.—सूक्ष्म, लघु एवं मध्यम उद्यम अधिनियम, 2006 की धारा 2 के खंड (पी) के साथ पठित धारा 20 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा विभाग की अधिसूचना संख्या एसीआई/एमएसएमई/सीआई/2/2010/1241-46 दिनांक 25 जुलाई, 2012 के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व की गई या किए जाने के लिए हटाई गई बातों को छोड़कर , राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल एतद द्वारा उक्त अधिनियम के प्रयोजनार्थ राष्ट्रीय राजधानी क्षेत्र दिल्ली के प्रत्येक राजस्व जिले में निम्नलिखित सदस्यों वाली ''एवं और लघु उद्योग सुविधा परिषद (एमएसईएफसी)'' का गठन करते हैं जिसमें निम्नलिखित सदस्य होंगे, अर्थात्‌ः -

2. कॉलम संख्या 4 के क्रम संख्या पर उल्लिखित औद्योगिक/व्यापारी संघ का सदस्य राज्य सरकार द्वारा नामित किया जाएगा।

3. संबंधित राजस्व जिले के एसडीएम (मुख्यालय) सुविधा के लिए आवेदनों के समय पर निपटान के लिए नियमित रूप से सूक्ष्म और लघु उद्यम सुविधा परिषद की बैठकें कराने के लिए उत्तरदायी होंगे। 4. संबंधित परिषद को अपने राजस्व जिले के अधिकार क्षेत्र के भीतर स्थित आपूर्तिकर्ता और भारत में कहीं भी स्थित खरीदार के बीच विवाद में मध्यस्थ या सुलहकर्ता के रूप में कार्य करने का अधिकार क्षेत्र होगा। 5. सूक्ष्म और लघु उद्यम सुविधा परिषद के सदस्यों के लिए पदनाम द्वारा नामांकित किया जा रहा है, कार्यालय छोड़ने वाले सदस्यों के कारण उत्पन्न होने वाली रिक्ति को उनके उत्तराधिकारी द्वारा कार्यालय में स्वतः रूप से भरा समझा जाएगा।

6. जिला स्तरीय एमएसएमई सुविधा परिषद निम्नलिखित कार्य करेगी।

(i) उपरोक्त अधिनियम की धारा 18 की उप-धारा (1) के तहत प्राप्त संदर्भ पद विचार करना, आपूर्ति की गई वस्तुओं के लिए या आपूतिकर्ता द्वारा प्रदत्त सेवाओं के लिए खरीदार से किसी भी राशि के संबंध में, मध्यस्थता कार्यवाही करना, एमएसएमई अधिनियम, 2006 और उद्योग विभाग द्वारा अधिसूचित नियमों के प्रवधानों के अनुसरण में अधिनिर्णय पारित करना।

(ii) प्राप्त संदर्भों पर 90 दिनों की अवधि के भीतर निर्णय करना।

(iii) अध्यक्ष या उनके द्वारा अधि—त कोई अन्य अधिकारी एमएसईएफसी की बैठकों की कार्रवाई और वार्षिक प्रगति रिपोर्ट को अपर सचिव और विकास आयुक्त (एमएसएमई) भारत सरकार को बैठकों अग्रसारित करेगा ।

File/3120.—In exercise of the powers conferred by section 20 read with clause (P) of section 2 of the Micro, Small and Medium Enterprises Act, 2006 and in supersession of Department's notification No. ACI/MSME/CI/2/2010/1241-46 dated the 25th July, 2012 except as respects things done or omitted to be done before such supersession, the Lieutenant Governor of National Capital Territory of Delhi is pleased to constitute the "Micro and Small Enterprise Facilitation Council (MSEFC)" in each Revenue District of National Capital Territory of Delhi for the purpose of the said Act consisting of the following members, namely: -

2. Member of Industrial/Trader Association mentioned at serial no. 4 of column number 4, shall be nominated by the State Government.

3. SDM (HQ) of the respective Revenue District shall be responsible for getting the meetings of Micro and Small Enterprise Facilitation Council convened on regular basis for timely disposal of the applications for facilitation.

4. The respective Council shall have jurisdiction to act as an Arbitrator or Conciliator in a dispute between the supplier located within the jurisdiction of its Revenue District and a buyer located anywhere in India.

5. For the Members of Micro and Small Enterprise Facilitation Council being nominated by designation, the vacancy arising on account of members leaving the office would be treated as filled up automatically by their successor-in- office.

6. The District Level MSME Facilitation Council shall exercise the following functions.

i. To entertain reference received under sub-section (1) of Section 18 of the aforesaid Act, with regard to any amount due from the buyer for the goods supplied or services rendered by the supplier, to conduct arbitration proceedings, to pass award in accordance with the provisions of MSME Act, 2006 and Rules notified by the Industries Department.

ii. To decide references received by it within a period of 90 days from making of such reference.

iii. The Chairperson or any other officer authorised by him shall forward the proceedings of the meetings and Annual Progress Report of MSEFC to Additional Secretary and Development Commissioner (MSME), Government of India.
