राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 23 नवम्बर, 2020 संविधान के अनुच्छेद 123 के खंड (1) द्वारा प्रदत्त शक्तियों के प्रयोग में, भारत के राष्ट्रपति ने ''कृषक उपज व्यापार और वाणिज्य (संवर्धन और सुविधा) नामक अध्यादेश, 2020 प्रख्यापित किया है, जिसे विधि एवं न्याय मंत्रालय, भारत सरकार द्वारा 05 जून, 2020 को भारत का राजपत्र असाधारण के भाग-II खंड 1 में प्रकाशित किया है। उक्त अध्यादेश की धारा 14 के अनुसार, यह किसी भी राज्य —षि उपज विपणन समिति (एपीएमसी) अधिनियम या किसी अन्य कानून के लागू होने के समय या तत्समय प्रवृत्त किसी भी कानून के प्रभाव में होने वाले प्रलेख के प्रभाव में आने वाले समय के लिए लागू होगा।
जबकि, राष्ट्रीय राजधानी क्षेत्र दिल्ली की विधान सभा ने "दिल्ली —षि उपज विपणन (विनियम) अधिनियम, 1998" (1999 का दिल्ली अधिनियम संख्या 7) नामक एक अधिनियम अधिनियमित किया है जो 2 जून, 1999 से लागू है। और, जबकि —षि उपज विपणन समिति नजफगढ़, —षि उपज विपणन समिति नरेला और मछली, मुर्गी और अंडा बाजार, गाजीपुर के बाजार क्षेत्रों से संबंधित उक्त अधिनियम तथा इसके अन्तर्गत बनाये गये नियमों के कुछ प्रावधान उक्त अध्यादेशों के प्रावधानों से भिन्न हैं। इन —षि उपज विपणन समिति/बाजारों के घोषित बाजार क्षेत्र में उनकी भौतिक सीमाओं के बाहर का क्षेत्र भी शामिल है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] और, जबकि राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार ने उक्त अध्यादेश के परन्तुक को प्रभावी करने के लिए नजफगढ़, नरेला और गाजीपुर में स्थित —षि उपज विपणन समिति नामक उपरोक्त बाजार क्षेत्र को फिर से पुनःपरिभाषित करना आवश्यक समझा।
इसलिए, दिल्ली —षि उपज विपणन (विनियम) अधिनियम, 1998 की धारा 3 तथा धारा 4 की उपधारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार एतद्द्वारा यह घोषणा करती है कि उक्त अध्यादेश की धारा 14 के अन्तर्गत यथापरिभाषित कृषि उपज के विपणन के विनियम तत्काल प्रभाव से —षि उपज विपणन समिति, नजफगढ़, —षि उपज विपणन समिति, नरेला और मछली, मुर्गी पालन और अंडा बाजार, गाजीपुर नामक विपणन समितियों संबंधी बाजारों/बाजार यार्ड/सब-यार्डों से परे होंगे और इसके पश्चात् इन संमितियों के बाजार क्षेत्र के सीमाएं निम्नप्रकार होंगेः 1. —षि उपज विपणन समिति (एपीएमसी), नजफगढ़ (मार्केट यार्ड) से घिरा हुआ;
पूर्व ः अग्रवाल कॉलोनी पश्चिम ः बहादुरगढ़ झारोदा रोड। उत्तर ः बाबा हरिदास नगर। दक्षिण ः इंदिरा कॉलोनी और अग्रवाल कॉलोनी।
2. —षि उपज विपणन समिति (एपीएमसी), नरेला (पुरानी अनाज मंडी) से घिरा हुआ;
दक्षिण पूर्व ः नरेला अलीपुर रोड। दक्षिण पश्चिम ः मंडी विस्तार कॉलोनी उत्तर पश्चिम ः नरेला रेलवे स्टेशन। नॉर्थ ईस्ट ः नई बस्ती कॉलोनी।
3. —षि उपज विपणन समिति (एपीएमसी), नरेला (नई अनाज बाजार) से घिरा हुआ;
दक्षिण पूर्व ः नरेला अलीपुर रोड दक्षिण पश्चिम ः डीडीए कार्यालय। उत्तर पश्चिम ः दिल्ली चंडीगढ़ रेलवे लाइन। नॉर्थ ईस्ट ः बवाना रोड मंडी एक्सटेंशन कॉलोनी।
4. मछली, मुर्गी और अंडा बाजार गाजीपुर से घिरा हुआ;
पूर्व ः मुर्गा मार्किट की सीमा (एमआरटीसी द्वारा विस्तारित) हिंडन नहर की ओर
पश्चिम ः मछली बाजार की चारदीवारी सड़क की ओर जाती है सेनेटरी लैंडफिल क्षेत्र गाजीपुर के लिए
उत्तर ः मछली, बाजार की सीमा राष्ट्रीय राजमार्ग संख्या 24 की ओर
दक्षिण
ः एसएलएफ क्षेत्र की ओर मछली बाजार की चारदीवारी और मुर्गी बाजार की ओर की चारदीवारी खाली जमीन
हालाँकि, दिनांक 02 सितंबर, 2014 को दिल्ली राजपत्र असाधारण के भाग- IV में प्रकाशित अधिसूचना संख्या फा0 8 (34)/2014/ डीएएम/एमआर/1886 के अनुसार राष्ट्रीय महत्व के मंडी, आजादपुर और इसके उप यार्डों, —षि उपज विपणन समिति, शाहदरा और —षि उपज विपणन समिति, केशोपुर के बाजार क्षेत्र में कोई परिवर्तन नहीं होगा।

