एन॰एफ॰डी॰ टी॰ ॰ 2019-20 12297-12305.—दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, कोंडली फेस-1 (45.5 एम.एल.डी.), फेस-2 (113.7 एम.एल.डीय.) एवं फेस-3 (45.5 एम.एल.डी.), बी॰ओ॰डी-(10 एम॰जी॰)/1, टी॰एस॰एस॰-(10 एम॰जी॰)/1 बेहतर मानकों के साथ या वाई॰ए॰पी॰-III पैके ज –के ॰-3 के पुनर्वास एवं उन्नयल हेतु नीचे दिए गए विवरण के अनुसार 11.34 हेक्टेयर क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधाें से छूट प्रदान करती है।

यह छूट निम्नलिखित शर्तो के अधीन है:-

1. दिल्ली जल बोर्ड जो कि उपभोगी संस्था के रूप में संदभित है, को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 2,80,44,000 /- रुपये (दो करोड़ अस्सी लाख चवालीस हजार मात्र) की राशि अग्रिम रूप में जमा करवानी होगी।

	उपभोगी संस्था द्वारा परियोजना स्थल से 181 वृक्षों का प्रत्यारोपण दिल्ली जल बोर्ड स्टाफ क्वार्टरए कोंडली क े परिसर में उपलब्ध भूमि पर किया जाएगा ।

2. उपरोक्त 1 (क) और (ख) के अनुसार, देशी प्रजातियों के 4920 पौधों का 100 % प्रतिपूरक वृक्षारोपण और उनका सात वर्षों तक रखरखाव दिल्ली जल बोर्ड द्वारा किया जायेगा। इस वृक्षारोपण के सफलतापूर्वक स्थापना के बाद दिल्ली जल बोर्ड द्वारा निगरानी की जाएगी ।

3. उपभोगी संस्था द्वारा साइट के जीपीएस को-ऑडिनेट को इंगित करते हुए नए सिरे से ड्राइंग प्रस्तुत किया जाएगा, जहां वृक्षों का प्रत्यारोपण और प्रतिपूरक वृक्षारोपण किया जाना प्रस्तावित है ।

4. 492 वृक्षों को काटे/ प्रत्यारोपण जाने के बदले मे 1:10 के अनुपात में स्वदेशी प्रजातियों के 6-8 फीट की ऊँ चाई वाले 4920 पौधों का प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के तीन महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण स्थल के अनुसार विशिष्ट वृक्षारोपण तकनीकों के द्वारा किया जाएगा और उपभोगी संस्था द्वारा रखरखाव किया जाएगा ।

5. उपभोगी संस्था द्वारा अतिरिक्त साइट सुधार खर्चों को जमा किया जाएगा जो कि वृक्ष अधिकारी द्वारा गणना के अनुसार वृक्षारोपण के लिए उपयुक्त बनाने के लिए आवश्यक हो सकता है ।

6. उपभोगी संस्था द्वारा प्रतिपूरक वृक्षारोपण/ प्रत्यारोपण स्थल में मृदा नमी संरक्षण कार्य की गतिविधियों को किया जाएगा । 7. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जायेगा कि इस प्रस्ताव की योजना को परिवतित नहीं किया जाएगा । 8. उपभोगी संस्था द्वारा प्रतिपूरक वृक्षारोपण स्थल को अतिक्रमण और अनावश्यक बायोटिक हस्तक्षेप से सुरक्षित किया जाएगा ।3 DELHI GAZETTE : EXTRAORDINARY PART IV] 9. उपभोगी संस्था द्वारा जहां कहीं भी आवश्यक हो, मृदा तैयार करने के लिए व्यापक हस्तक्षेप के आवश्यकता अनुसार अतिरिक्त बजट दिया जाएगा ।

10. जो भूमि प्रतिपूरक वृक्षारोपण के लिया आवंटित है, उसका उपयोग किसी अन्य कार्यो के लिए राज्य सरकार की स्वीकृ ति के बिना नहीं किया जाएगा।

11. अनुमति जारी होने के तुरंत बाद वृक्षों का प्रत्यारोपण शुरू किया जाएगा और इसे 3 महीने के अंतराल में पूर्ण किया जाएगा । प्रत्यारोपण प्रक्रिया के पूर्ण होने का बाद एक सम्पूर्ण रिपोर्ट संबन्धित वृक्ष अधिकारी को प्रस्तुत की जायेगी । प्रत्यारोपण स्थल में प्रत्यारोपित वृक्षों की दूरी 4 मीटर (बिदु से बिदु) से कम नहीं होनी चाहिए ।

