F. No. 92/WFD/COT/19-20/6473-80.—-दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29(1994 का दिल्ली अधिनियम 11) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए जनहित में राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, दिल्ली एमआरटीएस परियोजना चरण- प्टए नई दिल्ली के एरोसिटी से तुगलकाबाद कॉरिडोर के एरोसिटी और वसंत कु ं ज में मेट्रो स्टेशन के निर्माण हेतु नीचेदिए गए विवरण के अनुसार 4.911 हेक्टेयर लगभग क्षेत्रफल से उक्त अधिनियम की धारा 9की उपधारा (3) के उपबंधो स ेछूट प्रदान करती है।

यह छूट निम्नलिखित शर्तो के अधीनहै :-

नियम एवं शर्तें

1. दिल्ली मेट्रो रेल कॉर्पोरेशन,जो कि उपभोगी संस्था के रूप में संदर्भित है,कोसात वर्षोंकी अवधि के लिए पौधों के सम्पूर्ण विकास एवं रखरखाव हेतुउपरोक्तानुसार3,79,62,000/-रुपये¼तीन करोड़ उनासी लाख बासठ हजार मात्र @ रु. 57000/- प्रति वृक्ष)की राशि अग्रिम रूप से जमा करवानी होगी और यदि उपभोगी संस्थाद्वारा2, 3, 4 और 5 में उल्लिखितनियमों और शर्तों का पालन नहीं किया जाता है, तो इसराशिकोजब्त कर लिया जाएगा और इस राशि को वन विभाग द्वारा वृक्षारोपण के लिए उपयोग किया जाएगा ।

2. उपभोगी संस्थाअनुमति से पूर्व 47वृक्षों (देशी वृक्षों में से 472) के प्रत्यारोपण के लिए अतिरिक्त वृक्षप्रत्यारोपण भूमि प्रस्तुत करेगी।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 3. उपभोगी संस्था द्वारा वृक्षोंकी कटाई/ प्रत्यारोपण शुरू करने से पहले निम्नलिखित शर्तों को पूरा किया जाएगा:-

a. दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 12 के अनुपालन में उपभोगी संस्था द्वारा संबंधित वृक्ष अधिकारी को विस्तृत वृक्षारोपण कार्यक्रम प्रस्तुत प्रस्तुत किया जाएगा ।

b. उपभोगी संस्था द्वारा साइट की तैयारी और वृक्षारोपण के लिए एक विस्तृत योजना प्रस्तुत किया जाएगा । c. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जायेगा कि वृक्षो की कटाई/ प्रत्यारोपण से पूर्व कोई लंबित मुकदमेबाजी या स्थगन आदेश किसी भी न्यायालय / अन्य प्राधिकरण द्वारा पारित न हुआ हो।

d. उपभोगी संस्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कार्य सभी वैधानिक मंजूरियों को लेने के बाद ही शुरू किया जाएगा।

e. उपभोगी संस्था के द्वारा वनमंजूरी में और अन्य मंजूरी में उल्लिखित सभी शर्तों शर्तों, यदि कोई हो, का निष्ठापूर्वक पालन किया जाएगा ।

f. यह उस परियोजना का हिस्सा है जिसमें वन (संरक्षण) अधिनियम के तहत वन भूमि का व्यपवर्तन (diversion) शामिल है। इसलिए, उपभोगी संस्था (https://parivesh.nic.in/writereaddata/FC/HANDBOOK_GUIDELINES/HANDBOOK_GUIDELI NES18_03_2019.pdf) द्वारा वन (संरक्षण) अधिनियम की हैंडबुक के अनुसार दिशानिर्देशों का निष्ठापूर्वक पालन किया जायेगा ।

g. रिज मैनेजमेंट बोर्ड (आरएमबी) द्वारा स्वीकृ त और माननीय सर्वोच्च न्यायालय द्वारा अनुमोदित परियोजना के लिए निर्धारित परियोजना लागत का 5% आरएमबी के पास उपभोगी संस्था द्वारा जमा किया जायेगा और इसे वृक्ष अधिकारी (पश्चिम) को अवगत कराया जाये।

