सं. फा. डी.एम./एस-ई/ एल.ए.सी./भाग-III/2016/114.—जबकि भूमि अधिग्रहण, पुनर्वास और पुनःस्थापन का उचित मुआवजे और पारदर्शिता अधिकार अधिनियम, 2013 की धारा 11 की उपधारा (1) के तहत जारी अधिसूचना संख्या एडीएम/एसई/एलएसी/2016/506 दिनांकित 02.09.2019 के द्वारा जन कार्यो के लिए गांव नंगली रजापुर में सराय काले खां से मयूर विहार, नई दिल्ली तक बारापुल्ला नाले पर एलिवेटेड रोड के निर्माण हेतु परियोजना के लिए भूमि अधिग्रहण हेतु अधिसूचना जारी की गयी थी ;

और जबकि, उक्त अधिनियम की धारा 19 की उप-धारा (7) के अनुसार, इस अधिनियम की धारा 19 के तहत घोषणा प्राथमिक अधिसूचना के जारी होने से 12 महीने की अवधि के भीतर जारी होनी है।और जबकि, 2.09.2020 से 1.03.2021 तक छह महीने की अवधि के लिए समय बढ़ाने की अधिसूचना उक्त अधिनियम, 2013 की धारा 19 की उपधारा 7 के तहत 1.09.2020 पर जारी की गई थी। 1188 DG/2021 (1) 2 DELHI GAZETTE : EXTRAORDINARY PART IV] और जबकि, अधिनियम की धारा 19 के तहत घोषणा जारी करने के लिए समय बढ़ाने के प्रस्ताव को माननीय उपराज्यपाल, दिल्ली द्वारा अनुमोदित किया गया है और घोषणा के लिए समय अगले छह (6) महीने की आगे की अवधि के लिए बढ़ा दिया गया है। इसलिए, अब उपयुक्त सरकार उक्त भूमि अधिग्रहण, पुनर्वास और पुनःस्थापन का उचित मुआवजे और पारदर्शिता अधिकार अधिनियम, 2013 की धारा 19 के तहत घोषणा और घोषणा करने की अवधि को अगले छह (6) महीने की अवधि तक बढ़ाने की अनुमति प्रदान करती है अर्थात 2 मार्च, 2021 से 01 सितंबर 2021 तक ।

NOTIFICATION

Delhi, the 23rd February, 2021

F. No. DM/SE/LAC/Part-III/2016/114.—Whereas a Notification under sub section 1 of Section 11 of the Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 was issued vide notification No. ADM/SE/LAC/2016/506 dated 02.09.2019 for acquisition of land of Village Nangli Razapur, for public purpose, namely for construction of Elevated Road over Barapullaha Nallah starting from Sarai Kale Khan to Mayur Vihar, New Delhi.

And whereas, as per sub-section (7) of Section 19 of the said Act, the declaration under Section 19 of this Act is to be issued within a period of 12 months from the date publication of preliminary notification.

And whereas, a Notification for extension of the time for period of six month from 2.09.2020 to 1.03.2021 was issued on 1.09.2020 under sub section 7 of section 19 of the said Act, 2013.

And whereas, a proposal for further extension of time for issuance of declaration under section 19 of the Act has been approved by the Hon'ble Lieutenant Governor, Delhi and time for declaration has been extended for a further period of six (6) months.

Now, therefore, the appropriate Government in exercise of power conferred under proviso of the sub-section 7 of Section 19 of the Act is pleased to extend the period for issuance of declaration and summary of Rehabilitation and Resettlement under section 19 of the said Act, for further period of six month w.e.f. 2nd March, 2021 to 1st September, 2021.
