जबकि, मोटर वाहन अधिनियम, 1988 (1988 का 59) की धारा 212 की उप धारा (1) की अपेक्षानुसार दिल्ली ''दिल्ली में पार्क़िग स्थल के अनुरक्षण एवंम प्रबंधन नियम, 2019'' में संशोधन करने के लिए प्रारूप, राष्ट्रीय राजधानी क्षेत्र, दिल्ली सरकार की दिनांक 17 मार्च, 2022 की अधिसूचना संख्या फा.सं. ईओ/सीबी/ईएनएफ/परिवहन/20/35/075618669/23491 को दिल्ली राजपत्र-4 असाधारण में प्रकाशित किया गया था, जिसके द्वारा दिनांक 17 मार्च, 2022 सेे तीस दिन की अवधि के अन्दर, इस से प्रभावित होने वाले सभी व्यक्तियों से आपत्तियां तथा सुझाव आमंत्रित किये गए थे;
और जबकि, उक्त राजपत्र अधिसूचना की प्रतियां जनता को 17 मार्च, 2022 को उपलब्ध कराई गई थी।
और जबकि, उक्त नियम के संबंध में जनता से कोई आपत्ति व सुझाव प्राप्त नहीं हुए।
अतः अब मोटर वाहन अधिनियम, 1988 (1988 का 59) की धारा 2 की उप-धारा (41) तथा धारा 138 की उपधारा (2) के खण्ड (ड़) (ज) एवं (झ) के साथ पठित धारा 117, धारा 127 की उपधारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय राजधानी क्षेत्र, 2 DELHI GAZETTE : EXTRAORDINARY PART IV]
| स् ाक्षिप्त शीर्षक और प्रांरभ ं | 1 | (1) इन नियमों को दिल्ली पार्किग स्थल के अनुरक्षण एवंम प्रबंधन (प्रथम स शोधन) नियम 2022 कहा जाएगा। ं ( 2) ये दिल्ली राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे। |
| नियम-16 में स्ांशोधन | 2 | नियम 16 में दूसरे परंतुक का अंतःस्थापन अर्थात : बशर्ते कि परिवहन आयुक्त उपरोक्त नियमों के नियम 16 में उल्लिखित वाहनों की श्रेणियों के संबंध में सामान्य या विशिष्ट आदेश से पार्किग/कब्जा प्रभार को माफ/ कम कर सकता हैं। |

F.No. EO/CB/ENF/TPT/20/35/075618669/58672: Whereas, the draft to amend the Delhi Maintenance and Management of Parking Places Rules, 2019, was published as required under sub-section (1) of Section 212 of the Motor Vehicles Act, 1988 (59of 1988) by the Government of National Capital Territory of Delhi vide notification number EO/CB/ENF/TPT/20/35/075618669/23491 published in the Delhi Gazette Part-IV, Extraordinary dated 17th March, 2022; And whereas, objections and suggestions were invited from all persons likely to be affected thereby; within thirty days with effect from 17th March, 2022.
And whereas copies of the said Gazette Notification were made available to the public on the 17th March, 2022;
And whereas, no objections or suggestions have been received from the public on the said draft Rules;
Now, therefore, in exercise of the powers conferred by clause (e), (h) and (i) of sub-section (2)of section 138, read with Section 117, sub-section (3) of Section 127 and sub-section (41) of section 2 of Motor Vehicles Act, 1988 (59 of 1988),the Hon'ble Lt. Governor of National Capital Territory of Delhi, makes the following rules; namely:-
RULE
| Short Title and Commencement | 1 | 1) These rules may be called the Delhi Maintenance and Management of Parking Places (First Amendment) Rules, 2022. 2) They shall come into force on the date of their publication in the Delhi Gazette. |
| Amendment in Rule-16 | 2 | Insertion of second proviso in Rule 16 namely: P rovided that the Commissioner of Transport may waive off/reduce the parking/custody charges by general or specific order in respect of the categories of vehicles mentioned in Rule 16 of above said rules. |