12. वृक्षों को काटने/ प्रत्यारोपण के लिए अनुमति उनके स्वयं के जोखिम पर और किसी भी अन्य व्यक्ति के दावे के पक्षपात के बिना, जो वृक्षों और भूमि पर सही हो सकती है, दी जा रही है ।

13. उपभोगी संस्था द्वारा वृक्षों को काटने/ प्रत्यारोपण का कार्य सभी वैधानिक मंजूरियों को लेने के बाद ही शुरू किया जाएगा । 14. दिल्ली जल बोर्ड द्वारा 492 वृक्षों के अलावा किसी भी वृक्ष की कटाई / प्रत्यारोपण एक अपराध होगा ।

15. दिल्ली वृक्ष संरक्षण अधिनियम, 1994 के प्रावधानों के अनुसार प्रतिपूरक वृक्षारोपण के बारे में प्रलेखन का समापन उपभोगी संस्था द्वारा किया जाएगा।

16. उपभोगी संस्था द्वारा वृक्षों की प्रत्यारोपण की प्रगति रिपोर्ट संबंधित निरीक्षण अधिकारी के माध्यम से वृक्ष अधिकारी को प्रस्तुत की जाएगी ।

17. उपभोगी संस्था द्वारा वृक्षों को काटने के उपरान्त प्राप्त लकड़ियों की नीलामी की जाएगी और उससे प्राप्त धनराशि को सरकार के खाते मे राजस्व के रूप में जमा की जाएगी।

18. उपभोगी संस्था द्वारा वृक्षों के ऊपरी शाखाओं को काटे जाने के पश्चात प्राप्त लकड़ियों को मुफ्त में निकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौंपी जाएगी ।

19. उपभोगी संस्था द्वारा वृक्षों को काटने के स्थल से लकड़ियों को ले जाने से पूर्व वृक्ष अधिकारी (उत्तर) से ढुलाई अनुमति प्राप्त करनी होगी।

20. उपभोगी संस्था के द्वारा पर्यावरण मंजूरी में उल्लिखित सभी शर्तों का पालन किया जायेगा ।

NOTIFICATION

Delhi, the 19th February, 2020

F.No. 28/NFD/TC/Felling/2019-20/12297-12305.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 11.34 ha. as detailed below for rehabilitation and Up-gradation of Kondli Phase I (45.5 MLD), Phase II (11.37 MLD) and Phase III (45.5 MLD) with effluent standards of BOD-10 mg/1, TSS-10mg/1 or better under YAP-III Package K3, Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-

1. Delhi Jal Board, herein referred to as User Agency, shall make an advance deposit of an amount of Rs. 2,80,44,000/- (Rupees Two Crore Eighty Lakh Forty Four Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

(a)	100% Compensatory Plantation ten times the number of trees permitted for felling/ transplant of 492 trees i.e 4920 number of tree saplings proposed to be of species Neem, Amaltas, Peepal, Pilkhan, Gular, Bargad, Desi Kikkar and Arjun along with other native species shall be carried out by User Agency on land available at Bawana WTP, Okhla STP and in the premises of Delhi Jal Board Staff Quarters, Kondli, utilizing the security deposit amount..	4920	2,80,44,000/-	Deputy Conservator of Forests (North)/ Tree Officer
(b)	Transplantation of 181 No. of trees which are standing on site shall be done by User Agency in the premises of Delhi Jal Board Staff Quarter, Kondli Delhi.

2. 100% Compensatory Plantation of 4920 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.

3. The User Agency shall submit fresh drawing indicating the GPS Co-ordinates of site where trees shall be transplanted and compensatory plantation is proposed to be carried out.

4. Plants of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of removal/ transplantation of 492 No. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance shall be carried out there after by North Forest Division utilizing the deposits made by User Agency.

5. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer concerned (as deposits).

6. The User agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site Division utilizing the deposits made by user agency.

7. The User Agency shall ensure that the plan of this proposal shall not be changed.

8. Compensatory Plantation site shall have to be secured from encroachment and undesired biotic interference by User Agency.

9. Extensive interventions if any required to be undertaken for soil preparation, shall be carried out and additional budget if needed, shall be provided by User Agency.

10. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval of State Government.

11. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than three months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.

12. Permission for felling/transplantation of all tress is being granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.

13. Before the felling/transplantation of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency.

14. Felling/transplantation of any trees apart from 492 trees by User Agency shall constitute an offence.

15. Completion of documentation regarding compensatory plantation as per provisions of DPTA, 1994 shall be done by User Agency.

16. Progress report of transplantation shall be submitted to Tree Officer by User Agency through inspection officer concerned along with complete details of trees.

17. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency.

18. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to DCF (North) by User Agency.

19. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (North) by User Agency.

20. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, if any obtained, shall be followed scrupulously.
