.—जबकि वर्तमान पार्षदों कि मृत्यु व त्याग-पत्र

के कारण प्रत्येक निगम के सामने दर्शायी गई दिल्ली नगर निगम में निम्नलिखित वार्डों में रिक्तियां हो चुकी हैंः-

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] और जबकि दिल्ली नगर निगम अधिनियम, 1957 यथासंशोधित दिल्ली नगर निगम अधिनियम, 2011 के अधीन निर्मित नियमावली के उपबंधों के अनुसरण में उपरोक्त सन्दर्भित उत्तरी व पूर्वी दिल्लीं नगर निगमों में आकस्मिक रिक्तियों को भरने के लिए उपरोक्त वर्णित वार्डों के लिए पार्षदों के उप-चुनाव होंगे;

और जबकि राज्य चुनाव आयोग, राष्ट्रीय राजधानी क्षेत्र दिल्ली इस बात से संतुष्ट है कि उप-चुनावों में उपयोग हेतु उपरोक्त वार्डों के लिए नई मतदाता सूचियां तैयार करने के बजाये राष्ट्रीय राजधानी क्षेत्र दिल्ली के संबंधित विधानसभा निर्वाचन क्षेत्रों की नई मतदाता सूचियों को अंगीकर करना काफी होगा, जो उक्त नगर निगमों के उक्त वार्डों के अन्तर्गत आते हैं, और जो वर्तमान में लागू हैं पूर्वोक्त उप-चुनावों के प्रयोजन के लिए उक्त वर्णित वार्डों से संबंधित है। चूंकि विधानसभा निर्वाचन क्षेत्राें की मतदाता सूचियां ''01.01.2021'' से अर्हक तिथि के अनुरूप मुख्य चुनाव अधिकारी, दिल्ली द्वारा संशोधित की जा चुकी हैं और इस आयोग द्वारा उक्त वर्णित वार्डों की नई मतदाता सूचियों को तैयार करने में काफी समय लगेगा साथ ही इस संबंध में अत्यधिक व्यय भी होगा, जिसे आसानी से बचाया जा सकता है;

अब, इसलिए, दिल्ली नगर निगम अधिनियम, 1957 (यथासंशोधित 2011) कि धारा 7ई, तथा दिल्ली नगर निगम (मतदाता सूची तैयार करना) नियमावली 1975 के नियम 27 के साथ पठित, के परन्तुक के अन्तर्गत चुनाव आयोग को प्रदत्त शक्तियों का प्रयोग करते हुए मैं, संजय कुमार श्रीवास्तव, राज्य चुनाव आयुक्त, राष्ट्रीय राजधानी क्षेत्र दिल्ली, एतद्‌ द्वारा निर्देश देता हूँ कि दिल्ली नगर निगम के उक्त वर्णित वार्डों से संबंधित तत्समय लागू (वर्ष 2021 तक पुनरीक्षित) उन विधानसभा निर्वाचन क्षेत्रों की मतदाता सूचियाँ होने वाले उप-चुनावों के उद्देश्य से दिल्ली नगर निगम के उक्त वार्डों की मतदाता सूचियाँ होंगी।

No.F.4(1)BYE/OSD/legal/SEC/2021/7136.—WHEREAS the following vacancies have occurred in the Municipal Corporation shown against each ward due to death and resignation of the sitting councillors :-

AND WHEREAS bye –elections to the above mentioned Wards shall be held to elect councillors to fill the casual vacancies in the North & East Delhi Municipal Corporations, referred to above, in accordance with the provisions of Delhi Municipal Corporation Act, 1957 as amended by Delhi Municipal Corporation (Amendment) Act, 2011 and the rules made thereunder.

AND WHEREAS the State Election Commissioner of the National Capital Territory of Delhi is satisfied that instead of preparing fresh electoral rolls for the aforesaid wards for use in the bye-elections it would be sufficient to adopt the electoral rolls of the respective Assembly Constituencies of the National Capital Territory of Delhi, as are comprised within the above-mentioned wards of the Municipal Corporations, referred to above, and for the time being in force and as relate to the above-mentioned wards, for the purpose of the aforesaid bye-elections, as the electoral rolls for the Assembly Constituencies have since been revised by the Chief Electoral Officer, Delhi, with reference to 01.01.2021 as the qualifying date Preparation of fresh electoral rolls for the above-said wards by this Commission would entail long time besides incurring expenditure in this respect without any value addition at this stage and hence could be safely avoided ;

NOW, THEREFORE, in exercise of the powers conferred upon the Election Commission under the provision to Section 7E of the Delhi Municipal Corporation Act, 1957 as amended by the Delhi Municipal Corporation (Amendment) Act, 2011 read with the provisions of Rule 27 of the Delhi Municipal Corporation (Preparation of Electoral Rolls) Rules, 1957, I, Sanjay Kumar Srivastava, State Election Commissioner of the National Capital Territory of Delhi, hereby direct that the electoral rolls of such Assembly Constituencies, for the time being in force, as relate to the above-mentioned wards of the North & East Delhi Municipal Corporations, shown against each, shall be the electoral rolls for said Municipal Wards, for the purpose of the ensuing bye-elections to the said Wards of the North & East Delhi Municipal Corporations.
