फा.स. ¹⁰¹¹/ टी॰ओ॰(एस॰/(टी॰ सी॰-फे लिंग/²⁰¹⁸-¹⁹/⁸²⁰⁰-⁰⁹.—दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए जनहित में राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, ओखला इंडस्ट्रियल एस्टेट फे ज - III, ग्राम बाहापुर के खसरा नंबर 400, 401, 1131/402, 1187/1130/402, 440, 444, 445, 446, 447, 448, 449, 450, 451, 453, 454, 1721/452, 455 में जीबी पंत एकीकृ त तकनीकी परिसर के निर्माण हेतु नीचे दिए गए विवरण के अनुसार 3.75 हेक्टेयर (37502.18 वर्ग मीटर) क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधो से छूट प्रदान करती है।

यह छूट निम्नलिखित शर्तो के अधीन है:-

¹. प्रशिक्षण और तकनीकी शिक्षा विभाग जो कि उपभोगी संस्था के रूप में संदर्भित है, को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 1,56,75,000 /- रूपये (एक करोड़ छप्पन लाख पचहत्तर हजार मात्र) की राशि अग्रिम रूप में जमा करवानी होगी।

(क)	उपभोगी संस्था द्वारा प्रतिपूरक 100% वृक्षारोपण (275 वृक्षों को काटने /प्रत्यारोपण किए जाने वाले वृक्षों का दस गुना) अर्थात् 2750 पौधो का प्रस्तावित प्रजातियाँ नीम, अमलतास, पीपल, पिलखन, गूलर, बरगद, देशी कीकर एवं अन्य देशी प्रजातियाँ का गोविंदपुरी नई दिल् ली (ए-टू-टी पॉके ट्स) च ंडीवाला अस् पताल के पास खाली हरे क्षेत्र में परिधि में किया जाएगा ।	2 750	1,56,75,000 /-	उप- वन संरक्षक (दक्षिण)/वन अधिकारी
)ख(	उपभोगी संस्था द्वारा 115 वृक्षों का प्रत्यारोपण परियोजना स्थल (जीबी पंत कै म्पस, ओखला, नई दिल्ली) पर स्वयं उपभोगी संस्था द्वारा किया जाएगा।

2. उपरोक्त 1 (क) और (ख) के अनुसार, देशी प्रजातियों के 2750 पौधों का 100 % प्रतिपूरक वृक्षारोपण और उनका सात वर्षों तक रखरखाव उपभोगी संस्था द्वारा किया जायेगा। इस वृक्षारोपण के सफलतापूर्वक स्थापना के बाद उपभोगी संस्था द्वारा निगरानी की जाएगी ।

3. 275 वृक्षों को काटे/ प्रत्यारोपण जाने के बदले मे 1:10 के अनुपात में स्वदेशी प्रजातियों के 6-8 फीट की ऊँ चाई वाले 2750 पौधों का प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के तीन महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण स्थल के अनुसार विशिष्ट वृक्षारोपण तकनीकों के द्वारा किया जाएगा और उसका रखरखाव उपभोगी संस्था द्वारा अपने स्वयं की लागत पर किया जाएगा ।

4. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जायेगा कि इस प्रस्ताव की योजना को परिवर्तित नहीं किया जाएगा । 5. विस्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष संरक्षण अधिनियम, ¹⁹⁹⁴ की धारा ¹² के अनुपालन में उपभोगी संस्था द्वारा प्रस्तुत किया जाएगा ।

6. उपभोगी संस्था द्वारा वृक्षों को काटे / प्रत्यारोपण शुरू करने से पहले साइट की तैयारी और वृक्षारोपण के लिए एक विस्तृत योजना प्रस्तुत करेगी।

7. उपभोगी संस्था द्वारा वृक्षारोपण पत्रिका को वन और वन्यजीव विभाग राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार को निर्धारित करेंगी और इसकी एक प्रति प्रत्येक वित्तीय वर्ष के अंत में प्रस्तुत की जा सकती है।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 8. उपभोगी संस्था द्वारा प्रतिपूरक वृक्षारोपण/ प्रत्यारोपण स्थल में मृदा नमी संरक्षण कार्य की गतिविधियों को किया जाएगा । 9. अनुमति जारी होने के तुरंत बाद वृक्षों का प्रत्यारोपण उपभोगी संस्था द्वारा शुरू किया जाएगा और इसे छ: महीने के अंतराल में पूर्ण किया जाएगा । प्रत्यारोपण प्रक्रिया के पूर्ण होने का बाद एक सम्पूर्ण रिपोर्ट संबन्धित वृक्ष अधिकारी को प्रस्तुत की जायेगी । प्रत्यारोपण स्थल मे प्रत्यारोपित वृक्षों की दूरी 4 मीटर (बिंदु से बिंदु) से कम नहीं होनी चाहिए ।

10. उपभोगी संस्था द्वारा वृक्षों की प्रत्यारोपण की प्रगति रिपोर्ट संबंधित निरीक्षण अधिकारी के माध्यम से वृक्ष अधिकारी को प्रस्तुत की जाएगी ।

11. वृक्षों को काटने/ प्रत्यारोपण के लिए अनुमति उनके स्वयं के जोखिम पर और किसी भी अन्य व्यक्ति के दावे के पक्षपात के बिना, जो वृक्षों और भूमि पर सही हो सकती है, दी जा रही है ।

