राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 6 अक्तूबर, 2021 CIS/Exemption (CIS-01)/Lab/2021/3891-3904.—दिल्ली दुकान एवं संस्थापन अधिनियम 1954 (1954 का दिल्ली अधिनियम 7) की धारा 4 के परन्तुक के अन्तर्गत प्रदत्त शक्तियों को प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, उक्त अधिनियम के संलग्न अनुसूची मेें निम्नलिखित परिवर्द्धन करता है।
उक्त अनुसूची में प्रतिष्ठान, इत्यादि शीर्षक मे वर्तमान प्रविष्टी क्रम संख्या 268 के बाद निम्नलिखित प्रविष्टी को जोडा जायेगा, नाम से :-
अधिनियम की धारा-14,15और 16 से निम्नलिखित शर्तों के अधीनः-
269 मेसर्स कैपीटल रिटेल प्राइवेट लिमिटेड़ जो एल जी एफ एंड ग्राउड़ तल, बी 2/6, पश्चिम विहार, नई दिल्ली- 110063 पर स्थित है।
1. किसी कर्मचारी को एक दिन में 9 घंटे (खाना व आराम के साथ) या एक सप्ताह मेें 48 घंटे से अधिक काम करने के लिये न रखा जायेगा और न अनुमति दी जायेगी। इसके अलावा कोई कर्मचारी एक बार में 5 घंटे से अधिक काम पर नहीं लगाया जायेगा। दिल्ली दुकान एवं 5687 DG/2021
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] संस्थापन अधिनियम 1954 की धारा'8 के अंर्तगत समयोपरि मजदूरी का भुगतान कर्मचारियों को सामान्य दर से दूगने दर पर किया जायेगा । नियोक्ता यह सुनिश्चिित करेगा कि बायोमेट्रिक मशीन के रिकार्ड्स दिल्ली दुकान एव संस्थापन अधिनियम 1954 ंऔर दिल्ली दुकान एव संस्थापन नियम 1954 के अंतर्गत इस तरह के रजिस्टर और रिकार्ड के संरक्षण के लिये कथित समय तक संरक्षित रहे ।
2. यदि पारी मे कार्य चलता हो, तो इस प्रकार से होगा कि किसी भी कर्मचारी को केवल रात्रि पारी में कार्य करने के लिए बाध्य ंनही किया जायेगा ।
3. नियोक्ता उन सभी कर्मचारियों की सुरक्षा और यातायात का उचित प्रबंध करेगा जिन्हें समयोपरि या दिल्ली दुकान एवं संस्थापन, 1954 के अंतर्गत विहित सामान्य कार्यावधि के बाहर पारी में काम करने को कहा गया है तथा नियोक्ता दुकान/संस्थान में वीडियोग्राफी के लिए सी.सी. टी.वी. स्थापित करेगा तथा उसे कम से कम 6 महीने के लिए संरक्षित रखेगा व मांगे जाने पर प्रमुख दुकान निरीक्षक के समक्ष पेश करेगा।
4. यदि किसी कर्मचारी से राष्ट्रीय अवकाश पर काम करवाया जाता है तो उसके लिए कर्मचारी को मुआवजा अवकाश व समयोपरि दोगुना वेतन का भुगतान किया जायेगा।
5. कर्मचारियों को साप्ताहिक अवकाश बारी बारी से दिया
जायेगा ।
6. नियोक्ता यह सुनिश्चिित करेगा कि श्रमिकों को विभिन्न
श्रम कानूनों के तहत सभी कानूनी लाभ जैसे पी.एफ., ई. एस.आई., बोनस व छुट्टी प्रदान की जायेंगी।
7. कर्मचारियों को वेतन की अदायगी चैक या ई.सी.एस. के
द्वारा की जायेगी।
8. इस छूट का किसी अन्य प्राधिकरण/ विभाग/सरकारी एजेंसियों जिसमें पुलिस भी शामिल है द्वारा जारी किसी अधिसूचना/आदेश/सलाह/परिपत्र पर कोई प्रभाव नहीं पडे़गा।
9. इस अधिसूचना की प्रतिलिपि प्रतिष्ठान के कर्मचारीे प्रवेश द्वार पर प्रमुखता से प्रदर्शित किया जायेगा।

NOTIFICATION
Delhi, the 6th October, 2021
No. CIS/Exemption (CIS-01)/Lab/2021/ 3891-3904.—In exercise of powers conferred by the proviso to Section 4 of the Delhi Shops and Establishments Act, 1954 (Delhi Act 7 of 1954), the Lt. Governor of National Capital Territory of Delhi is pleased to make the following addition in the Schedule-1, appended to the said Act. In the said Schedule under "Establishment etc." after the existing entry at serial no. 268 the following entry shall be added, namely:-
From Section 14, 15 and 16 of the Act, subject to the following conditions:-
269 M/s. Capital Retail Pvt. Ltd. situated at LGF & Ground Floor, B2/6, Paschim Vihar, New Delhi- 110063.
(i) No employee shall be employed or allowed to work for more than nine hours (including that of meal and rest) on any day and for not more than forty Eight hours a week. Further, no employee shall be allowed to work for more than five hours at a stretch. Overtime wages shall be paid to eligible employees at double the normal rate as provided under section 8 of the Delhi Shops and Establishment Act, 1954. The employer shall ensure that the records of the Biometric machine if maintained shall be preserved for the duration mentioned for the similar register/record, in Delhi Shops and Establishment Act, 1954 and Rules made there under.
(ii) Shift working, if any, shall be in such a way that no employee is forced to work in night shift only.
(iii) Employer shall make suitable arrangement regarding safety, security and transportation of all the employees, who have been asked to work overtime or in the shift beyond the normal working hours as prescribed in the Delhi Shops and Establishments Act, 1954. Further the employer shall install Closed Circuit Television (CCTV) for videography of the establishment and preserve the same for not less than a period of six months and submit the same on demand from the Chief Inspector of Shops.
(iv) Employees working on national holidays shall be given compensatory leave in lieu thereof, and double rate of wages as overtime.
(v) Weekly off day will be allowed to employees in
rotation.
(vi) The employer shall ensure that the workers are provided all the legal benefits under various labour laws like Minimum Wages, Provident Fund (PF), Employees' State Insurance (ESI), Bonus, Leave facility and the same be put on website of the shop/ establishment.
(vii) Payment of wages of employees shall be made
by cheque/Electronic Clearing Service (ECS).
4 DELHI GAZETTE : EXTRAORDINARY PART IV](viii) This grant of exemption shall have no overriding effect on any notification/ order/advisory/ circular/issued by any other Authority/ Department/Government Agencies
Including Police.
(ix) A copy of this notification shall be prominently displayed at the employee's entrance/exit of the establishment.
