सं.फा. डीएम/एस ई/एलएसी/ पार्ट-II/2016/ 2844.—जबकि, भूमि अधिग्रहण, पुनर्वास और पुनःस्थापन का उचित मुआवज़ा और पारदर्शिता अधिकार अधिनियम, 2013 की धारा 11 की उपधारा (1 ) के अंतर्गत जारी अधिसूचना संख्या फा. एडीएम/एस ई/एलएसी/2016/506 दिनांक 02.09.2019 के द्वारा जन कार्यो के लिए गांव नंगली रजापुर में सराय काले खां से मयूर विहार तक बारापुल्ला नाले के ऊपर एलिवेटेड रोड के निर्माण हेतु परियोजना के लिए भूमि अधिग्रहण हेतु अधिसूचना जारी की गयी थी;

और जबकि, उक्त अधिनियम की धारा 19 की उप-धारा (7) के अनुसार, इस अधिनियम की धारा 19 के तहत घोषणा प्राथमिक अधिसूचना के जारी होने से 12 महीने की अवधि के अंदर जारी होनी है;

और जबकि, उक्त अधिनियम की धारा 19 के अंतर्गत घोषणा जारी करने में समय के विस्तार के प्रस्ताव को दिल्ली के माननीय उपराज्यपाल द्वारा अनुमोदित किया गया है और घोषणा का समय अगले छह (6) महीने के लिए बढ़ा दिया गया है; 4071 DG/2020 (1) [PART IV DELHI GAZETTE : EXTRAORDINARY 2 इसलिए, अब उपयुक्त सरकार, उक्त भूमि अधिग्रहण पुनर्वास और पुनःस्थापन का उचित मुआवज़ा और पारदर्शिता अधिकार अधिनियम, 2013 की धारा 19 के अंतर्गत घोषणा जारी करने की अवधि को अगले छह महीने की

अवधि तक बढ़ाने की अनुमति प्रदान करती है अर्थात 1 मार्च, 2021 तक ।

NOTIFICATION

Delhi, the 1st September, 2020

F. No. DM/SE/LAC/Part-II/2016/2844.—Whereas, a Notification under sub section 1 of Section 11 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 was issued vide notification No. ADM/SE/LAC/2016/506 dated 02.09.2019 for acquisition of land for public purpose, namely for construction of Elevated Road over Barapullaha Nallah starting from Sarai Kale Khan to Mayur Vihar, New Delhi;

And whereas, as per sub-section of (7) of Section 19 of the said Act, the declaration under Section 19 of this Act is to be issued within a period of 12 months from the date of publication of preliminary notification;

And whereas, a proposal for extension of time for issuance of declaration under Section 19 of the Act, has been approved by Hon'ble Lt. Governor of Delhi and time for declaration has been extended for a further period of six (6) months;

Now, therefore, the appropriate Government in exercise of powers conferred under proviso of sub-section 7 of Section 19 of the Act, is pleased to extend the period for issuance of declaration and summary of Rehabilitation and Resettlement under section 19 of the said Act for a further period of six months i.e. upto 1st March,2021.