12. उपभोगी संस्था द्वारा वृक्षों को काटने/ प्रत्यारोपण का कार्य सभी वैधानिक मंजूरियों को लेने के बाद ही शुरू किया जाएगा । 13. के लिए वृक्षों की कटाई / प्रत्यारोपण और उसमें पैदा होने वाली वन उपज को सार्वजनिक श्मशान में 90 दिनों के भीतर पूरा किया जाएगा।

14. उपभोगी संस्था द्वारा 160 वृक्षों को काटने से पूर्व प्रत्यारोपण किया जाएगा । वृक्षों की अनुमति 115 वृक्षो के सफल प्रत्यारोपण और उप- वन संरक्षक (दक्षिण) को अनुपालन प्रमाण पत्र प्रस्तुत करने के बाद दी जायेगी ।

15. उपभोगी संस्था द्वारा प्रस्तावित ²⁷⁵ वृक्षों के अलावा किसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष संरक्षण अधिनियम, 1994 के अन्तर्गत एक अपराध होगा ।

16. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जायेगा कि वृक्षों की कटाई से पूर्व कोई लंबित मुकदमेबाजी या स्थगन आदेश किसी भी न्यायालय / अन्य प्राधिकरण द्वारा पारित न हो ।

17. उपभोगी संस्था द्वारा वृक्षों को काटने के उपरान्त प्राप्त लकड़ियों की नीलामी की जाएगी और उससे प्राप्त धनराशि को सरकार के खाते मे राजस्व के रूप में जमा की जाएगी।

18. उपभोगी संस्था द्वारा वृक्षों के ऊपरी शाखाओं को काटे जाने के पश्चात प्राप्त लकड़ियों को मुफ्त में निकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाएगी और इसकी सूचना वृक्ष अधिकारी (दक्षिण) को दी जाएगी ।

19. उपभोगी संस्था द्वारा वृक्षों को काटने के स्थल से लकड़ियों को ले जाने से पूर्व वृक्ष अधिकारी (दक्षिण) से ढुलाई अनुमति प्राप्त करनी होगी।

20. उपभोगी संस्था के द्वारा पर्यावरण मंजूरी में उल्लिखित सभी शर्तों का पालन किया जायेगा ।

21. अनुमति तभी दी जाएगी जब "वृक्ष संरक्षण योजना" को समय-समय पर उप-वन संरक्षक (दक्षिण) द्वारा जारी किए गए पत्र दिनाँक-28.10.2020 के अनुसार वृक्ष अधिकारी/ उप-वन संरक्षक (दक्षिण) को प्रस्तुत किया जाए ।

NOTIFICATION

Delhi, the 19th January, 2021

F. No. 1011/TO(S)/TC-Felling/2018-19/8200-09.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 3.75 ha. (37502.18 Sq. Mtr.) as detailed below for construction of GB Pant Integrated Technical Campus Situated on Khasra No. 400,401,1131/402, 1187/1130/402, 440, 444, 445, 446, 447, 448, 449, 450, 451, 453, 454, 1721/452, 455 of village Bahapur, at Okhla Industrial Estate Phase-III, New Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-

1. Department of Training & Technical Education, herein referred to as User Agency, shall make an advance deposit of an amount of Rs. 1,56,75,000 /- (Rupees One Crore Fifty Six Lakh Seventy Five Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

(b)	Transplantation of 115 no. of trees which are standing on site shall be done by User Agency in the project site shall be done by User Agency in the project site itself (G.B Pant IT Campus, Okhla, New Delhi).

2. 100% Compensatory Plantation of 2750 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.

3. Plants of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non- forest land in lieu of removal/ transplantation of 275 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance shall be carried out there after by User Agency with their own funds.

4. The User Agency shall ensure that the plan of this proposal shall not be changed.

5. Detailed plantation schedule shall be submitted by User Agency in compliance with Section 12 of DPTA 1994 before initiating felling/ transplantation.

6. The User Agency shall submit a detailed plan for site preparation and plantation before initiating felling/ transplantation.

7. The User Agency shall maintain plantation journal as prescribed by the Department of Forest and Wildlife, GNCTD and a copy of the same may be submitted at the end of each financial year.

8. The User agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site.

9. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than six months, after which a completion report has to be submitted to the concerned Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.

10. The Progress report of transplantation shall be submitted to Tree Officer by User Agency through inspection officer concerned along with complete details of trees.

11. Permission for felling/ transplantation of all tress is being granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.

12. Before the felling/ transplantation of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency.

13. Felling/ transplantation of trees and transportation of forest produce arising therefrom to the public crematorium shall be completed within 90 days.

14. The transplantation shall be carried out prior to felling of 160 nos. of trees permitted herein. The 160 trees shall be removed/ felled after successful transplantation of 115 trees and submission of compliance certificate to DCF (South).

15. Felling/ transplantation of any tree apart from 275 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act, 1994.

16. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling of trees.

17. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency.

18. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to DCF (South) by User Agency.

19. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (South) by User Agency.

20. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, if any obtained, shall be followed scrupulously.

21. The permission shall be granted only if "The Tree Preservation Plan" is timely submitted to the Tree Officer as per the letter dated 28.10.2020 issued by DCF (South).
