. 1649-62.—दिल्ली कारागार अधिनियम, 2000 (2002 का दिल्ली अधिनियम संख्या 02) की धारा 71 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार माननीय मंत्री (गृह) के अनुमोदन के अनुसार दिल्ली कारागार नियमावली, 2018 में संशोधन करने के लिये निम्नलिखित नियम बनाती है, अर्थात्‌ :-

(1) इन नियमों को दिल्ली कारागार (संशोधन) नियमावली, 2020 कहा जाए। (2) यह दिल्ली राजपत्र में अपनी प्रकाशन की तिथि से प्रभावी होगी।

दिल्ली कारागार नियमावली, 2018 के नियम 1212-क को निम्न प्रकार से प्रतिस्थापित किया जायेगा, अर्थात्‌ः-

"महामारी के खतरे, प्राकृतिक आपदा या किसी अन्य स्थिति या परिस्थितियों में जो जेल में कैदियों की संख्या को तत्काल कम करने के लिए और कैदियों, जेल प्रशासन एवं बड़े पैमाने पर समाज के हित के लिए, नियम 1210 या 1212 के बावजूद सरकार नियमित पैरोल के अलावा एक चरण में आठ सप्ताह तक की पैरोल दे सकती है। आगे, आपातकालीन स्थिति को ध्यान में रखते हुए चरण की संख्या बढ़ाई जा सकती है, इसके अलावा यह सरकार द्वारा निर्धारित किया जायेगा, कि इस आपातकालीन पैरोल पर जेल के बाहर कैदी द्वारा बिताई गई अवधि को कैदी की सजा की और गिना जाएगा या नहीं।''राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल के आदेश से तथा उनके नाम पर, एम के अग्रवाल, उप-सचिवः गृह 2158 DG/2020 (1) [PART IV DELHI GAZETTE : EXTRAORDINARY 2 मूल नियम दिनांक 01.10.2018 की अधिसूचना फा0 नं0 9/87/2018/एचजी/5980 के द्वारा अधिसूचित किया गया था और निम्नानुसार उत्तरवर्ती संशोधन किये गये।

F. No. 18/191/2015-HG/1649-62.—In exercise of the powers conferred by section 71 of the Delhi Prison Act,2000 ( Delhi Act 2 of 2002), the Hon'ble Minister (Home), Government of National Capital of Territory of Delhi, is pleased to amend the Delhi Prisons Rules, 2018, namely: —

1. Short title and commencement:—(1) These rules may be called the Delhi Prisons(Amendment) Rules, 2020.

(2) They shall be come into force on the date of their publication in the Delhi Gazette.

2. Amendment of Rule 1212 A: — In the Delhi Prisons Rules, 2018 for Rule 1212 A, the following shall be substituted namely: —

" Notwithstanding anything contained in the Rule 1210 or 1212, in the event of emergent situations like threat of epidemic, natural disaster or any other situation or circumstances which warrant immediate easing of population of the inmates in the prison, and, in order to secure the interest of inmates, the prison administration and the society at large, the Government may grant up to eight weeks parole in one spell in addition to the regular parole as provided in these Rules. Further, the number of spells may be increased if emergent situation so warrants. This shall be subject to such conditions as may be prescribed by the Government. Further, it shall be discretion of the Government to decide as to whether the period spent by the prisoner outside the prison on this emergency parole shall be counted towards the sentence of the prisoners or not."
