(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा के सदस्यों का (वेतन, भो, पेंशन इत्यादि) अधिनियम, 1994 में पुनः संशोधन करने के लिए भारत गणराज्य के बहतरवें वर्ष में राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा द्वारा यह निम्न रूप से अधिनियमित किया जाएः-

(1) इस अधिनियम को राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा के सदस्यों का (वेतन, भो, पेंशन इत्यादि) (संशोधन) अधिनियम, 2022 कहा जाए।

(2) यह उप-राज्यपाल द्वारा शासकीय राजपत्र में अधिसूचना द्वारा यथानियत तिथि से प्रवृत्त होगा। 2.

राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा के सदस्यों का (वेतन, भो, पेंशन इत्यादि) अधिनियम, 1994 (1995 का दिल्ली अधिनियम 6) (इसके पश्चात ''मूल अधिनियम'' के रूप में संदर्भित) की धारा 3 में -

(क) उपधारा (1) में :-

(i) ''बारह हजार रुपये'' शब्दों के स्थान पर ''तीस हजार रुपये'' शब्दों को प्रतिस्थापित किया जाएगा;

(ii) ''एक हजार रुपये'' शब्दों के स्थान पर ''एक हजार पाँच सौ रुपये'' शब्दों को प्रतिस्थापित किया जाएगा;

(ख) उपधारा (2) में ''अठारह हजार रुपये'' शब्दों के स्थान पर ''पच्चीस हजार रुपये'' शब्दों को प्रतिस्थापित किया जाएगा;

(ग) उपधारा (3) में ''छह हजार रुपये'' शब्दों के स्थान पर ''दस हजार रुपये'' शब्दों को प्रतिस्थापित किया जाएगा;

(घ) उपधारा (4) में ''दस हजार रुपये'' शब्दों के स्थान पर ''पंद्रह हजार रुपये'' शब्दों को प्रतिस्थापित किया जाएगा;

(ङ) उपधारा 4 के प"चात्‌ निम्नलिखित उपधारा को सन्निविष्ट किया जाएगा; अर्थात-

''(5) प्रत्येक कार्यकाल के लिए प्रत्येक सदस्य को लैपटॉप, व्यक्तिगत कंप्यूटर, प्रिंटर, मोबाइल हैंडसेट, इत्यादि की खरीद हेतु एकबारगी भत्ते के रूप में कुल एक लाख रुपये भुगतान किया जाएगा।''

3. मूल अधिनियम की धारा 6 में आए ''आठ हजार रुपये'' शब्दों के स्थान पर ''दस हजार रुपये'' शब्दों को प्रतिस्थापित किया जाएगा;

4. मूल अधिनियम की धारा 6क में आए ''पचास हजार रुपये'' शब्दों के स्थान पर ''एक लाख रुपये'' शब्दों को प्रतिस्थापित किया जाएगा;

5. मूल अधिनियम की धारा 8 की उपधारा (1) में आए ''चार लाख रुपये'' शब्दों के स्थान पर ''आठ लाख रुपये'' शब्दों को प्रतिस्थापित किया जाएगा;

6. मूल अधिनियम की धारा 9 में आए ''सात हजार पाँच सौ रुपये'' शब्दों के स्थान पर ''पंद्रह हजार रुपये'' शब्दों को प्रतिस्थापित किया जाएगा;

पिछले कुछ समय से विधायकों की ओर से मूल्य सूचकांक में वृद्धि को लेकर उनके वेतन और अनुलाभों/सुविधाओं में वृद्धि की मांग लगातार की जा रही है। यह भी अनुभव किया गया कि मंत्रियों/अध्यक्ष/उपाध्यक्ष/नेता-प्रतिपक्ष/मुख्य सचेतक के वेतन/अनुलाभ/सुविधाएं अपर्याप्त हैं जिन्हें एक समानुपातिक सीमा तक उन्नत तथा बढ़ाया जाना चाहिए। इस प्रयोजनार्थ, राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा के सदस्यों ( वेतन, भत्ते, पेंशन इत्यादि ) अधिनियम, 1994 में संशोधन करने के लिए राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा के सदस्यों का (वेतन, भत्ते, पेंशन इत्यादि) (संशोधन) अधिनियम, 2022 को आरंभ किया गया है। इस विधेयक द्वारा राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार की विधानसभा के सदस्यों के वेतन, भत्तों और अन्य सुविधाओं को बढ़ाया जाना प्रस्तावित है, ताकि उन्हें प्रभावी ढंग से कार्य करने में सुविधा हो।

विधेयक पूर्वोक्त उद्देश्यों को प्राप्त करता है।

कैलाश गहलोत, मंत्री (विधि, न्याय एवं विधायी कार्य) राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा के सदस्यों का (वेतन, भाा, पेंशन इत्यादि) (संशोधन) अधिनियम, 2022 किसी अधीनस्थ पदाधिकारियों पर विधायी शक्ति सौंपने की मांग नहीं करता है।

(SALARIES, ALLOWANCES, PENSION, ETC.)

