टी॰ओ॰(एस॰)/टी॰ सी॰-फे लिंग/ —दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, वाई॰ए॰पी॰ III (पैके ज-ओ॰) नई दिल्ली ओखला में डी॰बी॰ ओ॰ बेसिस पर बी॰ ओ॰डी॰-10 मिली(cid:7061)ाम/ लिटर] टी॰एस॰एस॰-103 मिली(cid:7061)ाम/ लिटर या बेहतर और पावर जनरेशन के ए(cid:7010)लडेंट स्टैंडर्ड के साथ 564 एम॰एल॰डी॰ 124 एम॰जी॰डी॰) अपशिष्ट जल उपचार संयंत्र के निर्माण हेतु नीचे दिए गए विवरण के अनुसार 42,492 हेक्टेयर (105 एकड़) क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधो से छूट प्रदान करती।

यह छूट निम्नलिखित शर्तो के अधीन है:-
1. दिल्ली जल बोर्ड, जो कि उपभोगी संस्था के रूप में संद(cid:7414)र्भत है, को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 2,33,13,000 /- रूपये (दो करोड़ तैंतीस लाख तेरह हजार मात्र) की राशि अग्रिम रूप में जमा करवानी होगी।

| (ख( | उपभोगी संस्था द्वारा 18 वृक्षों का प्रत्यारोपण परियोजना स्थल में उपलब्ध भूमि पर किया जाएगा । |
2. उपरोक्त 1 (क) और (ख) के अनुसार, देशी प्रजातियों के 4090 पौधो का 100 % प्रतिपूरक वृक्षारोपण और उनका सात वष(cid:7299) तक रखरखाव उपभोगी संस्था द्वारा किया जायेगा। इस वृक्षारोपण के सफलतापूर्वक स्थापना के बाद उपभोगी संस्था द्वारा निगरानी की जाएगी ।
3. 409 वृक्षों को काटे/ प्रत्यारोपण जाने के बदले में 1:10 के अनुपात मे स्वदेशी प्रजातियों के 6-8 फीट की ऊँ चाई वाले 4090 पौधों का प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के तीन महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण स्थल के अनुसार विशिष्ट वृक्षारोपण तकनीकों के द्वारा किया जाएगा और उपभोगी संस्था द्वारा रखरखाव किया जाएगा ।
4. अनुमति जारी होने के तुरंत बाद वृक्षों का प्रत्यारोपण शुरू किया जाएगा और इसे तीन महीने के अंतराल में पूर्ण किया जाएगा । प्रत्यारोपण प्र(िcid:7059)या के पूर्ण होने का बाद एक सम्पूर्ण रिपोर्ट संबन्धित वृक्ष अधिकारी को प्रस्तुत की जायेगी । प्रत्यारोपण स्थल में प्रत्यारोपित वृक्षों की दूरी 4 मीटर (बिंदु से बिंदु) से कम नह(cid:7277) होनी चाहिए ।
5. उपभोगी संस्था के द्वारा यह सुनि(िcid:7391)त किया जायेगा कि इस प्रस्ताव की योजना को परिव(cid:7414)र्तत नह(cid:7277) किया जाएगा ।
6. जो भूमि प्रतिपूरक वृक्षारोपण के लिये आवंटित है , उसका उपयोग किसी अन्य काय(cid:7299) के लिए राज्य सरकार की स्वीकृ ति के बिना नह(cid:7277) किया जाएगा।
7. वृक्षो को काटने/ प्रत्यारोपण के लिए अनुमति उनके स्वयं के जोखिम पर और किसी भी अन्य (cid:7390)क्ति के दावे के पक्षपात के बिना, जो वृक्षों और भूमि पर सही हो सकती है, दी जा रही है ।
8. उपभोगी संस्था द्वारा वृक्षों को काटने/ प्रत्यारोपण का कार्य सभी वैधानिक मंजूरियों को लेने के बाद ही शुरू किया जाएगा । 9. उपभोगी संस्था द्वारा 409 वृक्षो के अलावा किसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष संरक्षण अधिनियम, 1994 के तहत एक अपराध होगा ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 10. उपभोगी संस्था द्वारा वृक्षों को काटने के उपरान्त प्राप्त लकड़ियों की नीलामी की जाएगी और उससे प्राप्त धनराशि को सरकार के खाते मे राजस्व के रूप में जमा की जाएगी।
11. उपभोगी संस्था द्वारा वृक्षों के ऊपरी शाखाओं को काटे जाने के पश्चात प्राप्त लकड़ियों को मु(cid:7010)त में निकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाएगी और इसकी सूचना वृ(cid:162) अ(cid:876)धकार(cid:547) (दक्षिण) को दी जानी जाएगी ।
12. उपभोगी संस्था द्वारा वृक्षों को काटने के स्थल से लकड़ियों को ले जाने से पूर्व वृक्ष अधिकारी (दक्षिण) से ढुलाई अनुमति प्राप्त करनी होगी।
13. उपभोगी संस्था के द्वारा पर्यावरण मंजूरी में उल्लिखित सभी शत(cid:7300) का पालन किया जाए ।
14. उपभोगी संस्था द्वारा वृक्षों की प्रत्यारोपण की प्रगति रिपोर्ट संबंधित निरीक्षण अधिकारी के माध्यम से वृक्ष अधिकारी को प्रस्तुत की जाएगी ।
15. उपभोगी संस्था के द्वारा ट्री ट्रांसप्लांटेशन पॉलिसी 2020 में उल्लिखित सभी शत(cid:7300) का पालन किया जाए ।

Delhi, the 19th January, 2021
F.No.R.809/TO(S)/TC-Felling/19-20/ 8255-63:- In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 42.492 ha. (105 Acres) as detailed below for construction of 564 MLD (124 MGD) WWTP with Effluent Standard of BOD-10 Mg/l, tss-103 mg/l or better and Power Generation on DBO Basis at Okhla under YAP-III (Package-O), New Delhi from the provision of sub-section (3) of section 9 of the said Act.

1. Delhi Jal Board, herein referred to as User Agency, shall make an advance deposit of an amount of Rs. 2,33,13,000 /- (Rupees Two Crore Thirty Three Lakh Thirteen Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.
3. Plants of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non- forest land in lieu of removal/ transplantation of 409 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance shall be carried out there after by User Agency with their own funds.
4. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than three months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
5. The User Agency shall ensure that the plan of this proposal shall not be changed.
6. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval of State Government.
7. Permission for felling/ transplantation of all tress is being granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
8. Before the felling/ transplantation of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency.
9. Felling/ transplantation of any trees apart from 409 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act, 1994.
10. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency.
11. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to DCF (South) by User Agency.
12. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (South) by User Agency.
13. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, if any obtained, shall be followed scrupulously.
14. Progress report of transplantation shall be submitted to Tree Officer by User Agency through inspection officer concerned along with complete details of trees.
15. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency.
