I I .—दिल्ली माल और सेवा कर अधिनियम, 2017 (2017 का 03), की धारा 11 की उप धारा (1) और धारा 16 की उप धारा (1) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, परिषद की सिफारिशों के आधार पर, ऐसे माल की अंतःराज्यीय पूर्ति को, जिसका वर्णन नीचे दी गई सारणी के कॉलम (3) में विनिर्दिष्ट है और जो उक्त सारणी के कॉलम (2) की तत्सम्बन्धी प्रविष्टि में यथाविनिर्दिष्ट टैरिफ मद, उप शीर्ष, शीर्ष या अध्याय के अंतर्गत आता है, पूर्वोक्त सारणी के कॉलम (5) की तत्सम्बन्धी प्रविष्टि में यथा विनिर्दिष्ट इस अधिसूचना के उपाबंध में विनिर्दिष्ट सुसंगत शर्तो के अधीन रहते हुए, दिल्ली माल एवं सेवा कर अधिनियम, 2017 (2017 का 03) कि धारा 9 के अधीन उन पर उद्ग्रहणीय उतने राज्य कर से छूट प्रदान करते हैं, जो उक्त सारणी के कॉलम (4) में की तत्सम्बन्धी प्रविष्टि में विनिर्दिष्ट दर पर संगणित रकम से अधिक है :

(i) इस अधिसूचना के प्रयोजनों के लिए, ''टैरिफ मद'', ''उपशीर्ष'', ''शीर्ष'' और ''अध्याय'' से सीमा शुल्क टैरिफ अधिनियम, 1975 (1975 का 51) की पहली अनुसूची में यथाविनिर्दिष्ट क्रमशः टैरिफ मद, उपशीर्ष, शीर्ष और अध्याय अभिप्रेत होगा।
(ii) उक्त सीमा शुल्क टैरिफ अधिनियम, 1975 (1975 का 51) की पहली अनुसूची, जिसके अंतर्गत पहली अनुसूची के अनुभाग और अध्याय टिप्पण तथा साधारण स्पष्टीकरण टिप्पण भी है, के निर्वचन के लिए नियम, जहां तक हो सके, इस अधिसूचना के निर्वचन के लिए लागू होंगे।
| 1 | (क) माल की पूर्ति में अनन्य रुप से प्रयुक्त माल या सेवाओं पर प्रभारित इनपुट कर का प्रत्यय नहीं लिया गया है ; और (ख) माल की पूर्ति के लिए प्रयुक्त माल या सेवा ओं पर प्रभारित इनपुट कर का प्रत्यय और इनपुट कर प्रत्यय के लिए पात्र अन्य पूर्तियाें को भागतः प्रभावित करने के लिए, इस प्रकार उलट दिया जाता है कि मानो ं ऐसे माल की पूर्ति एक छूट प्राप्त पूर्ति है और दिल्ली माल और सेवा कर अधिनियम, 2017 (2017 का 12) की धारा 17 की उपधारा (2) और तदधीन बनाये गए नियम के उपबंध लागू होते । |
2. यह अधिसूचना 1 अप्रैल, 2022 को लागू होगी।

NOTIFICATION
Delhi, the 27th June, 2022
F. No. 3 (7)/Fin.(Exp-I)/2022-23/DS-I/538.—In exercise of the powers conferred by sub-section (1) of section 11 and sub-section (1) of section 16 of the Delhi Goods and Services Tax Act, 2017 (03 of 2017), the Lieutenant Governor of the National Capital Territory of Delhi, on the recommendations of the Council, hereby exempts the intra- state supplies of goods, the description of which is specified in column (3) of the table below, falling under the tariff item, sub-heading, heading or Chapter, as specified in the corresponding entry in column (2) of the said table, from so[PART IV DELHI GAZETTE : EXTRAORDINARY 3 much of the state tax leviable thereon under section 9 of the Delhi Goods and Services Tax Act, 2017 (03 of 2017) as is in excess of the amount calculated at the rate specified in the corresponding entry in column (4) of the said table and subject to the relevant conditions annexed to this notification, the condition number of which is mentioned in the corresponding entry in column (5) of the said table:

Explanation. –
(i) For the purposes of this notification, "Tariff item", "sub-heading", "heading" and "Chapter" shall mean respectively a tariff item, sub-heading, heading and chapter as specified in the First Schedule to the Customs Tariff Act, 1975(51 of 1975).
(ii) The rules for the interpretation of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), including the Section and Chapter Notes and the General Explanatory Notes of the First Schedule shall, so far as may be, apply to the interpretation of this notification.

| 1. | (a) credit of input tax charged on goods or services used exclusively in supplying such goods has not been taken; and (b) credit of input tax charged on goods or services used partly for supplying such goods and partly for effecting other supplies eligible for input tax credits, is reversed as if supply of such goods is an exempt supply and attracts provisions of sub-section (2) of section 17 of the Central Goods and Services Tax Act, 2017 (12 of 2017) and the rules made thereunder. |
2. This notification shall come into force on the 1st day of April, 2022.