(AMENDMENT) BILL, 2022.

BILL

Further to amend the Members of the Legislative Assembly of the National Capital Territory of Delhi (Salaries, Allowances, Pension, etc.) Act, 1994.

Be it enacted by the Legislative Assembly of the National Capital Territory of Delhi in the Seventy-second year of the Republic of India as follows:-

1. Short title and commencement.- (1) This Act may be called the Members of the Legislative Assembly of the National Capital Territory of Delhi (Salaries, Allowances, Pension, etc.) (Amendment) Act, 2022.

(2) It shall come into force on such date as the Lieutenant Governor may, by notification in the Official Gazette, appoint.

2. Amendment of section 3. – In the Members of the Legislative Assembly of the National Capital Territory of Delhi (Salaries, Allowances, Pension, etc.) Act, 1994, (Delhi Act 06 of 1995) (hereinafter referred to as the principal Act), in section 3, –

(a) in sub-section (1)-

(i) for the words ―twelve thousand rupees‖, the words ―thirty thousand rupees‖, shall be substituted;

(ii) for the words ―one thousand rupees‖, the words ―one thousand five hundred rupees‖, shall be substituted;

(b) in sub-section (2), for the words ―eighteen thousand rupees‖, the words ―twenty five thousand rupees‖, shall be substituted;

(d) in sub- section (4), for the words ―ten thousand rupees‖, the words ―fifteen thousand rupees‖, shall be substituted;

(e) after sub-section (4), the following sub-section shall be inserted, namely.-

"(5) There shall be paid to each Member a sum of rupees one lakh as one time allowance for purchase of

laptop, personal computer, printer, mobile handset etc. for each term of office".

3. Amendment in section 6. – In the principal Act, in section 6, for the words ―eight thousand rupees‖, the words ―ten thousand rupees‖, shall be substituted.

4. Amendment in section 6A.- In the principal Act, in section 6A, for the words ―fifty thousand rupees‖, the words ―one lakh rupees‖, shall be substituted;

5. Amendment in section 8. – In the principal Act, in section 8, in sub-section (1), for the words, ―four lakh rupees‖, the words ―eight lakh rupees‖, shall be substituted.

6. Amendment of section 9. – In the principal Act, in section 9, for the words ―seven thousand five hundred rupees‖, the words, ―fifteen thousand rupees‖, shall be substituted.

STATEMENT OF OBJECTS & REASONS

For some time past, there has been persistent demand from the MLAs for the increase in their salaries and perks/ facilities having regard to the increase in the price index. It was also felt that salaries/ perks/ facilities of Ministers/ Speaker/ Deputy Speaker/ Leader of Opposition/ Chief Whip are a bit inadequate which should be upgraded and enhanced to a commensurate extent.

For the purpose, the Members ofthe Legislative Assembly of the National Capital Territory of Delhi (Salaries, Allowances, Pension, etc) (Amendment) Act, 2022, has been initiated to amend the Members ofthe Legislative Assembly of the National Capital Territory of Delhi (Salaries, Allowances, Pension, etc.) Act, 1994. This Bill proposes to increase the salaries, allowances & other facilities of the Members of the Legislative Assembly of the Government of National Capital Territory of Delhi, so as to facilitate them to work effectively.

The Bill seeks to achieve the aforesaid objectives.

FINANCIAL MEMORANDUM

For the implementation of the proposals contained in the Members of the Legislative Assembly of the National Capital Territory of Delhi (Salaries, Allowances, Pension, etc.) (Amendment) Act, 2022, there will be an additional annual recurring expenditure from the Consolidated Fund of the National Capital Territory of Delhi.

The Members of the Legislative Assembly of the National Capital Territory of Delhi (Salaries, Allowances, Pension, etc.) (Amendment) Act, 2022, does not seek to confer power of legislation on any subordinate functionaries.
