फाफाफाफा.... संसंसंसं.... 149/डडडडब्ल्यूब्ल्यूब्ल्यूब्ल्यू॰एफ॰डी॰॰एफ॰डी॰॰एफ॰डी॰॰एफ॰डी॰////सी॰ओ॰टी॰सी॰ओ॰टी॰सी॰ओ॰टी॰सी॰ओ॰टी॰/2018-19/8993-9001....————दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, जनरल पूल आवासीय कॉलोनी, मोह(cid:19)मदपुर, (cid:22)द(cid:23)ल(cid:24) के पुन(cid:26)व(cid:27)कास हेतु नीचे दिए गए विवरण के अनुसार 2.3 हे(cid:28)टेयर क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधो से छूट प्रदान करती है।

यह छूट निम्नलिखित षर्तों के अधीन है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 1. आवेदक के (cid:31) (cid:24)य लोक !नमा(cid:27)ण (cid:26)वभाग को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 1,21,41,000/- रुपये (एक करोड़ इ(cid:28)क'स लाख इकताल(cid:24)स हजार #पये मा* ) की राशि अग्रिम रूप में जमा करवानी होगी।;

| (ख) | साइट पर लगे *ए 213 देशी वृक्षों का प्रत्यारोपण उपभोगी संस्था द्वारा उपयुत थान पर किया जाएगा। प्रत्यारोपण उपरान्त इन प्रत्यारोपित वृक्षों के रखरखाव की ज़िम्मेदारी भी उपभोगी संस्था की होगी । |
2. देशी प्रजातियों के 2130 पौधों का 100 % प्रतिपूरक वृक्षारोपण के (cid:31) (cid:24)य लोक !नमा(cid:27)ण (cid:26)वभाग उपभोगी संस्था द्वारा किया जायेगा और उनका सात वष6 तक रखरखाव तथा सफलतापूर्वक स्थापना के बाद उपरोक्त 1 (क) & (ख) के अनुसार िनगरानी की जाएगी । 3. 1:10 स्वदेशी प्रजातियों के 6-8 फीट की ऊँ चाई वाले पौधे 213 वृक्षो को प्रत्यारोपण Aकए जाने के बदले मे प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के तीन महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण साइट विशिष्ट वृक्षारोपण तकनीकों के बाद किया जाएगा और उसका रखरखाव उपभोगी संस्था द्वारा अपने स्वयं की लागत पर किया जाएगा ।
4. जिस भूमि पर प्रतिपूरक वृक्षारोपण किया गया है, उसका उपयोग संबंधित वृक्ष अधिकारी की स्वीकृ ति के बिना अन्य प्रयोजन के लिए नहF किया जाएगा।
5. दिल्ली वृक्ष संरक्षण अिधिनयम, 1994 की धारा 12 के अनुपालन में उपभोगी संस्था द्वारा विस्तृत वृक्षारोपण अनुसूची प्रस्तुत की जाएगी। 6. उपभोगी संस्था द्वारा साइट की तैयारी और वृक्षारोपण के लिए एक विस्तृत योजना प्रस्तुत किया जाएगा । 7. (क) अनुमति जारी होने के तुरंत बाद पेड़ों का प्रत्यारोपण शुरू किया जाना चािहए और इसे 3 महीने के अंतराल में पूरा किया जाना चािहए, जिसके बाद एक पूर्ण रिपोर्ट वृक्ष अधिकारी को प्रस्तुत की जानी चाहिए । स्थानांतरित किए जाने वाले वृ2ो की दूरी 4 मीटर (बिंदु से बिंदु) से कम नहF होनी चाहिए । (ख) वृक्षों के प्रत्यारोपण हेतु एक प्रस्तावित नीति दिल्ली सरकार मे िवचाराधीन है, इसलिए भविष्य की अनुमति में नीति के कार्यान्वयन के कारण प्रभावी होने वाले किसी भी बदलाव को संभावित प्रभाव के साथ सक्षम प्राधिकरण की मंजूरी के साथ उस सीमा तक संशोधित किया जाएगा । (ग) 213 वृक्षों को हटाने/ प्रत्यारोपण के िलए अनुमित उनके स्वयं के जोखिम पर दी जाएगी और किसी भी अन्य Rक्ति के दावे के पक्षपात के िबना अनुमित दी जाएगी, जो वृक्षों और भूिम पर सही हो सकती है ।
8. वृक्षों को प्रत्यारोपण किए जाने से पहले सभी वैधानिक प्रावधानों का अनुपालन उपभोगी संस्था द्वारा किया जाएगा । 9. वृक्षों के सम्पूर्ण प्रगति िववरण के साथ संबंधित निरीक्षण अधिकारी के माध्यम से प्रत्यारोपण की प्रगति रिपोर्ट उपभोगी संस्था द्वारा प्रस्तुत की जाएगी ।
10. वृक्षों को प्रत्यारोपण किए जाने के स्थल से पूर्व सभी वृक्षों की परिवहन की अनुमति वृक्ष अधिकारी (पि?चमी) से प्राप्त करनी होगी। 11. वृक्षों को हटाये/प्रत्यारोपण किए जाने के उपरान्त प्राप्त लकड़ी की नीलामी भू-स्वामित्व संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार को राजस्व के रूप में जमा कर दी जाएगी। वृक्षों की ऊपरी शाखांए )लोप्स एंड टॉप्स ( की लकड़ी को काटे जाने के पश्चात प्राप्त लकड़ी मुXत में िनकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाए । इसकी सूचना उप-वन संरक्षक (पि?चमी)/वृक्ष अधिकारी को दी जानी चाहिए ।
12. वृक्षों को हटाये/प्रत्यारोपण किए जाने के स्थल से लकड़ी ले जाने से पूर्व उक्त लकडियों की ढुलाई के लिए वृक्ष अधिकारी (पि?चमी) से ढुलाई अनुमति प्राप्त करनी होगी।

