Qk- la- 1379@Vh-vks-¼,l½@Vh-lh-@Qsfyax@18&19@11140&48....————दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, तेहखंड ओखला औद्योगिक क्षेत्र फेज-1 नई दिल्ली में प्रस्तावित सेनेटरी लैंड फिल के निार्मण हेतु नीचे दिए गए विवरण के अनुसार 10.49 हेक्टेयर लगभग क्षेत्रफल को उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधों से छूट प्रदान करती है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] यह छूट निम्नलिखित शर्तों के अधीन है:-
1. आवेदक दक्षिणी दिल्ली नगर िनगम को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 4,19,52,000/-रुपये (चार करोड़ उन्नीस लाख बावन हजार रूपये मात्र) की राषि अग्रिम रूप में जमा करवानी होगी।

| (ख) | उपभोगी संस्था द्वारा परियोजना स्थल से 660 वृक्षों का प्रत्यारोपण ओखला तेहखंड Cीन बेल्ट मे उपलब्ध 1.62 हेक्टेअर भूिम पर किया जाएगा । |
2. उपरोक्त 1 (क) और (ख) के अनुसार, देशी प्रजातियों के 7360 पौधो का 100 % प्रतिपूरक वृक्षारोपण और उनका सात वषH तक रखरखाव दक्षिणी दिल्ली नगर निगम द्वारा किया जायेगा । इस वृक्षारोपण के सफलतापूर्वक स्थापना के बाद दक्षिणी दिल्ली नगर निगम द्वारा िनगरानी की जाएगी ।
3. 736 वृक्षों को काटे जाने के बदले मे 1:10 के अनुपात मे स्वदेशी प्रजातियों के 6-8 फीट की ऊँ चाई वाले 7360 पौधों का प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के छ: महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण स्थल के अनुसार विशिष्ट वृक्षारोपण तकनीकों के द्वारा किया जाएगा और उपभोगी संस्था द्वारा रखरखाव किया जाएगा ।
4. उपभोगी संस्था द्वारा प्रतिपूरक वृक्षारोपण/प्रत्यारोपण स्थल में मृदा नमी संरक्षण कार्य की गतिविधियों को किया जाएगा । 5. उपभोगी संस्था के द्वारा यह सुनिOित किया जायेगा कि इस प्रस्ताव की योजना को परिवQतत नहR किया जाएगा । 6. उपभोगी संस्था द्वारा प्रतिपूरक वृक्षारोपण स्थल को अति:मण और अनावश्यक बायोटिक हस्तक्षेप से सुरक्षित किया जाएगा ।
7. उपभोगी संस्था द्वारा जहां कहR भी आवश्यक हो, मृदा तैयार करने के लिए Uापक हस्तक्षेप के आवश्यकता अनुसार अतिरिक्त बजट किया जाएगा ।
8. जो भूमि प्रतिपूरक वृक्षारोपण के लिया आवंटित है, उसका उपयोग किसी अन्य कायH के िलए संबंधित वृक्ष अधिकारी की स्वीकृ ति के बिना नहR किया जाएगा।
9. अनुमित जारी होने के तुरंत बाद वृक्षों का प्रत्यारोपण शुरू किया जाएगा और इसे 6 महीने के अंतराल में पूर्ण किया जाएगा । प्रत्यारोपण प्र:िया के पूर्ण होने का बाद एक सम्पूर्ण रिपोर्ट संबन्धित वृक्ष अधिकारी को प्रस्तुत की जायेगी । प्रत्यारोपण स्थल मे प्रत्यारोपित वृक्षों की दूरी 4 मीटर (बिदु से बिदु) से कम नहR होनी चाहिए ।
10. वृक्षों को काटने/प्रत्यारोपण के िलए अनुमित उनके स्वयं के जोखिम पर और किसी भी अन्य Uक्ति के दावे के पक्षपात के िबना, जो वृक्षो और भूिम पर सही हो सकती है, दी जा रही है ।
11. उपभोगी संस्था द्वारा वृक्षों को काटने/प्रत्यारोपण का कार्य सभी वैधािनक मंजूरियों को लेने के बाद ही शुरू किया जाएगा । 12. वृक्षों की प्रत्यारोपण की प्रगति रिपोर्ट संबंधित निरीक्षण अधिकारी के माध्यम से उपभोगी संस्था द्वारा वृक्ष अधिकारी को प्रस्तुत की जाएगी ।
13. वृक्षों को काटने के उपरान्त प्राप्त लकड़ियों की नीलामी उपभोगी संस्था द्वारा की जाएगी और उससे प्राप्त धनरािश को सरकार के खाते मे राजस्व के रूप में जमा की जाएगी । वृक्षों के ऊपरी शाखाओं को काटे जाने के पश्चात प्राप्त लकड़ियों को मु]त में िनकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाएगी ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 14. वृक्षों को काटने के स्थल से लकड़ियों को ले जाने से पूर्व वृक्ष अधिकारी (दक्षिण) से ढुलाई अनुमति प्राप्त करनी होगी । 15. उपभोगी संस्था के द्वारा पर्यावरण मंजूरी में उल्लिखित सभी शतH का पालन किया जायेगा ।

Delhi, the 3rd January, 2020
F. No. 1379/TO(S)/TC-Felling/18-19/11140-48.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 10.49 ha. approx as detailed below for construction of proposed sanitary land fill at Tehkhand Okhla Industrial Area Phase-I, New Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. The applicant i.e South Delhi Municipal Corporation shall make an advance deposit of an amount of Rs. 4,19,52,000 /- (Four Crore Nineteen Lakhs and Fifty Two Thousand only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

| (b) | Transplantation of 660 no. of trees which are standing on project site shall be done by user agency at Okhla Tehkhand Green Belt in 1.62 Ha. |
2. 100% Compensatory Plantation of 7360 saplings of native species shall be raised and maintained by South Delhi Municipal Corporation for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.
3. Plants of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of removal/ transplantation of 736 no. of trees. The plantation shall be done following site specific plantation techniques with additional measures on identified land within six months of issue of tree removal permission and maintenance shall be carried out there after by User Agency.
4. The User agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site.
5. The User agency shall ensure that the plan of this proposal shall not be changed.
6. Compensatory Plantation site shall have to be secured from encroachment and undesired biotic interference.
7. Extensive interventions if any required to be undertaken for soil preparation, shall be carried out and additional budget if needed, shall be provided by User Agency.
8. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval of Tree Officer concerned.
9. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than six months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees should not be less than 4 meter (point to point) at transplantation site.
10. Permission for felling/ transplantation of all tress shall be granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
11. Before the felling/ transplantation of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the user agency.
12. Progress report of transplantation shall be submitted to Tree Officer through inspection officer concerned alongwith complete details of trees.
13. The timber obtained from removal of trees shall be auctioned by the user agency. The proceeds shall be deposited as revenue to the Government account. The lops and tops of trees shall be sent/supplied to nearest crematorium free of cost and the same should be reported to Forest Department. 14. Before shifting of timber if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from DCF (South).
15. It should be ensured by the user agency that all the conditions mentioned in environmental clearance if any obtained, shall be followed scrupulously.
