सं़ ़फा ़ 23 (1535)/कैप/टीपीटी/पीसीडी/2019/1559/72803.— जबकि दिल्ली मोटर वाहन नियमावली, 1993 का पुनः संशोधन करने के लिए कतिपय नियमों का प्रारूप राष्ट्रीय राजधानी क्षेत्र, दिल्ली सरकार की दिनांक 24 सितंबर, 2019 की अधिसूचना सं. सं़ ़फा ़ 23(1535)/कैप/टीपीटी/पीसीडी/2019/63573 को दिल्ली राजप़त्र भाग-IV आसाधारण में, प्रकाशित किया गया था, जिसमें प्रभावित व्यक्तियों से उक्त अधिसूचना वाले दिल्ली के राजपत्र की प्रतियां जनसाधारण को उपलब्ध कराने की तिथि से दस दिन की अवधि बीतने से पहले इससे प्रभावित होने वाले सभी व्यक्तियों से आपत्तियां तथा सुझाव मांगे गए थे।
और जबकि उक्त राजपत्र अधिसूचना की प्रतियां जनता को 25 सितंबर, 2019 को उपलब्ध कराई गई थीं;
और जबकि, उक्त नियमों के प्रारूप के सम्बन्ध में जनसाधारण से भी आपत्ति या सुझाव प्राप्त नहीं हुई है ;
अतः अब मोटर वाहन अधिनियम, 1988 (1988 का 59) की धारा 111 की उपधारा (2) के खण्ड (घ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, दिल्ली मोटर वाहन नियमावली, 1993 का पुनः संशोधन करने के लिए हुए, एत्द्वारा निम्नलिखित नियम बनाते है, अर्थात्ः
नियमावली
1. संक्षिप्त शीर्षक एवं प्रारम्भ इन नियमों को दिल्ली मोटर वाहन संशोधन नियमावली, 2019 कहा जाएगा।
ये दिल्ली राजपत्र में अपनी अंतिम प्रकाशन तिथि से प्रभावी होंगे। 2 DELHI GAZETTE : EXTRAORDINARY PART IV] 2. नियम 99 का संशोधन दिल्ली मोटर वाहन नियमावली, 1993 के नियम 99 के उपनियम (1),- (क) खंड (क) के बाद, निम्नलिखित नया खंड जोड़ा जाएगा, अर्थात् :- "(ख) प्रदूषण जांच सुविधा का लाभार्थी प्रदूषण जांच के समय मोटर वाहन के पंजीकृत स्वामी का मोबाइल (सेलफोन) नम्बर प्रदान करेगा तथा प्रदूषण जांच केन्द्र उसे अपने डाटाबेस में सही प्रकार से लेख्यांकित करेगा।"
(ख) मौजूदा खंड (ख) खंड (ग) के रूप में पुनः क्रमांकित किया जाएगा।
यह अधिसूचना परिवहन मंत्री, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के अनुमोदन से जारी की गई है।

NOTIFICATION
Delhi, the 17th October, 2019
F.NO. 23(1535)/ CAP/TPT/PCD/2019/1559/72803.— Whereas the draft rules further to amend the Delhi Motor Vehicles Rules, 1993 were published as required under sub-section (1) of section 212 of the Motor Vehicles Act,1988 (59 of 1988), vide notification F.No. 23(1535)/CAP/TPT/PCD/2019/63573, dated 24.09.2019 in the Delhi Gazette, Extraordinary inviting objections and suggestions from all persons likely to be affected thereby, before expiry of the period of ten days from the date on which copies of the Delhi Gazette containing the said notification were made available to public.
And whereas copies of the said Gazette Notification were made available to the public on 25th September, 2019.
And whereas, no objectionor suggestion has been received from the public in respect of the said draft rules.
Now, therefore, in exercise of the powers conferred by clause (d) of sub-section (2) of section 111 of the Motor Vehicles Act, 1988 (59 of 1988), the following rules further to amend the Delhi Motor Vehicles Rules, 1993 are hereby made, namely: -
RULES 1. Short title and commencement.—(1) These rules may be called the Delhi Motor Vehicles (Amendment) Rules, 2019.
(2) They shall come into force on the date of their publication in the Delhi Gazette.
2. Amendment of rule 99. —In the Delhi Motor Vehicles Rules, 1993, in rule 99, in sub rule (1), —
(a) after clause (a), the following new clause shall be inserted, namely:-
"(b) the person availing the pollution checking facility shall provide the mobile (cell phone)
number of registered owner of the motor vehicle at the time of pollution checking andpollution
checking centre shall record the same correctly in its data base."
(b) existing clause (b), shall be renumbered as clause (c).
This notification is issued with the approval of Minister of Transport, Government of National Capital Territory of Delhi.
