la-,Q-12¼143½////2019@Hkw-o-Hk-@;ks-////jsjk U;k;kf/kdj.k 9648....————जबकि गृह मंत्रालय, भारत सरकार की अधिसूचना संख्या एस.ओ. 1395 (ई) दिनांक 02 मई, 2017 के द्वारा निर्देश दिया कि रियल एस्टेट (विनियमन और विकास) अधिनियम, 2016 (2016 का 16) के अन्तर्गत उपयुक्त सरकार की शक्तियां राष्ट्रपति के नियंत्रण के अधीन होंगी और अगले आदेशों तक, राष्ट्रीय राजधानी क्षेत्र दिल्ली के संबंध में, उपराज्यपाल इन शक्तियों का प्रयोग करेंगें ।
और जबकि गृह मंत्रालय, भारत सरकार की अधिसूचना संख्या एस.ओ. 1395 (ई) दिनांक 02 मई, 2017 के साथ पठित रियल एस्टेट (विनियमन एवं विकास) अधिनियम, 2016 (2016 का 16) की धारा (43) के उपधारा (4) के प्रथम परन्तुक के अंतर्गत राष्ट्रीय राजधानी क्षेत्र दिल्ली के संबंध में माननीय उपराज्यपाल, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार द्वारा उपयुक्त सरकार होने के नाते अधिसूचना संख्या एफ12 (143)/2017/भू- एवं भव-/पीएलजी/पार्ट-1/4176 दिनांक 28/07/2017 के माध्यम से मूल्य संवर्धित कर न्यायाधिकरण, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार को राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के अपीलीय न्यायाधिकरण के रूप में नामित किया है।
और जब कि रियल एस्टेट (विनियमन एवं विकास) अधिनियम, 2016 (2016 का 16) की धारा (46) के उपधारा (2) के प्रावधानों के अनुसार माननीय मुख्य न्यायाधीश, दिल्ली उच्च न्यायालय ने रियल एस्टेट अपीलीय न्यायाधिकरण राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार एवं संघ क्षेत्र चंडीगढ के अध्यक्ष के रूप में नियुक्ति हेतु श्रीमान न्यायाधीश, चन्द्र शेखर के नाम की अनुशंसा की है। 2 DELHI GAZETTE : EXTRAORDINARY PART IV] भव-/पीएलजी/पार्ट 1/4176 दिनांक 28 जुलाई, 2017 के अधिक्रमण में दिल्ली के उपराज्यपाल एतद्द्वारा राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार एवं संघ क्षेत्र चंडीगढ के लिए रियल एस्टेट अपीलीय न्यायाधिकरण के अध्यक्ष के रूप में श्रीमान न्यायाधीश, चन्द्र शेखर को नियुक्त करते हैं। रियल एस्टेट अपीलीय न्यायाधिकरण के अध्यक्ष का कार्यकाल पांच वर्ष अथवा सडसठ वर्ष की आयु पूर्ण करने तक, उनके कार्यालय में प्रवेश करने की तिथि से, इसमें जो भी पहले हो, तथा पुन: नियुक्ति हेतु पात्र नहीं होगा।
नियुक्ति की सेवा के नियमों और शर्तों को अलग से अधिूसचित किया जाएगा।

NOTIFICATION
Delhi, the 13th December, 2019
No. F. 12(143)/2019/L&B/Plg./RERA TRIBUNAL/9648.—Whereas the Ministry of Home Affairs, Government of India, vide Notification S.O. No. 1395 (E) dated 2nd May, 2017 directed that powers of the appropriate Government under the Real Estate (Regulation and Development) Act, 2016 (16 of 2016) shall subject to the control of President and until further orders, be exercised, in relation to the National Capital Territory of Delhi, by the Lieutenant Governor thereof;
And whereas the Hon'ble Lieutenant Governor, National Capital Territory of Delhi vide notification No. F. 12(143)/2017/L&B/PLG/Pt. I/4176 dated 28th July, 2017 being the appropriate Government designated Value Added Tax Tribunal of Government of National Capital of Delhi as the Appellate Tribunal in relation to National Capital Territory of Delhi under first proviso to sub-section (4) of section 43 of the Real Estate (Regulation and Development) Act, 2016 (16 of 2016) read with Government of India, Ministry of Home Affairs, notification number S.O. 1395 (E) dated the 2nd May, 2017.
And whereasas per provisions of sub-section (2) of section (46) of the Real Estate (Regulation and Development) Act, 2016 (16 of 2016), the Hon'ble Chief Justice of High Court of Delhi has recommended the name of Mr. Justice ChanderShekharfor appointment as Chairpersonof the Real Estate Appellate Tribunal for the Nation Capital Territory of Delhi and Union Territory of Chandigarh.
Now, therefore, in exercise of powers under sub-section (4) of section 43 and sub-section (2) of section 46 of the Real Estate (Regulation and Development) Act, 2016 (16 of 2016) read with Government of India S.O. No. 1395 (E) dated the 2nd May, 2017, and in supersession of notification No. F.12(143)/2017/L&B/PLG/Pt. I/4176 dated 28th July, 2017 issued by Govt. of NCT of Delhi, the Lt. Governor of Delhi is pleased to appoint Mr. Justice Chander Shekharas Chairperson of the Real Estate Appellate Tribunal for the National Capital Territory of Delhi and Union Territory of Chandigarh.
The tenure of the office of the Chairperson of the Real Estate Appellate Tribunal shall be five years or till attaining the age of sixty-seven years, whichever is earlier from the date he enters upon his office and shall not be eligible for re-appointment.
The terms and conditions of service of appointment will be notified separately.
