(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा में नेता-प्रतिपक्ष के (वेतन तथा भो) अधिनियम, 2001 में पुनः संशोधन करने के लिए भारत गणराज्य के बहतरवें वर्ष में राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा द्वारा यह निम्न रूप से अधिनियमित किया जाएः-
(1) इस अधिनियम को राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा में नेता-प्रतिपक्ष के (वेतन 1. तथा भो) (संशोधन) अधिनियम, 2022 कहा जाए।
(2) यह उप-राज्यपाल द्वारा शासकीय राजपत्र में अधिसूचना द्वारा यथानियत तिथि से प्रवृत्त होगा। 2. राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा में नेता-प्रतिपक्ष के (वेतन तथा भो) अधिनियम, 2001 (2002 का दिल्ली अधिनियम 6) (इसके पश्चात ''मूल अधिनियम'' के रूप में संदर्भित) की धारा 3 के लिए निम्नलिखित धारा को प्रतिस्थापित किया जाएगा; अर्थात्-
''(3) नेता-प्रतिपक्ष ऐसे वेतन, भत्ते तथा अन्य पात्रताओं को प्राप्त करने के पात्र होंगे जैसा कि राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के मंत्रियों को (वेतन तथा भत्ते) अधिनियम, 1994 के अंतर्गत किसी मंत्री को ग्राह्य है। '' मूल अधिनियम में धारा 4 3. तथा धारा 5 का लोप किया जाएगा और धारा 6, धारा 7, धारा 8 एवं धारा 9 का पुनःक्रमांकन क्रमशः धारा 4, धारा 5, धारा 6 तथा धारा 7 में किया जाएगा । पिछले कुछ समय से विधायकों की ओर से मूल्य सूचकांक में वृद्धि को लेकर उनके वेतन और अनुलाभों/सुविधाओं में वृद्धि की मांग लगातार की जा रही है। यह भी अनुभव किया गया कि मंत्रियों/अध्यक्ष/उपाध्यक्ष/नेता-प्रतिपक्ष/मुख्य सचेतक के वेतन/अनुलाभ/सुविधाएं अपर्याप्त हैं जिन्हें एक समानुपातिक सीमा तक उन्नत तथा बढ़ाया जाना चाहिए। इस प्रयोजनार्थ, राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा में नेता-प्रतिपक्ष के (वेतन तथा भो) अधिनियम, 2001 में संशोधन करने के लिए राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा में नेता-प्रतिपक्ष (संशोधन) अधिनियम, 2022 को आरंभ किया गया है। इस विधेयक द्वारा राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार की विधानसभा में नेता-प्रतिपक्ष के वेतन, भत्तों और अन्य सुविधाओं को बढ़ाया जाना प्रस्तावित है, ताकि उन्हें प्रभावी ढंग से कार्य करने में सुविधा हो।
विधेयक पूर्वोक्त उद्देश्यों को प्राप्त करता है।
कैलाश गहलोत, मंत्री (विधि, न्याय एवं विधायी कार्य) राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा में नेता-प्रतिपक्ष के (वेतन तथा भत्ते) (संशोधन) अधिनियम, 2022 में निहित प्रस्तावों के कार्यान्वयन हेतु अतिरिक्त वार्षिक आवर्ती व्यय राष्ट्रीय राजधानी क्षेत्र दिल्ली की संचित निधि से किया जाएगा।
कैलाश गहलोत, मंत्री (विधि, न्याय एवं विधायी कार्य) राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा में नेता-प्रतिपक्ष के (वेतन तथा भत्ते) (संशोधन) अधिनियम, 2022 किसी अधीनस्थ पदाधिकारियों पर विधायी शक्ति सौंपने की मांग नहीं करता है।

BILL
Further to amend the Leader of Opposition in the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) Act, 2001.
Be it enacted by the legislative Assembly of the National Capital Territory of Delhi in the Seventy-second year of the Republic of India as follows:-
1. Short title and commencement.—(1) This Act may be called the Leader of Opposition in the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) (Amendment) Act, 2022.
(2) It shall come into force on such date as the Lieutenant Governor may, by notification in the Official Gazette, appoint.
2. Amendment of section 3. – In the Leader of Opposition in the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) Act, 2001 (Delhi Act 6 of 2002) (hereinafter referred to as the principal Act), for section 3, the following section shall be substituted, namely:-
"(3) The Leader of Oppositionshall be entitled to receive a salary, allowances, and such other entitlements as
are admissible to a Minister under the Ministers of the Government of the National Capital Territory of Delhi
(Salaries and Allowances) Act, 1994.".
3. Omission of section 4 and section 5 and re-numbering of section 6, section 7, section 8 and section 9. – In the principal Act, section 4 and section 5 shall be omitted, and section 6, section 7, section 8 and section 9 shall be re- numbered as section 4, section 5 section 6and section 7, respectively.
STATEMENT OF OBJECTS & REASONS
For some time past, there has been persistent demand from the MLAs for the increase in their salaries and perks/ facilities having regard to the increase in the price index. It was also felt that the salaries/ perks/ facilities of Ministers/ Speaker/ Deputy Speaker/ Leader of Opposition/ Chief Whip are a bit inadequate which should be upgraded and enhanced to a commensurate extent.
For the purpose, the Leader of Opposition in the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) (Amendment) Act, 2022, has been initiated to amend the Leader of Opposition in the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) Act, 2001. This Bill proposes to increase the salaries, allowances & other facilities of the Leader of Opposition in the Legislative Assembly of the Government of National Capital Territory of Delhi, so as to facilitate him to work effectively.
The Bill seeks to achieve the aforesaid objectives.

FINANCIAL MEMORANDUM
For the implementation of the proposals contained in the Leader of Opposition in the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) (Amendment) Act, 2022, there will be an additional annual recurring expenditure from the Consolidated Fund of the National Capital Territory of Delhi.

The Leader of Opposition in the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) (Amendment) Act, 2022, does not seek to confer power of legislation on any subordinate functionaries.