4. वृक्षों की कटाई/ प्रत्यारोपण के दौरान निम्नलिखित शर्तों को पूरा किया जाएगा:-

a. क्र .सं. 2और3में शर्तों के संतुष्ट होने के तुरंत बाद उपभोगी संस्था द्वारा वृक्षो का प्रत्यारोपण शुरू किया जाएगा और इसे छ:महीने के अंतराल में पूर्ण किया जाएगा ।प्रत्यारोपण प्रक्रिया के पूर्ण होने का बाद एक सम्पूर्ण रिपोर्ट संबन्धित वृक्ष अधिकारी को प्रस्तुत की जायेगी । प्रत्यारोपण स्थल मे प्रत्यारोपित वृक्षो की दूरी 4 मीटर (बिंदु से बिंदु) से कम नहीं होनी चाहिए ।

b. उपभोगी संस्था के द्वारा वृक्ष प्रत्यारोपणनीति 2020में उल्लिखित सभी शर्तों का पालन किया जाएगा । c. उपभोगी संस्था द्वारा 194वृक्षो को काटने से पूर्व प्रत्यारोपण किया जाएगा । 194वृक्षो की अनुमति 472वृक्षो के सफल प्रत्यारोपण और उप- वन संरक्षक (पश्चिम) को अनुपालन प्रमाण पत्र प्रस्तुत करने के बाद दी जायेगी। d. प्रतिरोपण/कटाई की प्रगति रिपोर्ट निरीक्षण अधिकारी के माध्यम से संबंधित वृक्ष अधिकारी को वृक्षों के पूर्ण विवरण के साथ प्रस्तुत की जाएगी।

e. यदि किसी वृक्ष में पक्षियों का घोंसला पाया जाता है तो उसे तब तक नहीं काटा/ प्रत्यारोपण किया जाएगा जब तक कि पक्षी उसे छोड़ न दें।

f. उपभोगी संस्था द्वारा 666वृक्षो के अलावा किसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष संरक्षण अधिनियम, 1994 के अन्तर्गत एक अपराध होगा।

g. उपभोगी संस्था द्वारा वृक्षो को हटाए जाने के उपरान्त प्राप्त लकड़ियों की नीलामी की जाएगी और उससे प्राप्त धन राशि को सरकार के खाते मे राजस्व के रूप में जमाकीजाएगी।

h. उपभोगी संस्थाद्वारावृक्षों के ऊपरी शाखाओंको काटे जाने के उपरान्त प्राप्तलकड़ियों को मुफ्त में निकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाएगीऔर इसकी सूचना वृक्ष अधिकारी (पश्चिम) को भी दी जाएगी। i. उपभोगी संस्थाद्वारावृक्षो को हटाए जाने के स्थल से लकड़ियों को को ले जाने से पूर्व वृक्ष अधिकारी (पश्चिम) से ढुलाई अनुमति प्राप्त करनी होगी।

j. उपभोगी संस्थाद्वारावृक्षो की प्रत्यारोपण/ कटाई और उसमें पैदा होने वाली वन उपज को सार्वजनिक श्मशान मे 90 दिनों के अंदर पूरा किया जाएगा ।

k. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जायेगा कि इस प्रस्ताव की योजना को परिवर्तित नहीं किया जाएगा । l. उपभोगी संस्था के द्वारा वनमंजूरी में और अन्य मंजूरी में उल्लिखित सभी शर्तों शर्तों, यदि कोई हो, का निष्ठापूर्वक पालन किया जाएगा ।

