.—जबकि मोटर वाहन अधिनियम 1988 (1988 का 59) की धारा 212 की उपधारा (1) की अपेक्षानुसार दिल्ली मोटर वाहन नियमावली 1993 का पुनः संशोधन करने के लिए नियमों का प्रारूप दिनांक 10.10.2020 की अधिसूचना सं. फा़. डीसी ऑप्स टीपीटी 2020 75/57917 के अनुसार दिल्ली राजपत्र भाग-4 असाधारण में जिस तिथि को उक्त अधिसूचना वाला दिल्ली के राजपत्र की प्रतियां जनता को उपलब्ध कराई गई थी उस तिथि से तीन दिन की अवधि बीतने से पहले इससे प्रभावित होने वाले सभी व्यक्तियों से आपत्तियां तथा सुझाव आमंत्रित करने के लिए प्रकाशित किया गया था और जबकि, उक्त राजपत्र अधिसूचना की प्रतियां जनता को 10 अक्तूबर 2020 को उपलब्ध कराई गईं थी;

और जबकि, उक्त प्रारूप नियमावली के संबंध में जनता से कोई भी आपत्ति प्राप्त नहीं हुए हैं।

अतः इसलिए केंद्र सरकार द्वारा की गयी अधिसूचना दिनांक 21/03/2017, जीएसआर 271 (ई), खंड 2 (i) जो भारत सरकार के राजपत्र भाग-II, खण्ड 3 (i) में प्रकाशित हुई थी के द्वारा केंद्रीय मोटर वाहन नियमों, 1989 के नियम 81 में दी गयी शक्तियों का प्रयोग करते हुए, दिल्ली मोटर वाहन नियमों, 1993 में पुनः संशोधन करने के लिए निम्नलिखित नियम बनाते है, अर्थात :- 4960 DG/2020

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 1 1) इन नियमों को दिल्ली मोटर वाहन (संशोधन) नियमावली (द्वितीय संशोधन) नियम, 2020 स्ांक्षिप्त शीर्षक एवं प्रारम्भ

कहा जाएगा।

2) ये दिल्ली राजपत्र में अपनी प्रकाशन की तिथि से प्रभावी होगा।

2 1) दिल्ली मोटर वाहन नियम, 1993 में नियम 37 के बाद निम्नलिखित को सम्मिलित किया नया नियम 37 ए अन्तःस्थापित

जाएगा :-

नियम 37 ए

2) केन्द्रीय मोटर वाहन नियम, 1989 के नियम 81 के स्तम्भ 3 में क्रम संख्या 4 पर निर्धारित पंजीकरण शुल्क, बैटरी चलित वाहनों जैसा कि केन्द्रीय मोटर वाहन नियम 1989 में परिभाषित है, पर लागू नहीं होगा।

3) इन नियमों में कुछ भी शामिल होने के बावजूद, केंद्रीय मोटर वाहन नियम, 1989 के नियम 81 की फीस तालिका में क्रमशः क्रमांक 6,7 और 11 में निर्दिष्ट मोटर वाहनों के लिए स्वामित्व के हस्तांतरण में देरी, निवास स्थान में परिवर्तन तथा फिटनेस के प्रमाणपत्र के अनुदान या नवीनीकरण में देरी होने पर अतिरिक्त शुल्क के लिए किसी व्यक्ति या किसी वर्ग के व्यक्ति को छूट देने का आदेश आयुक्त द्वारा दिया जा सकता है।

Delhi, the 15th October, 2020

No. DC/OPS/TPT/2020/75/59849.—Whereas the draft rules further to amend the Delhi Motor Vehicles Rules, 1993 were published as required under sub-section (1) of section 212 of the Motor Vehicles Act,1988 (59 of 1988), vide Notification No.F.DC/OPS/TPT/2020/75/57917 dated 10-10-2020 in the Delhi Gazette, Part-IV, Extra- ordindary inviting objects and suggestions from all persons likely to be affected thereby, before expiry of the period of three days from the date on which copies of the Delhi Gazette containing the said notification were made available to public.

And whereas, copies of the said Gazette notification were made available to the public on the 10th October, 2020.

And whereas, no objection and suggestion have been received from the public in respect of the said draft rules.

Now therefore, in exercise of powers given under rule 81 of the Central Motor Vehicles Rules, 1989 by Central Government vide notification dated 21st March 2017, G.S.R 271(E), clause 2(i) published in gazette of Part-II, section 3 (i), the following rules further to amend the Delhi Motor Vehicles Rules, 1993 are hereby made, namely :-

Rules

1 (1) These rules may be called the Delhi Motor Vehicles (Second

Amendment) Rules, 2020.

Short Title and Commencement

(2) They shall come into force on the date of their final

publication in the Delhi Gazette.

Insertion of new Rule 37A 2 (1) In the Delhi Motor Vehicles Rules, 1993 after Rule 37,

following shall be inserted namely :

Rule 37 A

(2) The Registration fee prescribed at Serial No.4 in the Column 3 of the Table given in Rule 81 of Central Motor Vehicles Rules, 1989 shall not be applicable on Battery Operated Vehicles as defined in Central Motor Vehicles Rules, 1989.

(3) Notwithstanding anything contained in these rules, the Commissioner may by order exempt a person or a class of persons from the payment of additional fee for delay in transfer of ownership, change of residence and delay in grant or renewal of certificate of fitness for a motor vehicle as specified in the table of fees in Rule 81 of the Central Motor Vehicles Rules, 1989, at Serial No. 6, 7 and 11 respectively.
