सं. फा. 1(255)/स्था0/पर्या./2018-19/4440-4448.—गृह मंत्रालय, भारत सरकार की दिनांक 24 सितम्बर, 1968 की अधिसूचना स.फा. 24/78/68-डीएच(एस) के साथ पठित संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए तथा इस सरकार की दिनांक 07 मई, 1992 की अधिसूचना सं. 56(211)/87/डीईवी.मुख्य. /खंड-II/3516-24 के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व की गई या हटाए जाने के लिए की जाने वाली बातों को छोड़कर, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उप राज्यपाल, संघ लोक सेवा आयोग से परामर्श के पश्चात् पर्यावरण विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में 'विधि अधिकारी' के पद हेतु निम्नलिखित भर्ती नियम बनाते हैंः—
1. संक्षिप्त शीर्षक तथा प्रारंभ :- (i) इन नियमों को विधि अधिकारी भर्ती नियमावली, 2019 कहा जाये।
(ii) ये दिल्ली राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।
2. पदों की संख्या, वर्गीकरण एवं वेतन मैट्रिक्स में स्तर :- उक्त पदों की संख्या, इसका वर्गीकरण तथा उसके साथ संलग्न वेतन मैट्रिक्स में स्तर इन नियमों के साथ संलग्न अनुसूची के कॉलम 2 से 4 में यथाविनिर्दिष्ट होंगे। 3. भर्ती पद्धति, आयु सीमा, योग्यता इत्यादि ः- उक्त पद की भर्ती पद्धति, आयु सीमा, योग्यता तथा उससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम 5 से 13 में यथाविनिर्दिष्ट होंगे।
4. अयोग्यता :- कोई भी व्यक्ति,
(क) जिसने किसी ऐसे व्यक्ति से विवाह किया है जिसका जीवित पति/पत्नी है; या
(ख) जिसने जीवित पत्नी/पति के रहते हुए किसी अन्य व्यक्ति के साथ विवाह किया है, वह उक्त पद पर नियुक्ति के लिये अयोग्य होगा :
5842 DG/ 2019 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] उपबंध है कि सरकार यदि इस बात से संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति या अन्य पार्टी पर लागू व्यक्तिगत कानून के अन्तर्गत अनुमति योग्य है तथा ऐसा करने के अन्य आधार हैं तब किसी व्यक्ति को इस नियम के प्रचालन से छूट प्रदान की जा सकती है।
5. छूट प्रदान करने की शक्ति :- जहां सरकार का मत है कि ऐसा करना आवश्यक या समीचीन है तो वह आदेश द्वारा तथा कारणों को लिखित में अभिलेखबद्ध करते हुए एवं संघ लोक सेवा आयोग की पूर्व परामर्श से व्यक्तियों के किसी वर्ग या श्रेणी के संबंध्ां में इन नियमों के किन्हीं उपबंधों से छूट प्रदान कर सकती है।
6. बचाव :- इन नियमों में कोई भी बात इस संबंध में सरकार द्वारा समय-समय पर जारी आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिक तथा अन्य विशेष व्यक्तियों के वर्गों के लिये अपेक्षित आरक्षण, आयु सीमा में छूट एवं अन्य रियायतों को प्रभावित नहीं करेगी।

(1) मूल संवर्ग/विभाग में नियमित आधार पर समरूप पदधारण करने वाले; अथवा (2) म ल ू स वर्ग/विभाग ं म ं े स्तर - 9 (53,100- 1,67,800/-रूपये)/स्तर -10 (56,100 - 1,77,500/-रूपये ) या समकक्ष पदों पर नियमित आधार पर नियुक्ति के उपरांत ग्रेेड में पांच वर्ष की सेवा सहित एवं (ख) निम्नलिखित शैक्षणिक योग्यता एवं अनुभव रखने वालेः— अनिवार्य : (i) मान्यता प्राप्त विश्वविद्यालय/संस्थान से विधि उपाधि ; तथा (ii) विधि मामलों में पांच वर्ष का अनुभव वांछनीय : पर्यावरणीय विधिक मामलों से निपटने का अनुभव । |

NOTIFICATION
Delhi, the 6th September, 2019
No. F. 1(255)/ Estt./Env./2018-19/4440-4448.—In exercise of the powers conferred by proviso to article 309 of the Constitution of India, read with the Government of India, Ministry of Home Affairs, Notification No.F. 24/78/68-DH (S), dated the 24th September, 1968, and in supersession of this Government's Notification No.F. 56(211)/87/Dev.HQ/ Vol.II/3516-24 dated 7th May' 1992 except as respects things done or omitted to be done before such supersession, the Lt. Governor of the National Capital Territory of Delhi, after consultation with the Union Public Service Commission, is pleased to make the following rules for the post of 'Legal Officer' in the Department of Environment, Government of National Capital Territory of Delhi, namely: —
1. Short title and commencement:- (i) These rules may be called the Legal Officer Recruitment Rules, 2019.
(ii) They shall come into force on the date of their publication in the Delhi Gazette.
2. Number of posts, classification and level in the pay matrix:- The number of said post, its classification and level in the pay matrix shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualifications, etc:- The method of recruitment to the said post, age-limit, qualification and other matters relating thereto, shall be as specified in columns 5 to 13 of the said Schedule.
4. Disqualifications:-No person,
(a) Who has entered into or contracted a marriage with a person having a spouse living, or (b) Who having a spouse living, has entered into or contracted a marriage with any person;
shall be eligible for appointment to the said post:
Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax:- Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing and in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of person. 6. Saving:- Nothing in these rules shall effect reservations, relaxation of age-limit and other concessions, required to be provided for the Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-servicemen or any other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.

Note: The period of deputation (ISTC) including the period of deputation (ISTC) in another Ex-Cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Government shall ordinarily not exceed four years. The maximum age limit for appointment by deputation shall not exceed 56 years as on the closing date of receipt of applications. |