m. उपभोगी संस्था के द्वारा अनुमोदित वृक्ष संरक्षण योजना के अंतर्गतप्रस्तुत सभी गतिविधियों का निष्ठापूर्वक पालन किया जाएगा ।4 DELHI GAZETTE : EXTRAORDINARY PART IV] n. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जाएगा कि वृक्षप्रत्यारोपण नीति 2020 की धारा 4 (6-बी) के अंतर्गतसभी प्रावधानों का निष्ठापूर्वक पालन किया गया है और इसका विवरण संबंधित वृक्ष अधिकारी को प्रस्तुत किया जाएगा ।उपभोगी संस्था के द्वारा यह सुनिश्चित किया जाएगा कि सभी प्रतिरोपित वृक्षों के लिए जो 15 फीट ऊं चाई और कम से कम 6 इंच व्यास वाले स्वदेशी वृक्ष प्रजातियों में जीवित नहीं रहपाते हैं, तो उन्हें 1:5 के अनुपात में लगाया जाएगा । आवश्यक अतिरिक्त भूमि उपभोगी संस्था द्वारा प्रदान की जाएगीऔर वृक्षारोपण स्वयं की लागत पर किया जाएगा।

5. वृक्ष अधिकारी द्वारा सफल वृक्षारोपण और जमानत राशि जारी करने पर विचार करने के लिए निम्नलिखित शर्तों को पूरा किया जाएगा:

a. उपरोक्ततालिका1 (क) और (ख) के अनुसार, देशी प्रजातियों के 6660पौधो का 100 %प्रतिपूरकवृक्षारोपण और उनका सात वर्षो तकरखरखावउपभोगी संस्थाद्वारा किया जायेगा। इस वृक्षारोपण के सफलतापूर्वक स्थापना के बाद उपभोगी संस्था द्वारा निगरानी की जाएगी।

b. 666वृक्षो के प्रत्यारोपण/ काटेकिए जाने के बदले मे 1:10 के अनुपात मे स्वदेशी प्रजातियों के 6-8 फीट की ऊँ चाई वाले 6660पौधो का प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के तीनमहीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण स्थल के अनुसार विशिष्ट वृक्षारोपण तकनीकों के द्वारा किया जाएगा और अग्रिम सात (7) वर्षों के लिए रखरखाव तथा उसके बादउनका रखरखाव उपभोगी संस्था द्वाराअपनी स्वयं की लागत पर किया जाएगा ।

c. यदि उपभोगी संस्था सफलतापूर्वक प्रतिपूरक वृक्षारोपण करने में विफल रहती है।उपभोगी संस्थाद्वारा अतिरिक्त साइट सुधार खर्चों को जमा किया जाएगाजो कि वृक्ष अधिकारी (पश्चिम)द्वारा गणना के अनुसार वृक्षारोपण के लिए उपयुक्त बनाने के लिए आवश्यक हो सकती है।

d. जो भूमि प्रतिपूरक वृक्षारोपण/ वृक्ष प्रत्यारोपण के लिए आवंटित है, उसका उपयोग किसी अन्य कार्यो के लिए राज्य सरकारकी स्वीकृ ति के बिना नहीं किया जाएगा।

e. उपभोगी संस्था द्वारा वृक्षारोपण पत्रिका को वन और वन्यजीव विभाग राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार को निर्धारित करेंगी और इसकी एक प्रति प्रत्येक वित्तीय वर्ष के अंत में वृक्ष अधिकारी ¼ पश्चिम ½ कोप्रस्तुत की जाएगी ।

f. भूमि स्वामित्व एजेंसी यह सुनिश्चित करेगी कि प्रतिपूरक वृक्षारोपण के लिए प्रस्तावित क्षेत्र में कोई अतिक्रमण न हो । g. उपभोगी संस्था द्वारा प्रतिपूरक वृक्षारोपण/ प्रत्यारोपण स्थल में मृदा नमी संरक्षण कार्य की गतिविधियों को किया जाएगा।

h. उपभोगी संस्था के द्वारा यह सुनिश्चित किया जायेगा कि इस प्रस्ताव की योजना को परिवर्तित नहीं किया जाएगा । i. यदि परियोजना लागत संशोधित हो जाती है, तो अतिरिक्त सुरक्षा राशि जारी करने के अनुरोध से पहले उपभोगी संस्था के द्वारा आरएमबी के पास जमा कर दीजाए।

6. 666 वृक्षो को प्रत्यारोपण/ काटनेके लिएअनुमति उनके स्वयं के जोखिम पर और किसी भी अन्य व्यक्ति के दावे के पक्षपात के बिना, जो वृक्षो और भूमि पर सही हो सकती है, दी जा रही है ।

