राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 8 अक्तूबर, 2021 गृह मंत्रालय, भारत सरकार की दिनांक 24 सितंबर, 1968 की अधिसूचना सं0 एस.ओ 3532 के साथ पठित भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए तथादिनांक 3सितंबर, 1981 की अधिसूचना संख्या फा० 2(85)/80-एस II द्वारा अधिसूचित पद फोरमैन (कार्य करने वाला) के लिए भर्ती नियमोंके अधिक्रमण में, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, पुरातत्व विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में फोरमैन (वक्र्स) के पद हेतु भर्ती पद्धति को विनियमित करने के लिये निम्नलिखित नियम बनाते है, अर्थात् :-
(i) इन नियमों को पुरातत्व विभाग, फोरमैन (वक्र्स)भर्ती नियमावली, 2021 कहा जायेगा।
(ii) ये दिल्ली राजपत्र में अपने प्रकाशन की तारीख से लागू हाेंगे।
उक्तपदों की संख्या, इनका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर इन नियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे।
उक्त पदों की भर्ती पद्धति, आयु सीमा, योग्यताएं एवं इससे संबंधित अन्य मामलें उक्त अनुसूची के कॉलम (5) से (11) में यथाविनिर्दिष्ट होंगे।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] वह व्यक्ति, (क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या विवाह की संविदा की है; या
(ख) जो एक जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह अनुबंध कर चुका है, वह उक्त पद पर नियुक्ति का पात्र नहीं होगा।
शर्त यह है कि यदि सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्ष पर लागू व्यक्तिगत कानून के अंतर्गत अनुमत है और ऐसा करने के लिये अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन की छूट दे सकती है। 5. जहां सरकार का यह मत हो कि ऐसा करना आवश्यक अथवा समीचीन है, तो वह कारणों को लिखित में अभिलेखबद्ध करते हुए सक्षम अधिकारी के परामर्श से एवं आदेश द्वारा व्यक्तियों की किसी श्रेणी या वर्ग के इन नियमों के किसी उपबंध को छूट दे सकती है। 6. इन नियमों के संबंध में भारत सरकार द्वारा समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिक या अन्य विशेष वर्गों के व्यक्तियों के लिये अपेक्षित आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा।

NOTIFICATION
Delhi, the 8th October, 2021
No. F.2(3)/Estt./Archy/2020/1243.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, read with Government of India, Ministry of Home Affair's Notification number F.27/59-Him(i) dated the 13th July, 1959 and in supersession of the recruitment rules for the post of Foreman (Works) notified vide notification No. F.2(85)/80-S.II dated 30thSeptember, 1981, the Lieutenant Governor of the National Capital Territory of Delhi is pleased to make the following rules regulating the method of recruitment to the post of Foreman (Works) in the Department of Archaeology, Government of National Capital Territory of Delhi, namely:—

(1)These rules may called the Department of Archaeology for the post of Foreman (Works) Recruitment Rules, 2021.
(2) They shall come into force on the date of their publication in the Delhi Gazette.
2. Number of Posts, its classification and level in pay matrix. –
The number of the said post, its classification and level in pay matrix attached thereto shall be as specified in column (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualification etc. -
The method of recruitment, age limit, qualifications and other matters relating to the said post, shall be as specified in the columns (5) to (11) of the said Schedule.
4. Disqualifications. –
No persons, -
(a) Whohas entered into or contracted marriage with a person having a spouse living; or
(b) Who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax. -
Where the Government is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing, and in consultation with the Competent Authority, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving. –
Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-Servicemen and other special categories of persons in accordance with orders issued by Government of India from time to time, in this regard.

(Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Govt. shall ordinarily not to exceed three years. The maximum age limit for appointment by transfer on deputation (including short-term contract)/transfer shall be not exceeding 56 years, as on the closing date of receipt of applications.) |
