(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] यह छूट निम्नलिखित शर्तों के अधीन हैै :-

¹. दिल्ली मेट्रो रेल कॉर्पोरेशन लिमिटेड, जो कि उपभोगी संस्था के रूप में संदर्भित है, को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 8,36,76,000 /- रूपये (आठ करोड़ छत्तीस लाख छिहत्तर हजार मात्र) की राशि अग्रिम रूप में जमा करवानी होगी।

प्रतिपूरक वृक्षारोपण के लिए साइटों का विवरण इस प्रकार है:

Total 21810 2. उपरोक्त 1 (क) व (ख) के अनुसार, देशी प्रजातियों के 14680 पौधों का 100 % प्रतिपूरक वृक्षारोपण और उनका सात वर्षों तक रखरखाव उपभोगी संस्था की ओर से दिल्ली विकास प्राधिकरण द्वारा किया जायेगा। इस वृक्षारोपण के सफलतापूर्वक स्थापना के बाद उपभोगी संस्था द्वारा निगरानी की जाएगी । हालांकि, दिल्ली मेट्रो रेल कॉर्पोरेशन लिमिटेड वृक्षारोपण और प्रत्यारोपण के लिए जिम्मेदार होगा। इन स्थितियों में से किसी भी विचलन के लिए दिल्ली मेट्रो रेल कॉर्पोरेशन लिमिटेड जिम्मेदार होगा ।

3. 1468 वृक्षों को काटे/ प्रत्यारोपण किए जाने के बदले मे 1:10 के अनुपात मे स्वदेशी प्रजातियों के 6-8 फीट की ऊँ चाई वाले 14680 पौधों का प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के तीन महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण स्थल के अनुसार विशिष्ट वृक्षारोपण तकनीकों के द्वारा किया जाएगा और उपभोगी संस्था द्वारा रखरखाव किया जाएगा ।

4. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जायेगा कि इस प्रस्ताव की योजना को परिवर्तित नहीं किया जाएगा । 5. जो भूमि प्रतिपूरक वृक्षारोपण के लिया आवंटित है, उसका उपयोग किसी अन्य कार्यों के लिए राज्य सरकार की स्वीकृ ति के बिना नहीं किया जाएगा ।

6. उपभोगी संस्था द्वारा विस्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष संरक्षण अधिनियम, ¹⁹⁹⁴ की धारा ¹² के अनुपालन में वृक्ष अधिकारी (उत्तर) को प्रस्तुत किया जाएगा ।

7. उपभोगी संस्था द्वारा वृक्षों को काटे / प्रत्यारोपण शुरू करने से पहले साइट की तैयारी और वृक्षारोपण के लिए एक विस्तृत योजना प्रस्तुत करेगी ।

8. उपभोगी संस्था द्वारा वृक्षारोपण पत्रिका को वन और वन्यजीव विभाग राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार को निर्धारित करेंगी और इसकी एक प्रति प्रत्येक वित्तीय वर्ष के अंत में प्रस्तुत की जाएगी ।

9. उपभोगी संस्था द्वारा प्रतिपूरक वृक्षारोपण/ प्रत्यारोपण स्थल में मृदा नमी संरक्षण कार्य की गतिविधियों को किया जाएगा । 10. अनुमति जारी होने के तुरंत बाद वृक्षों का प्रत्यारोपण शुरू किया जाएगा और इसे छ: महीने के अंतराल में पूर्ण किया जाएगा । प्रत्यारोपण प्रक्रिया के पूर्ण होने का बाद एक सम्पूर्ण रिपोर्ट संबन्धित वृक्ष अधिकारी को प्रस्तुत की जायेगी । प्रत्यारोपण स्थल में प्रत्यारोपित वृक्षों की दूरी 4 मीटर (बिंदु से बिंदु) से कम नहीं होनी चाहिए ।

11. उपभोगी संस्था के द्वारा वृक्ष प्रत्यारोपण नीति 2020 में उल्लिखित सभी शर्तों का पालन किया जाएगा ।

12. उपभोगी संस्था द्वारा वृक्षों की प्रत्यारोपण की प्रगति रिपोर्ट संबंधित निरीक्षण अधिकारी के माध्यम से वृक्ष अधिकारी को प्रस्तुत की जाएगी ।4 DELHI GAZETTE : EXTRAORDINARY PART IV] 13. वृक्षों को प्रत्यारोपण/ काटने के लिए अनुमति उनके स्वयं के जोखिम पर और किसी भी अन्य व्यक्ति के दावे के पक्षपात के बिना, जो वृक्षों और भूमि पर सही हो सकती है, दी जा रही है ।

