संसंसंसं....फाफाफाफा.... 03(19)/03(19)/03(19)/03(19)/वित्तवित्तवित्तवित्त((((राजराजराजराज....----1)/20191)/20191)/20191)/2019----20/ 20/ 20/ 20/ डीएसडीएसडीएसडीएस----VI/400VI/400VI/400VI/400....————राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, दिल्ली माल और सेवा कर अिधिनयम, 2017 (2017 का 03) की धारा 164 द्वारा प्रदत्त शक्तियों का प्रयोग करते ए, दिल्ली माल और सेवा कर िनयम, 2017 का और संशोधन करने के िलए निम्नलिखित िनयम बनाते हैं, अर्थात् :-
1. (1) इन नियमों का संक्षिप्त नाम दिल्ली माल और सेवा कर (नौवां संशोधन) िनयम, 2018 है ।
(2) ये 10 सितम्बर, 2018 से लागू मानी जाएगी।
2. दिल्ली माल और सेवा कर िनयम, 2017 में,-
(i) िनयम 117 में
(क) उपिनयम (1) के प/ात्, निम्नलिखित उपिनयम अंतःस्थापित किया जाएगा, अर्थात् :-

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] "(1क) उपिनयम (1) में अन्त3वष्ट किसी बात के होते ए भी, आयुक्त, परिषद् की सिफारिशों पर, ऐसे रजिस्ट्रीकृ त >क्तियों, जो सामान्य पोर्टल पर तकनीकी कठिनाइयों के कारण देय तारीख तक उक्त घोषणा प्रस्तुत नहB कर सके , के सम्बन्ध में और उन >क्तियों जिनकी परिषद् ने ऐसे विस्तार के िलए सिफारिश की है, के सम्बन्ध में प्ररूप जीएसटीटीआरएएन-1 में इलेक्ट्रॉनिक रूप से घोषणा प्रस्तुत करने की तारीख को ऐसी और अविध तक, जो 31 मार्च, 2019 से आगे की नहB होगी, बढ़ा सके गा ।";
(ख) उपिनयम (4) के खंड (ख) के उपखंड (iii) में, निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात् :-
"परंतु उपिनयम (1क) के अनुसार प्ररूप जीएसटी टीआरएएन-1 में घोषणा फाइल करने वाले रजिस्ट्रीकृ त >क्ति 30 अप्रैल, 2019 तक प्ररूप जीएसटी टीआरएन-2 में िववरण प्रस्तुत कर सकें गे ।";
(ii) िनयम 142 के उपिनयम (5) में, "धारा 76 की उपधारा (3)" शब्दों, अंकों और कोष्ठकों के प/ात्, "या धारा 125" शब्द और अंक अंत:स्थापित किए जाएंगे ।

ए. के . सिह, उप-सिचव-VI (वित्त) टिप्पणटिप्पणटिप्पणटिप्पण::::————मूल िनयम दिल्ली के राजपत्र, असाधारण, भाग IV, में सं.फा. 03(10)/वित्त(राज.-1)/2017-18/डीएस-VI/342 तारीख 22 जून, 2017 द्वारा प्रकाशित किए गए थे और अन्तिम बार उन्हें सं.फा. 03(17)/वित्त(राज.-1)/2019- 20/डीएस-VI/398, तारीख 03/09/2019 द्वारा प्रकाशित अिधसूचना सं. 39/2018-राज्य कर, तारीख 03/09/2019 द्वारा संशोधन किया गया था।

Delhi, the 3rd September, 2019
No.48/2018–State Tax
No. F. 3(19)/Fin (Rev-I)/2019-20/ DS-VI/400.—In exercise of the powers conferred by section 164 of the Delhi Goods and Services Tax Act, 2017 (03 of 2017), the Lt. Governor of National Capital Territory of Delhi hereby makes the following rules further to amend the Delhi Goods and Services Tax Rules, 2017, namely:-
1. (1) These rules may be called the Delhi Goods and Services Tax (Ninth Amendment) Rules, 2018.
(2) They shall come into force from 10th September, 2018.
2. In the Delhi Goods and Services Tax Rules, 2017,
(i) in rule 117,
(a) after sub-rule (1), the following sub-rule shall be inserted, namely:-
"(1A) Notwithstanding anything contained in sub-rule (1), the Commissioner may, on the recommendations of the Council, extend the date for submitting the declaration electronically in FORM GST TRAN-1 by a further period not beyond 31st March, 2019, in respect of registered persons who could not submit the said declaration by the due date on account of technical difficulties on the common portal and in respect of whom the Council has made a recommendation for such extension.";
(b) in sub-rule (4), in clause (b), in sub-clause (iii), the following proviso shall be inserted, namely:-
"Provided that the registered persons filing the declaration in FORM GST TRAN-1 in accordance with sub-rule (1A), may submit the statement in FORM GST TRAN-2 by 30th April, 2019.";
[PART IV DELHI GAZETTE : EXTRAORDINARY 3(ii) in rule 142, in sub-rule (5), after the words and figures "of section 76", the words and figures "or section 125" shall be inserted.
