फा. सं. 17 डब्लू. ऍफ़. डी./सी. ओं. टी/18-19-2872-80.—दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 (1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, जनहित में बमनौली- झटीकारा 400 के .वी. ट्रांसमिशन लाइन, द्वारका, दिल्ली के लूप इन लूप आउट सकिट के निर्माण हेतु नीचे दिए गए विवरण के अनुसार लगभग 8.4226 हेक्टेयर (लगभग), क्षेत्रफल से उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधो से छूट प्रदान करती है।

1. पावर ग्रिड कॉर्पोरेशन इंडिया लिमिटेड, जो कि उपभोगी संस्था के रूप में संदभित है, को सात वर्ष की अवधि के लिए पौधों के संपूर्ण विकास एवं रखरखाव हेतु निम्नानुसार 1,09,44,000 /- रूपये ( एक करोड़ नौ लाख चौवालीस हजार रुपये मात्र) की राशि अग्रिम रूप में जमा करवानी होगी।

2. उपरोक्त 1(क) के अनुसार, देशी प्रजातियों के 1920 पौधो का 2.41 हेक्टेयर भूमि पर 100 % प्रतिपूरक वृक्षारोपण और उनका सात वर्षो तक रखरखाव वन विभाग द्वारा किया जायेगा (पावर ग्रिड कॉर्पोरेशन इंडिया लिमिटेड द्वारा अधिकृ त पत्र संख्या पीजी/एनआर1/डी.डब्ल्यू/ए.आर.के .ए./400के वी लिलो लाइन/फॉरेस्ट/एफसीए/276 दिनांक 24.06.2020)। इस वृक्षारोपण के सफलतापूर्वक स्थापना के बाद उप वन संरक्षक (उत्तरी) द्वारा निगरानी की जाएगी।
3. उपभोगी संस्था द्वारा उस स्थान के जीपीएस को-ऑडिनेट्स को इंगित करते हुए नया नक्शा प्रस्तुत करेगी जहां वृक्षो का प्रत्यारोपण और प्रतिपूरक वृक्षारोपण किया जाना प्रस्तावित है।
4. 192 वृक्षो को काटे/ प्रत्यारोपण जाने के बदले मे 1:10 के अनुपात मे स्वदेशी प्रजातियों के 6-8 फीट की ऊँ चाई वाले 1920 पौधो का प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के तीन महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण स्थल के अनुसार विशिष्ट वृक्षारोपण तकनीकों के द्वारा किया जाएगा और उपभोगी संस्था द्वारा जमा की गई राशि से वन प्रभाग द्वारा रखरखाव किया जाएगा।
5. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जायेगा कि इस प्रस्ताव की योजना को परिवतित नहीं किया जाएगा।
6. उपभोगी संस्था द्वारा अतिरिक्त साइट सुधार खर्चों को जमा किया जाएगा जो कि वृक्ष अधिकारी द्वारा गणना के अनुसार वृक्षारोपण के लिए उपयुक्त बनाने के लिए आवश्यक हो सकता है।
7. जो भूमि प्रतिपूरक वृक्षारोपण के लिया आवंटित है, उसका उपयोग किसी अन्य कार्यो के लिए राज्य सरकार की स्वीकृ ति के बिना नहीं किया जाएगा।
8. उपभोगी संस्था द्वारा प्रतिपूरक वृक्षारोपण/ प्रत्यारोपण स्थल में मृदा नमी संरक्षण कार्य की गतिविधियों को किया जाएगा। 9. उपभोगी संस्था द्वारा यह सुनिश्चित किया जायेगा कि वृक्षो की कटाई/प्रत्यारोपण से पूर्व कोई लंबित मुकदमेबाजी या स्थगन आदेश किसी भी न्यायालय/अन्य प्राधिकरण द्वारा पारित न हुआ हो।
10. अनुमति जारी होने के तुरंत बाद वृक्षो का प्रत्यारोपण शुरू किया जाएगा और इसे छह महीने के अंतराल में पूर्ण किया जाएगा। प्रत्यारोपण प्रक्रिया के पूर्ण होने का बाद एक सम्पूर्ण रिपोर्ट संबन्धित वृक्ष अधिकारी को प्रस्तुत की जायेगी। प्रत्यारोपण स्थल मे प्रत्यारोपित वृक्षो की दूरी 4 मीटर (बिदु से बिदु) से कम नहीं होनी चाहिए।
11. उपभोगी संस्था के द्वारा वृक्ष प्रत्यारोपण नीति 2020 में उल्लिखित सभी शर्तों का पालन किया जाएगा।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 12. 192 वृक्षो को प्रत्यारोपण/ काटने के लिए अनुमति उनके स्वयं के जोखिम पर और किसी भी अन्य व्यक्ति के दावे के पक्षपात के बिना, जो वृक्षो और भूमि पर सही हो सकती है, दी जा रही है।
13. उपभोगी संस्था द्वारा वृक्षो को प्रत्यारोपण/ काटने का कार्य सभी वैधानिक मंजूरियों को लेने के बाद ही शुरू किया जाएगा । 14. उपभोगी संस्था द्वारा 192 वृक्षो के अलावा किसी भी वृक्ष का प्रत्यारोपण/ कटाई दिल्ली वृक्ष संरक्षण अधिनियम, 1994 के अंतर्गत एक अपराध होगा।
15. उपभोगी संस्था द्वारा वृक्षो की प्रत्यारोपण की प्रगति रिपोर्ट संबंधित निरीक्षण अधिकारी के माध्यम से वृक्ष अधिकारी को प्रस्तुत की जाएगी।
16. उपभोगी संस्था द्वारा वृक्षो को हटाए जाने के उपरान्त प्राप्त लकड़ियों की नीलामी की जाएगी और उससे प्राप्त धनराशि को सरकार के खाते मे राजस्व के रूप में जमा की जाएगी ।
17. उपभोगी संस्था द्वारा वृक्षों के ऊपरी शाखाओं को काटे जाने के प"चात प्राप्त लकड़ियों को मुफ्त में निकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाएगी और इसकी सूचना वृक्ष अधिकारी (दक्षिण) को भी दी जाएगी ।
18. उपभोगी संस्था द्वारा वृक्षो को काटने के स्थल से लकड़ियों को ले जाने से पूर्व वृक्ष अधिकारी (दक्षिण) से ढुलाई अनुमति प्राप्त करनी होगी।
19. उपरोक्त 1(ख) के अनुसार, उपभोगी संस्था द्वारा 53 वृक्षों का प्रत्यारोपण जो साइट पर खड़े है, स्वय की लागत पर किया जाएगा।
20. भूमि स्वामित्व एजेंसी यह सुनिश्चित करेगी कि प्रतिपूरक वृक्षारोपण के लिए प्रस्तावित क्षेत्र में कोई अतिक्रमण न हो । 21. उपभोगी संस्था द्वारा विस्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 12 के अनुपालन में वृक्ष अधिकारी (पश्चिम) को प्रस्तुत किया जाएगा।
22. उपभोगी संस्था द्वारा 139 वृक्षो को काटने से पूर्व प्रत्यारोपण किया जाएगा । 139 वृक्षो की अनुमति 53 वृक्षो के सफल प्रत्यारोपण और उप-वन संरक्षक (पश्चिम) को अनुपालन प्रमाण पत्र प्रस्तुत करने के बाद दी जायेगी ।
23. उपभोगी संस्था के द्वारा पर्यावरण मंजूरी में उल्लिखित सभी शर्तों का पालन किया जाएगा
यह माननीय पर्यावरण एवं वन मंत्री राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के पूर्व अनुमोदन से जारी किया जाता है ।