14. उपभोगी संस्था द्वारा वृक्षों को प्रत्यारोपण/ काटने का कार्य सभी वैधानिक मंजूरियों को लेने के बाद ही शुरू किया जाएगा । 15. उपभोगी संस्था द्वारा वृक्षों का प्रत्यारोपण/ कटाई और उसमें पैदा होने वाली काष्ठ को सार्वजनिक श्मशान मे 90 दिनों के भीतर पूरा किया जाएगा ।

16. उपभोगी संस्था द्वारा 507 वृक्षों को काटने से पूर्व प्रत्यारोपण किया जाएगा । वृक्षों की अनुमति 961 वृक्षो के सफल प्रत्यारोपण और उप- वन संरक्षक (उत्तर) को अनुपालन प्रमाण पत्र प्रस्तुत करने के बाद दी जायेगी ।

17. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जायेगा कि वृक्षों की कटाई से पूर्व कोई लंबित मुकदमेबाजी या स्थगन आदेश किसी भी न्यायालय / अन्य प्राधिकरण द्वारा पारित न हुआ हो ।

18. उपभोगी संस्था द्वारा वृक्षों को काटने के उपरान्त प्राप्त लकड़ियों की नीलामी की जाएगी और उससे प्राप्त धनराशि को सरकार के खाते मे राजस्व के रूप में जमा की जाएगी।

19. उपभोगी संस्था द्वारा वृक्षों के ऊपरी शाखाओं को काटे जाने के पश्चात प्राप्त लकड़ियों को मुफ्त में निकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाएगी और इसकी सूचना वृक्ष अधिकारी (उत्तर) को भी दी जाएगी ।

20. उपभोगी संस्था द्वारा वृक्षों को काटने के स्थल से लकड़ियों को ले जाने से पूर्व वृक्ष अधिकारी (उत्तर) से ढुलाई अनुमति प्राप्त करनी होगी।

21. उपभोगी संस्था के द्वारा पर्यावरण मंजूरी में उल्लिखित सभी शर्तों का पालन किया जाएगा ।

²². उपभोगी संस्था द्वारा ¹⁴⁶⁸ वृक्षो के अलावा किसी भी वृक्ष की प्रत्यारोपण/ कटाई दिल्ली वृक्ष संरक्षण अधिनियम, ¹⁹⁹⁴ के तहत एक अपराध होगा ।

23. वृक्षों को हटाने की अनुमति से पूर्व उप- वन संरक्षक (उत्तर) द्वारा पाया गया वृक्ष संबंधी अपराध (दो मामलों मे) दिल्ली मेट्रो रेल कॉर्पोरेशन लिमिटेड / उपभोगी संस्था द्वारा उपयुक्त रूप से निराकरण कराया जाएगा ।

NOTIFICATION

Delhi, the 22nd February, 2021

F. No. 23/NFD/TC/Felling/2020-21/11239-47.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 13.9198 ha. as detailed below for construction of Maujpur to Majlis Park corridor of Delhi MRTS Project Phase-I, New Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-

2. 100% Compensatory Plantation of 14680 saplings of native species shall be raised and maintained by the DDA on behalf of DMRC for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above. However ensuring Compensatory Plantation and transplantation shall be responsible of DMRC. For any deviation from these conditions DMRC shall be responsible.

3. Plants saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of transplantation/ felling of 1468 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance shall be carried out thereafter, by user agency with their own funds.

4. The User Agency shall ensure that the plan of this proposal shall not be changed.

5. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval of State Government.

6. Detailed plantation schedule shall be submitted by User Agency in compliance with Section 12 of Delhi Preservation of Trees Act (DPTA), 1994 before initiating transplantation/ felling.

7. The User Agency shall submit a detailed plan for site preparation and plantation before initiating transplantation/ felling.

8. The User Agency shall maintain plantation journal as prescribed by the Department of Forest and Wildlife, GNCTD and a copy of the same may be submitted at end of each financial year.

9. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation sites.

10. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than six months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.

11. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency.

12. The progress report of transplantation shall be submitted through inspection officer concerned along with complete details of trees.

13. Permission for transplantation/ felling of all tress is being granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.

14. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency.

15. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public crematorium shall be completed within 90 days.

16. The transplantation shall be carried out prior to felling of 507 nos. of trees permitted herein. The 507 trees shall be removed/ felled after successful transplantation of 961 trees and submission of compliance certificate to Deputy Conservator of Forests (North).

17. The user agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling of trees.

18. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency.

19. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to DCF (North) by User Agency.

20. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (North) by User Agency.

21. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, and other clearances, if any obtained, shall be followed scrupulously.

22. Transplantation/ felling of any tree apart from 1468 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act, 1994.

23. Tree offences (two nos.) detected by DCF (North) shall be resolved/ compounded by DMRC/ User Agency before tree removal permission.
