सं. फा. 47/नीति/06/2020/179.—दिल्ली सहकारी समितियां अधिनियम, 2003 (2004 का दिल्ली अधिनियम 3) की धारा 127 द्वारा प्रदत्त अधिकारों का उपयोग करते हुए और अधिसूचना सं.फा. 47/नीति/06/2020/79-88 दिनांक 25.06.2020 एवं शु ्द्धि पत्र दिनांक 09.07.2020 के क्रम में, राष्ट्रीय राजधानी क्षेत्र सं.फा. 47/नीति/06/2020/59-68 दिनांक 25.06.2020 तथा शु ्द्धि पत्र दिनांक 09.07.2020 जिसके द्वारा निर्दिष्ट किया गया था कि सोसायटी के सदस्यों की आम बैठक 20 नवम्बर और 31 दिसम्बर, 2020 के बीच बुलायी जा सकती है, को ध्यान में रखते हुए एवं यह भी कि मौजूदा स्थिति में चुनाव के लिये और अधिनियम की धारा 31 के तहत, अलग से बैठक आयोजित करना उचित नहीं होगा, एतद्द्वारा आदेश देते हैं कि दिल्ली सहकारी समितियां अधिनियम, 2003 की धारा 35 में निहित चुनाव से संबंधित और समिति के निर्वाचित सदस्यों के कार्यकाल से संबंधित प्रावधान निम्नलिखित आशोधनों के साथ लागू होंगे :-

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] "आवासीय सहकारी समितियों के अतिरिक्त सहकारी समितियों के मामले में, जिनके सदस्यों की संख्या एक हजार से अधिक है और जहां नयी समितियों के गठन के लिये चुनाव अब तक नहीं हो सके हैं, मौजूदा समिति अपनी आम बैठक के साथ ही नयी समिति के लिये 20.11.2020 और 31.12.2020 के बीच चुनाव करायेगी । नयी समितियों के चुनाव तक मौजूदा समितियों का कार्यकाल विस्तारित होगा "

NOTIFICATION
Delhi, the 18th November, 2020
F.No. 47/Policy/06/2020/179.—In exercise of powers conferred by section 127 of the Delhi Co-operative Societies Act, 2003 (Delhi Act 3 of 2004) and in continuation to notification no. F.No. 47/Policy/06/2020/79-88 dated 25.06.2020 read with corrigendum dated 09.07.2020, the Lieutenant Governor of National Capital Territory of Delhi keeping in view various guidelines and restrictions which remained/remain in force on account of Covid-19 situation and also that notification No. F. No. 47/Policy/06/2020/59-68 dated 25.06.2020 read with corrigendum dated 09.07.2020 stipulated that GBM of members of the society can be convened between 20th November and 31st December, 2020 and under the prevailing condition it would not be expedient to hold separate GBMs for election and u/s 31 of the Act, hereby order that the provisions relating to election and also the term of office of elected members of the committee as contained in Section 35 of Delhi Co-operative Societies Act, 2003 shall be modified as under:-
"In the case of cooperative societies, other than housing cooperative societies, whose membership exceeds One Thousand and where the election for constituting the new committees of the societies could not be conducted so far, the existing committees shall arrange election of the new committee alongwith their AGM to be held between 20/11/2020 and 31/12/2020. The tenure of the existing Committees of these societies would accordingly stand extended till the election of the new committees."

सं.फा.47/पोलिसी/06/2020/180.—दिल्ली सहकारी समितियां अधिनियम, 2003 (2004 का दिल्ली अधिनियम 3) की धारा 127 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एवं दिनांक 25/06/2020 को जारी अधिसूचना सं. 47/पोलिसी/06/2020/89-98 के क्रम में, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल कोविड-19 स्थिति के कारण लागू विभिन्न दिशा-निर्देशों और प्रतिबंधों को ध्यान में रखते हुए एतद्द्वारा आदेश देते हैं कि अधिनियम, 2003 की धारा 70 के तहत पंजीयक को इस प्रश्न के निर्धारण के लिये कि क्या वह सहकारी समिति के संविधान प्रबंधन या व्यवसाय से संबंधित विवाद है या नहीं, संदर्भित मामलों में जहां कार्यवाहियां व निर्णय लंबित है, रजिस्ट्रार द्वारा 30 नवम्बर, 2020 तक निर्णय लिया जाएगा।

NOTIFICATION
Delhi, the 18th November, 2020
F.No. 47/Policy/06/2020/180.—In exercise of powers conferred by section 127 of the Delhi Cooperative Societies Act, 2003 (Delhi Act 3 of 2004) and in continuation of notification no. F.No. 47/Policy/06/2020/ 89-98 dated 25.06.2020, the Lieutenant Governor of National Capital Territory of Delhi keeping in view various guidelines and restrictions which remained/remain in force on account of Covid-19 situation, hereby order that all proceedings relating to the question whether dispute referred to the Registrar under section 70 of Delhi Co-operative Societies Act, 2003 is or is not a dispute touching the constitution, management or the business of the cooperative society which are pending decision; shall now be decided by 30th November, 2020.

सं.फा.47/पोलिसी/06/2020/181.—दिल्ली सहकारी समितियां अधिनियम, 2003 (2004 का दिल्ली अधिनियम 3) की धारा 127 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एवं दिनाक 25/06/2020 को अधिसूचना सं.47/पोलिसी/06/2020/99-108 की निरंतरता मे, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल कोविड-19 स्थिति के कारण लागू विभिन्न दिशा-निर्देशों और प्रतिबंधों को ध्यान में रखते हुए एतद् द्वारा आदेश देते हैं कि अधिनियम की धारा 86 के अधीन सहकारी हाउसिंग सोसाइटी की समिति द्वारा निर्दिष्ट सदस्यों के निष्कासन से संबंधित सभी प्रस्तावों के संबंध में, जहां एक सौ अस्सी दिनों की निर्धारित समय सीमा समाप्त हो गई है और अंतिम आदेश पारित होने बाकी हैं, पंजीयक ऐसे सभी मामलों में 30 नवम्बर, 2020 तक अंतिम आदेश पारित करेंगे।

NOTIFICATION

F.No. 47/Policy/06/2020/ 99-108 dated 25.06.2020, the Lieutenant. Governor of National Capital Territory of Delhi keeping in view various guidelines and restrictions which remained/remain in force on account of Covid-19 situation: hereby order that all the proceeding relating to the proposals of expulsion of members referred by the committee of a cooperative housing society under section 86 of the Act, where the prescribed time limit of One Hundred Eighty days has expired and the final orders are yet to be passed, shall be disposed off by 30th November, 2020.
