सं. एफ. 25(10)/21-आरएन/142/ए-1190-99.—दिल्ली राष्ट्रीय राजधानी राज्यक्षेत्र शासन अधिनियम, 1991 जिसे दिल्ली राष्ट्रीय राजधानी राज्यक्षेत्र शासन (संशोधन) अधिनियम, 2021 के द्वारा संशोधित किया गया है, की धारा 44 की उपधारा (2) के परन्तुक के प्रावधानों के तहत निहित शक्तियों का उपयोग करते हुए, उपराज्यपाल, राष्ट्रीय 2428 DG/2021
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] राजधानी क्षेत्र दिल्ली सरकार, एतद्द्वारा संविधान के अनुच्छेद 239एए की खंड (4) के प्रावधानों के संदर्भ में निम्नलिखित मामलों में मंत्रीपरिषद अथवा किसी मंत्री के निर्णय के अनुपालन में किसी कार्यवाही के निष्पादन से पूर्व राजधानी में लागू किसी कानून के तहत, उपराज्यपाल की राय प्राप्त करने के लिए निर्दिष्ट करते हैं, ताकि सरकार, राज्य सरकार, उपयुक्त सरकार, उपराज्यपाल, प्रशासक अथवा मुख्य आयुक्त, जो भी लागू हो, की शक्तियों का अनुपालन हो सके , अर्थात:-
1. संसद द्वारा निर्मित अथवा कें द्र सरकार द्वारा राष्ट्रीय राजधानी क्षेत्र के लिए विस्तारित किसी विधि के अंतर्गत आने वाले, राज्य की सूची अथवा संविधान की सातवीं अनुसूची की समवर्ती सूची में उद्धृत मामले के संबंध में;
2. दिल्ली विधानसभा द्वारा विधि के तहत विनिर्मित आने वाले निम्नलिखित मामलेः
(क) ऐसे मामले जिनका ऐसे किन्हीं विषयों पर प्रत्यक्ष अथवा अप्रत्यक्ष प्रभाव पड़ता हो, जिनके संबंध में उपराज्यपाल को राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार अधिनियम, 1991 के अनुच्छेद 41 अर्थात, पुलिस, लोक व्यवस्था, भूमि, सेवाओं इत्यादि संबंधी के लिए अपने विवेक से कार्यवाही करनी हो;
(ख) अधीनस्थ कानूनों अर्थात नियम, विनियम, स्कीम, उपविधि इत्यादि बनाना;
(ग) विधिक निकायों जैसे प्राधिकरण, बोर्ड, समिति, आयोग इत्यादि की स्थापना अथवा गठन/पुनर्गठन करना;
(घ) दिल्ली वित्त आयोग अधिनियम, 1994 के तहत गठित दिल्ली वित्त आयोग की सिफारिशों से संबंधित मामले;
(ङ) दिल्ली जेल अधिनियम, 2000 तथा उसके अंतर्गत बने नियमों के तहत पेरोल प्रदान करना;
3. राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के ट्रांजेक्शन ऑफ बिजनेस रूल, 1993 के नियम 23 के तहत विनिर्दिष्ट मामले।

Delhi, the 28th April, 2021
No. F. 25(10)/21-RN/142/A-1190-99.—In exercise of the powers conferred by proviso to sub-section (2) of section 44 of the Government of National Capital Territory of Delhi Act, 1991, as amended by the Government of National Capital Territory of Delhi (Amendment) Act, 2021, the Lieutenant Governor of the National Capital Territory of Delhi , hereby, specifies the following matters for obtaining opinion of the Lieutenant Governor in terms of proviso to clause (4) of article 239AA of the Consti tution, before taking any executive action in pursuance of the decision of the Council of Mi nisters or a Minister, to exercise[PART IV DELHI GAZETTE : EXTRAORDINARY 3 powers of Government, State Government , Appropriate Government , Lieutenant Governor, Administrator or Chief Commissioner, as the case may be, under any law in force in the Capital , namel y:-
1. The matters falling under any law, made by Parliament or extended to the National Capi tal Territory of Delhi by the Central Government , with respect to any matter enumerated in the State List or Concu rrent List of Seventh Schedule of the Constitution ;
2. The following matters falling under any Jaw made by Legi slative Assembly of Delhi :
(a) The matters having, direct or indirect, effect on any of the subjects on which the Lieutenant Governor is to act in his discretion in accordance with section 41 of the Government of National Capital Territory of Delhi Act, 1991 i.e. Police, Public Order. Land , Services, etc.
(b) The mak ing of subordinate legislations i.e. rules, regulation s, schemes, bye-laws, etc. (c) Establishment or Constitution/re-constitution of statutory bodies, such as Authority, Board, Committee, Comm ission, etc.
(d) Matters relating to recommend ations of the Delhi Finance Commission constit uted und er the Delhi Finance Commission Act, 1994;
(e) Grant of parole under the Delhi Prisons Act, 2000 and rules made thereunder.
3. The matters specified under rule 23 of the Transaction of Business of the Government of National Capital Territory of Delhi Rules, 1993.