NOTIFICATION
Delhi, the 22nd October, 2019
F. No. 149/WFD/COT/2018-19/8993-9001.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 3.86 ha. as detailed below for redevelopment of General Pool Residential Colony at Mohammadpur, New Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions: —
1. The applicant i.e. Central Public Works Department shall make an advance deposit of an amount of Rs. 1,21,41,000/- (Rupees One Crore Twenty One Lakh Forty One Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

| (a) | 100% Compensatory Plantation of 2130 tree saplings of native species will be carried out on 12-15 meter vide strip alongwith the boundary wall of CPWD land at Ghitorni by the user agency. Total area is having vegetation and suitable for carrying out compensatory plantation is approximately 26695 square meter. | (b) | Transplantation of 213 No. of native species trees which are standing on site shall be done by User Agency at appropriate site. Post transplantation care of the trees shall be ensured by the project proponent. |
2. 100% Compensatory Plantation of 2130 saplings of native species shall be raised and maintained by Central Public Works Department for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.
3. 1:10 plants of native species 6-8 feet height shall be planted as compensatory plantation on non-forest land in lieu of transplantation of 213 no. of trees. The plantation shall be done by site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance shall be carried out there after by User agency with their own funds.
4. The land, over which compensatory plantation is raised, shall not be utilized for other purpose without the approval of Tree Officer concerned.
5. Detailed plantation schedule shall have to be submitted by user agency in compliance with Section 12 of Delhi Preservation of Trees Act, 1994.
6. User agency shall submit a detailed plan for site preparation and plantation.

(a) Transplantation of trees shall be initiated immediately after permission is issued and shall be completed not later than 3 months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point). (b). A draft policy on transplantation of trees is under active consideration by State Government of Delhi. User Agency shall follow all the terms and conditions as approved under policy on transplantation of trees to the extent approved by Competent Authority with prospective effect.
(c) Permission for transplantation of 213 tress would be granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
8. Before the transplantation of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the user agency.
9. Progress report of transplantation shall be submitted through inspection officer concerned along with complete details of trees.
10. Before transplantation from site of removal of trees, permission for transportation of the tree/ all trees shall be obtained from Tree Officer (West).
11. The timber obtained from removal/ transplantation of trees shall be auctioned by the user agency. The proceeds shall be deposited as revenue to the Government account. The Lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to Forest Department. 12. Before shifting of the timber if any, from site of removal/ transplantation of trees, permission for transportation of the said wood shall be obtained from the DCF (West).
