फा. सं. 226/नियम/डी.एच.सी.—सूचना का अधिकार अधिनियम, 2005 की धारा 28 की उपधारा (1) सह- पठित धारा 2 (ङ)(iii) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, दिल्ली उच्च न्यायालय के माननीय मुख्य न्यायाधीश एतद्द्वारा दिल्ली उच्च न्यायालय (सूचना का अधिकार) नियम, 2006, जो कि अधिसूचना संख्या 180/नियम/डी.एच.सी.
दिनांक 11.08.2006 द्वारा दिल्ली राजपत्र असाधारण, भाग-IV सं. 131 (रा.रा.क्षे.दि. सं. 109) दिनांक 11.08.2006 में अधिसूचित, अधिसूचना संख्या 117/नियम/डी.एच.सी. दिनांक 08.05.2007 द्वारा संशोधित व दिल्ली राजपत्र असाधारण, भाग-IV सं. 80 (रा.रा.क्षे.दि. सं. 30) में दिनांक 08.05.2007 को प्रकाशित, तत्पश्चात अधिसूचना संख्या 225/नियम/डी.एच.सी. दिनांक 29.10.2007 द्वारा संशोधित व दिल्ली राजपत्र असाधारण, भाग-IV संख्या 185 (रा.रा.क्षे.दि. सं. 206) दिनांक 29.10.2007 में प्रकाशित व शुद्धिपत्र सं. 117/नियम/डी.एच.सी. दिनांक 31.01.2008 द्वारा संशोधित व दिल्ली राजपत्र असाधारण, भाग-IV सं. 19 (रा.रा.क्षे.दि. सं. 301) में दिनांक 31.01.2008 को प्रकाशित, तत्पश्चात अधिसूचना संख्या 46/नियम/डी.एच.सी. दिनांक 22.01.2009 द्वारा संशोधित व दिल्ली राजपत्र असाधारण, भाग-IV संख्या 12 (रा.रा.क्षे.दि. सं. 303) में दिनांक 22.01.2009 को प्रकाशित, तत्पश्चात अधिसूचना संख्या 178/नियम/डी.एच.सी. दिनांक 13.05.2010 द्वारा संशोधित व दिल्ली राजपत्र असाधारण, भाग-IV संख्या 77 (रा.रा.क्षे.दि. सं. 41) में दिनांक 13.05.2010 को प्रकाशित, तत्पश्चात अधिसूचना संख्या 456/नियम/ डी.एच.सी.

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] दिनांक 11.09.2014 द्वारा संशोधित व दिल्ली राजपत्र असाधारण, भाग-IV संख्या 118 (रा.रा.क्षे.दि. सं. 96) में दिनांक 11.09.2014 को प्रकाशित तथा तत्पश्चात अधिसूचना संख्या 81/नियम/डी.एच.सी. दिनांक 16.02.2016 द्वारा संशोधित व दिल्ली राजपत्र असाधारण, भाग-IV संख्या 27 (रा.रा.क्षे.दि. सं. 208) में दिनांक 16.02.2016 को प्रकाशित हुए, में निम्नलिखित संशोधन करते हैं:
संशोधन
I. नियम 3(क) से पूर्व दर्शाया गया स्पष्टीकरण नियम 3 के अंत में पढ़ा जाएगा |
II. वतर्मान नियम 3(क) में, शब्दों "महानिबंधक, दिल्ली उच्च न्यायालय के पक्ष में, नकद, भारतीय पोस्टल आर्डर, डिमांड ड्राफ्ट, पे ऑर्डर द्वारा" को शब्द "आवेदन शुल्क" के बाद व शब्द "नियम 10 के अनुसार प्राधिकृ त व्यक्ति को" से पूर्व जोड़ा जाएगा |
III. वतर्मान नियम 3(क) के तुरंत बाद, निम्नलिखित परंतुक को निम्नानुसार जोड़ा जाएगा :-
"बशर्ते कि कोई आवेदन के वल इस आधार पर ख़ारिज नहीं किया जाएगा कि वह प्रारूप 'क' में नहीं है ।" IV. नियम 4 का उप नियम (i) हटाया जाता है |
V. नियम 5 के उप नियम (ख) तथा (ग) को हटाया जाता है |
VI. वतर्मान नियम 6 के स्थान पर निम्न को प्रतिस्थापित किया जाता है :-
"6. प्रदान की जाने वाली सूचना तथा अभिलेख तक पहुँच, अभिलेखों के नष्टीकरण से सम्बंधित समय-समय पर लागू होने वाले नियमों/निर्देशों के अध्यधीन होगी जिन्हें इस न्यायालय द्वारा अधिसूचित अथवा लागू किया जा चुका हो |"
VII. नियमों के साथ दिए गए वतर्मान प्रारूप 'क' के स्थान पर निम्न को प्रतिस्थापित किया जाएगा :-

No. 226/Rules/DHC.—In exercise of the powers conferred by sub-section (1) of Section 28 read with Section 2 (e) (iii) of the Right to Information Act, 2005, Hon'ble the Chief Justice of the High Court of Delhi hereby makes the following amendment in Delhi High Court (Right to Information) Rules, 2006, which were notified vide Notification No.180/Rules/DHC dated 11th August, 2006, in Delhi Gazette Extraordinary, Part IV No.131 (N.C.T.D. No. 109) dated 11th August, 2006, amended vide Notification No.117/Rules/DHC dated 8.5.2007 published in Delhi Gazette Extraordinary Part IV No. 80 (N.C.T.D. No. 30) dated 8.5.2007, further amended vide Notification No.225/Rules/DHC dated 29.10.2007 published in Delhi Gazette Extraordinary Part IV No. 185 (N.C.T.D. No. 206) dated 29.10.2007 and corrected vide Corrigendum No. 117/Rules/DHC dated 31.1.2008 published in Delhi Gazette Extraordinary Part IV No. 19 (N.C.T.D. No. 301) dated 31.1.2008, further amended vide Notification No.46/Rules/DHC dated 22.1.2009 published in Delhi Gazette Extraordinary Part IV No. 12 (N.C.T.D. No. 303) dated 22.1.2009, further amended vide Notification No. 178/Rules/DHC dated 13.05.2010 published in Delhi Gazette Extraordinary Part IV No. 77 (N.C.T.D. No. 41) dated 13.05.2010, further amended vide Notification No. 456/Rules/DHC dated 11.09.2014 published in Delhi Gazette Extraordinary Part IV No. 118 (N.C.T.D. No. 96) dated 11.09.2014 and further amended vide Notification No. 81/Rules/DHC dated 16.02.2016 published in Delhi Gazette Extraordinary Part IV No. 27 (N.C.T.D. No. 208) dated 16.02.2016 :-
AMENDMENTS
I. The Explanation shown before Rule 3(a) shall be read at the end of Rule 3.
II. In the existing Rule 3(a), the words "in favour of the Registrar General, High Court of Delhi by way of cash, Indian Postal Order, Demand Draft, Pay Order" shall be added after the words "application fee" and before the words "as per Rule 10 with the authorized person".
III. The following proviso shall be added immediately after the existing Rule 3(a), in the following manner :-
"Provided that no application shall be rejected only on the ground that it is not in Form A."

"6. Information which is to be furnished and access to records shall be subject to the rules/regulations
pertaining to destruction of records in force from time to time which may have been notified or
implemented by this Court."