यह माननीय पर्यावरण एवं वन मंत्री राष्ट्रीयराजधानी क्षेत्र दिल्ली सरकार के पूर्व अनुमोदन से जारी किया जाता है ।

NOTIFICATION

Delhi, the 25th August, 2022

F. No. 92/WFD/COT/19-20/6473-80.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 4.911ha approx.for construction ofMetro Station at Aerocity and VasantKunj of Aerocity to Tughlakabad Corridor of Delhi MRTS Project Phase-IV, New Delhifrom the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-

TERMS & CONDITIONS

1. Delhi Metro Rail Corporation (DMRC) herein referred to as User Agency, shall make an advance deposit of an amount of Rs.3,79,62,000/- (rupees ThreeCroreSeventy Nine Lakh Sixty Two Thousand Only @ Rs. 57000/- per tree) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3, 4 & 5 are not followed by User Agency.

2. The User Agency shall submit the additional Tree Transplantation land for accommodation of 47 trees (472 of the indigenous trees) before final permission.

3. The following conditions shall be fulfilled before starting felling / transplantation of trees by User

Agency:

a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer in compliance with Section-12 of Delhi Preservation of Trees Act, 1994.

b. User Agency shall submit a detailed plan for site preparation and plantation.

c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees.

d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall necessarily be obtained by the User Agency.

e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other clearances, if any obtained, shall be followed scrupulously.

f. This is part of project in which diversion of forest land under Forest (Conservation) Act is involved. Hence, guidelines as per Handbook of FCA should be followed scrupulously by User Agency (https://parivesh.nic.in/writereaddata/FC/HANDBOOK_GUIDELINES/HANDBOOK_GUIDELINES18_ 03_2019.pdf).

g. 5% of the project cost as prescribed for project cleared by Ridge Management Board (RMB) and approved by Hon'ble Supreme Court should be deposited with RMB and the same is conveyed to Tree Officer (West).

4. The following conditions shall be fulfilled during the felling/ transplantation of trees:

a. Transplantation of trees shall be initiated immediately after conditions in point no. 2& 3 is satisfied and should be completed not later than six (06) months of such date, after which a completion report has to be submitted to theTree Officer concerned. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.

b. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency.

c. The transplantation shall be carried out prior to felling of 194 nos. of trees permitted herein. The 194 trees shall be removed / felled after successful transplantation of 472 trees and submission of compliance certificate to DCF (West).

d. The progress report of transplantation / felling shall be submitted through inspection officer to concerned Tree Officer along with complete details of trees.

e. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned by the birds.

f. Transplantation / felling of any tree apart from 666 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act (DPTA), 1994.

g. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency.

h. The lops& tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same should be reported to DCF (West) by User Agency.

i. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (West) by User Agency.

j. Transplantation / felling of trees and transportation of forest produce arising there from to the public crematorium shall be completed within 90 days.

k. The User Agency shall ensure that the plan of this proposal shall not be changed.

l. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other clearances, if any obtained, shall be followed scrupulously.

m. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.

n. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy 2020 have been followed and details of the same should be submitted to the Tree Officer concerned.

o. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with 15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be provided by User Agency & plantation has to be done at own cost.

5. The following conditions shall be fulfilled for considering successful plantation & release of Security

Deposit by the Tree officer:

a. 100% Compensatory Plantation of 6660 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as mentioned on table above.

b. 6660 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of felling/ transplantation 666 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds.

c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer concerned (as deposits).

d. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other purpose without the approval of the State Government.

e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife, Govt. of NCT of Delhi and a copy of the same shall be submitted to the Tree Officer (West) at the end of every financial year.

f. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory plantation/ transplantation.

g. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site.

h. The User Agency shall ensure that the plan of this proposal shall not be changed.

i. If project costs get revised, the additional amount should be deposited with RMB before requesting for release of security deposit.

6. Permission for transplantation/ felling of 666 nos. of tress is being granted to the User Agency at their own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land or the trees.

This issues with prior approval of Hon'ble Minister (Environment & Forests), Govt. of NCT of Delhi.
