर नियुक्ति हेतु विचारणीय नहीं होंगे। इसी तरह, प्रतिनियुक्ति वाले भी पदोन्नति द्वारा नियुक्ति हेतु विचारणीय नहीं होंगे।" |

Delhi, the 5th August , 2019
No. DPCC/(3)(3)(8-15)/Admn.-14/300.—In exercise of the powers conferred by sub-section (3A) of section 12 read with clause (i) of section 2 of the Water (Prevention and Control of Pollution) Act, 1974, the Chairman, Delhi Pollution Control Committee, with prior approval of Hon'ble Lt. Governor, National Capital Territory of Delhi, hereby amends the Delhi Pollution Control Committee Assistant Law Officer Recruitment Regulations, 2017, namely:-
1. Short title and commencement.-(i) These regulations may be called the, Delhi Pollution Control Committee, Assistant Law Officer Recruitment (Amendment) Regulations, 2019.
(ii) They shall come into force on the date of their publication in the Delhi Gazette.
[PART IV DELHI GAZETTE : EXTRAORDINARY 32. In the Delhi Pollution Control Committee, Assistant Law Officer Recruitment Regulations, 2017, in the Schedule, for columns 4, 7 and 11 and the entries thereto, following shall be substituted, namely:-
| "Level in Pay matrix | Educational and other qualifications required for direct recruits. | In case of recruitment by promotion/deputation/ absorption grades from which promotion/ deputation/absorption to be made. |

| Level 7 of the Pay Matrix. (Rs. 44900- 142400) ( Pre-revised Pay Band 2, Rs.9300-34800/- with grade pay Rs.4600/-). | (i) Bachelor's Degree in Law from recognized University/ Institution. ( ii) Four years experience as Legal Practitioner, or four years experience in handling legal work in a Government Department/ Public Sector Undertaking. | Promotion: Legal Assistant with five years regular service in the grade rendered after appointment thereto on regular basis in Level 6 of pay matrix (Pre-revised Pay Band -2, Rs.9300-34800/- plus Grade Pay Rs. 4200/-) Note : Where the juniors who have completed their qualifying/eligibility service are being considered for promotion, their senior would also be considered provided they are not short of the requisite qualify/eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying /eligibility service. Deputation: Officers of the Central Government / State Governments / Union Territory Administrations or Central / State Autonomous or Statutory bodies; (a)(i) holding analogous posts on regular basis; or (ii) having atleast five years of regular service in posts in Level 6 of pay matrix (Pre-revised Pay Band-2, Rs. 9300- 34800/- with Grade Pay of Rs.4200/- and (b) Possessing the qualifications and experience as laid down for direct recruits in column 07. ( Period of deputation shall not ordinarily exceed three years). N ote: The departmental Officers in the feeder category who are in direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationist shall not be eligible for consideration for appointment by promotion." |
