MLO/VIU/Tpt./2017/221/2259.—जबकि केंद्रीय मोटर वाहन नियमों, 1989 के नियम 81 की शक्तियों का, केंद्र सरकार द्वारा की गयी अधिसूचना दिनांक 21/03/2017, सा.का.नि. 271 (अ), खंड 2 (i) के तहत प्रयोग करके दिल्ली मोटर वाहन नियमों, 1993 में आगे संशोधन करने के लिए निम्नलिखित नियमों का मसौंदा बनाना प्रस्तावित किया गया था जो मोटर वाहन अधिनियम, 1988, की धारा 212 की उपधारा (i) के अनुसार प्रभावित व्यक्तियों की जानकारी में लाने के लिए आवश्यक था, अधिसूचना संख्या एम एल ओ/वी आई यू/टी पी टी/2017/221/2245 दिनांक 28/10/2019 को दिल्ली गजट, असाधारण में सभी प्रभावित व्यक्तियों से आपत्तियों और सुझावों को आमंत्रित करने के लिए प्रकाशित किया गया था, इसके अलावा और सूचना दी गई थी कि उक्त मसौदे को उस तारीख से दो दिनों की अवधि समाप्त होने के बाद विचार में लिया जाएगा, जिस दिन दिल्ली के राजपत्र में प्रकाशित इस अधिसूचना की प्रतियां जनता को उपलब्ध कराई गई थीं। और जबकि, 28/10/2019 को उक्त राजपत्र अधिसूचना की प्रतियां जनता को उपलब्ध कराई गर्इं।

और जबकि, उक्त मसौदा नियमों के सम्बन्ध में जनता से प्राप्त आपत्तियां और सुझाव शून्य हैं।

अब, इसलिए, केंद्रीय मोटर वाहन नियमों, 1989 के नियम 81 की शक्तियों का केंद्र, सरकार द्वारा की गयी अधिसूचना दिनांक 21/03/2017, सा.का.नि 271(अ), खंड 2(i) के तहत प्रयोग करके, मोटर वाहन अधिनियम, 1988 की धारा 212 की उपधारा (i) के अनुसार दिल्ली मोटर वाहन नियमों, 1993 में आगे संशोधन करके निम्नलिखित नियम बनाए गए हैं, अर्थात्‌,

1. लघु शीर्षक और कमिशन (1) इन नियमों को दिल्ली मोटर वाहन (चतुर्थ संशोधन),

नियम, 2019, कहा जाएगा।

2. नियम में संशोधन 59 (क) दिल्ली मोटर वाहन नियम, 1993, के नियम 59 में, स्थानीय

टैक्सी के परमिट के निर्गमन एवं नवीनीकरण के मुद्‌दे

पर तालिका के मद (ख) के खिलाफ, आंकड़ा और शब्दों के लिए 1500/- (एक हजार पांच सौ रूपए), आंकडा और शब्द रू0 500/- (पांच सौ रूपए) प्रतिस्थापित किए जाएंगे।

(ख) दिल्ली मोटर वाहन नियम, 1993, के नियम 59 में, मद (ग)

अर्थात्‌ DL-1Z और DL-1RX टैक्सी की जगह, और "अन्य टैक्सी" शब्द प्रतिस्थापित किए जाएंगे।

आगे, परमिट के निर्गमन एवं नवीनीकरण या प्रतिहस्ताक्षरित के मुद्‌दे पर तालिका के मद (ग) के खिलाफ, अन्य सभी टैक्सी के लिए आंकड़ा और शब्दों के लिए 2000/- (दो हजार रूपए), आंकडा और शब्द रू0 500/- (पांच सौ रूपए) प्रविष्टि किए जाएंगे।

3. नए नियम 59 (बी) का प्रविष्टि नियम 59 (ए) के बाद, उक्त नियमों में, निम्नलिखित को

डाला जाएगाः-

नियम 59 (बी) फिटनेस, पंजीकरण, स्वामित्व के हस्तांतरण, जुर्माना और हल्के मोटर वाहन (टैक्सी) के लिए किराया खरीद जोड़ (HP) के संबंध में भुगतान की जाने वाली फीस निम्नानुसार होगीः-

उपरोक्त के रूप में संशोधित शुल्क संरचना केवल व्यक्तिगत नाम पर पंजीकृत टैक्सियों के संबंध में लागू होगी। यह अधिसूचना दिल्ली सरकार के मंत्री (परिवहन) की स्वीकृति से जारी की जाती है।

No. MLO/VIU//Tpt./2017/221/2259.—Whereas the draft rules further to amend Delhi Motor Vehicles Rules,1993, were published as required in exercise of powers given under rule 81 of the Central Motor Vehicle Rules, 1989 by Central Government vide notification dated 21.03.2017, G.S.R 271(E), clause 2(i), and sub-section (1) of section 212 of the Motor Vehicles Act, 1988, vide notification No. MLO/VIU//Tpt./2017/221/2245 dated the 28th October, 2019 in the Delhi Gazette, Extraordinary, inviting objections and suggestions from all persons likely to be affected thereby, before expiry of the period of two days from the date on which copies of the Delhi Gazette containing the said notification were made available to public.

And whereas, copies of the said Gazette notification were made available to the public on the 28th October, 2019,

And whereas, the objections and suggestions received from the public in respect of the said draft rules are nil,

Now, therefore, in exercise of the powers under rule 81 of the Central Motor Vehicle Rules, 1989 conferred by Central Government vide notification dated 21.03.2017, G.S.R 271(E), clause 2(i), and sub-section (1) of section 212 of the Motor Vehicles Act, 1988, the following rules are made to amend the Delhi Motor Vehicles Rules, 1993, namely,

Rules

1. Short Title and Commencement (1) These rules may be called the Delhi Motor Vehicles

(Fourth Amendment) Rules, 2019.

(2) They shall come into force w.e.f. 01/11/2019.

2. Amendment in Rule 59 (a)

In the Delhi Motor Vehicles Rules, 1993, in rule 59, against the item (b) in the table regarding issue of renewal of permit of a local taxi, for figure and words Rs.1500/- (rupees one thousand five hundred), the figure and words Rs.500/- (rupees five hundred) shall be substituted.

(b)

In the Delhi Motor Vehicles Rules, 1993, in rule 59, the words in item(c) namely DL-1Z and DL-1RX Taxi, may be substituted with words namely "all other taxies".

Further, against the item (c) in the table regarding issue of renewal or countersignature of permit, after the figure and words Rs.2000/- (rupees two thousand), the figure and words Rs.500/- (rupees five hundred) for all other taxies shall be inserted.

3. Insertion of new rule 59 (B) In the said rules, after rule 59 (A), the following shall be

inserted, namely :-

Rule 59 (B). fees to be paid in respect of fitness, registration, transfer of ownership, penalty and hire purchase addition for LMV(taxis) shall be as under:-

Revised fee structure, as above, shall be applicable only in respect of taxis registered in the names of individual (s).