NOTIFICATION
Delhi, the 30th July, 2021
F. No. 17/WFD/COT/18-19/2872-80.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 8.4226 ha. (approx.) as detailed below for construction of Loop in Loop out circuit of Bamnauli- Jhatikara 400 KV transmission line, Dwarka, Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:—
1. Power Grid Corporation India Limited, herein referred to as User Agency, shall make an advance deposit of an amount of Rs. 1,09,44,000/- (Rupees One Crore Nine Lakh Fourty Four Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

| (b) | Transplantation of 53 no. of trees which are standing on site shall be done by User Agency at1632 sq. Mtr. land in Sector-05, Dwarka, Delhi. |
2. 100% Compensatory Plantation of 1920 saplings of native species shall be raised and maintained by Forest Department (as authorized by PGCIL vide their letter no. PG/NR1/DW/ARKA/400Kv LILO LINE/FOREST/FCA/276 dated 24.06.2020) for Seven years and monitored till its successful establishment at 2.41 hectare indicated at 1 (a) above.
3. The User Agency shall submit fresh drawing indicating the GPS Co-ordinates of site where trees shall be transplanted and compensatory plantation is proposed to be carried out.
4. Plants of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of removal/ transplantation of 192 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance shall be carried out there after by Forest Department by utilizing funds deposited by PGCIL
5. The User Agency shall ensure that the plan of this proposal shall not be changed.
6. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer concerned (as deposits).
7. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval of State Government.
8. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site.
9. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling of trees.
10. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than three (03) months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
11. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency.
12. Permission for transplantation/ felling of 192 number of tress is being granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
13. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency.
14. Transplantation/ felling of any tree apart from 192 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act, 1994.
[PART IV DELHI GAZETTE : EXTRAORDINARY 515. The progress report of transplantation shall be submitted through inspection officer concerned along with complete details of trees.
16. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency.
17. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to DCF (West) by User Agency.
18. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (West) by User Agency.
19. Transplantation of 53 no. of trees which are standing on site shall be done by User Agency with their own funds in the location as indicated at 1 (b) above.
20. Land owning agency shall ensure that there is no encroachment in area proposed for compensatory plantation.
21. Details transplantation schedule shall have to be submitted by User Agency in compliance with Section 12 of DPTA, 1994 before initiating transplantation/ felling.
22. The transplantation shall be carried out prior to felling of 139 nos. of trees permitted herein. The 139 trees shall be removed/ felled after successful transplantation of 53 trees and submission of compliance certificate to DCF (West).
23. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, and other clearances, if any obtained, shall be followed scrupulously.
This issues with prior approval of Hon'ble Minister (Environment & Forests), Govt. of NCT of Delhi.