NOTIFICATION
Delhi, the 23rd November, 2020
No.F.8(01)/2020/DAM/MR/2110.—In exercise of powers conferred by clause (1) of article 123 of the Constitution, the President of India has promulgated an ordinance called "The Farmers' Produce Trade and Commerce (Promotion and Facilitation) Ordinance, 2020 published in Part-II Section 1 Gazette of India, Extraordinary dated 5th June, 2020 by Government of India, Ministry of Law and Justice. As per section-14 of the said ordinance, it has overriding effect on any State APMC Act or any other law for the time being in force or any instrument having effect by virtue of any law for the time being in force.
Whereas, Legislative Assembly of the National Capital Territory of Delhi has enacted an Act named "The Delhi Agricultural Produce Marketing (Regulation) Act, 1998" (Delhi Act No.7 of 1999) which is in force from 2nd June, 1999.
And, whereas certain provisions of the said Act and Rules made thereunder relating to the market area of Agricultural Produce Marketing Committee Najafgarh, Agricultural Produce Marketing Committee Narela and Fish, Poultry and Egg Market, Ghazipur are inconsistent therewith the provisions of the said ordinance. The declared market area of these Agricultural Produce Marketing Committee / Markets includes area outside their physical boundaries.
And, whereas Government of National Capital Territory of Delhi in order to give effect to the proviso of the said Ordinance consider it necessary to redefine the market area of above named Agricultural Produce Marketing Committee located at Najafgarh, Narela and Ghazipur.
Therefore, in exercise of the powers conferred by section- 3 and sub section (4) of section- 4 of the Delhi Agricultural Produce Marketing (Regulation) Act, 1998, Government of National Capital Territory of Delhi is pleased to declare that the regulation of marketing of agriculture produce as defined under section- 14 of above said ordinance shall cease beyond the markets / market yards / sub yards of respective marketing committees namely Agricultural Produce Marketing Committee, Najafgarh, Agricultural Produce Marketing Committee, Narela and Fish, Poultry and Egg Market Ghazipur with immediate effect, and henceforth market area of these committees shall have the following boundaries :
1. APMC, Najafgarh
(Market Yard) bounded by;
East : Aggarwal Colony
West : Bahadurgarh Jharoda Road.
North : Baba Haridas Nagar.
South : Indira Colony & Aggarwal Colony.
2. APMC, Narela
(Old grain market) bounded by;
South East : Narela Alipur Road.
South West : Mandi extension colony
North West : Narela Railway Station.
North East : Nai Basti Colony.
3. APMC Narela
(New grain market) bounded by;
South East : Narela Alipur Road
South West : DDA office.
North West : Delhi Chandigarh Railway Line.
North East : Bawana Road Mandi Extension Colony.

East- : Boundary of Poultry market (extended by MRTC)
towards Hindan Canal
West : boundary wall of Fish market towards road going to sanitary landfill area Ghazipur

South : Boundary wall of Fish market towards SLF area and boundary wall of poultry market towards vacant land.
However, there will be no change in the market area of Market of National Importance Azadpur and its sub yards, Agricultural Produce Marketing Committee, Shahdara, and Agricultural Produce Marketing Committee, Keshopur as vide notification No. F.8(34)/2014/DAM/MR/1886 published in Part-IV of Delhi Gazette Extraordinary on 2nd September, 2014.
